Rr~SOLUTION RELATING TO SETTLEMENT OF•
COLLTNS VS. RTCHFTELD
WHEREAS, Patrick .C. Collins and Loralyn A. Collins, husband and wife, have
brought legal action against the Village of Richfield in which they claim damages
caused by flooding of their property and further damages caused by depreciation
in their property by reason of raising the elevation of the street in front of
their property, and
`WHEREAS, this Council is informed that if damage to their property has been
caused by a change in the elevation of the street as alleged by them the Village
of Richfield can be held liable for such damage, and
WHEREAS, the Village of Richfield has employed two professional appraisers to
appraise the damage by way of depreciation to the prop erty of said claimants, which
damage has been appraised at X1,700 exclusive of damage caused by flooding, which
,.appraisal is substantially less than the depreciation claimed by said persons, and
WHEREAS, the~Village of Richfield has been provided with an affidavit by said
claimants to the effect that they have sustained damage to property from flooding
in the amount of ~765.lt0.exclusive of their own time and labor, and
WHEREAS; i't.now~.appeare that,. an~.amicable settlement of the claims of said
persons can be reached on the basis hereinafter set forth, which this Council
believes to be~a fair and reasonable settlement, _
NOW THEREFORE BE IT RESOLVED by the Village Council of the Village of
Richfield°as follows:
1. That it is hereby determined to pay the sum of X2,250 to Patrick C.
Collins and Loralyn ~,. Collins in .full and complete settlement of their above
mentioned claims, and that such payment constitutes a fair and equitable .settlement
of said claim.
2. That the mayor; manager, finHnce officer and attorney are hereby author-
ized and directed to take any and all steps necessary to secure a settlement of
said claims and `lawsuit en the basis aforesaid.
