Purpose. For the purpose of promoting the health, safety, order, conveni- ence, prosperity and general welfare by regulating the loca- tion, size, .use and height of buildings, the arrangement of buildings and lots, and the den-. city of population within the. Village of Richfield, Hennepin County, Minnesota, the said Vil-. loge of Richfield do ordain as •~ follows: Section 2. Title. Section 4. Definitions. For the purpose of this ordinance cer- tain terms used herein are de-' fined as follows: Apartment: A room or suite of rooms which is designed for, in-. tended' for or occupied by one family and equipped with cook-. ing facilities. Automobile Camp: Land' or ~ premises used or intended far f: occupancy by trailers or mov- able dwellings. rooms or sleep- l ing quarters of any kind, in- eluding trailer coach parks. Automobile Court: A group of two or more detached or semi- detached buildings containing guest rooms or apartments ` which group is designed, in- tended or used primarily for the ..accommodation of automobile travelers; includ ng groups de- s d as auto cabins, motor 1 motels and by similar Potions. mobile Wrecking: Bee J Yards. Block: That property abut- ting on one side of a street and lying between, the two nearest ~ intersecting or intercepting streets or projected streets and another street, railroad right- ofi-way or unsubdivided acreage. Tuilding, Accessory: A subor- dinate building, the use of which is incidental to that of .a. main,. building on the same lot.. Building, Main: A building ixi which is conducted the princi- pal use of the lot upon which it is situated. Court: An open, unoccupied space bounded on two or morn' sides by the exterior walls of a. building or buildings on the same lot. Dwelling: A building or por- tion thereof used exclusively for residence occupancy, includ- ing one-family, two-family, and multiple dwellings but not in- chiding hotels, or lodging or. boarding houses. Dwelling, One-Family: A building used exclusively for occupancy by one family. Dwelling, Two-Family: A. building used exclusively for oc-. cupancy by two families living. independently of each other. Dwelling, Multiple: A build- ing or portion thereof used for occupancy by three or more fa- milies living independently of each other. Dwelling Unit: A dwelling or portion of a dwelling or of an apartment hotel used by one family for cooking, living and sleeping. Family: One or more persons occupying a premises and living. as a .single, non-profit house- keeping unit, as distinguished from a group occupying a hotel, club, fraternity or sorority house. A family includes neces- sary servants. Garage, Private: An accessory building for only the storage of selfi-propelled vehicles. Garage, Public: Any premises ,except those herein defined as a private or storage garage,. used for the storage or care of self-propelled vehicles or where any such vehicles are equipped for operation or repair or kept for remuneration, hire or sale. Height of building: The ver- tical distance from the average level of the highest and lowest point of that portion of the hot covered by the building to the highest point of the roof for flat roofs; to the deck line of man- sard roofs; and to the mean height between eaves and ridge fior gable, hip and gambrel roofs. Home Occupation: Any use customarily conducted entirely within a dwelling by the occu- pants only, which use is clearly, incidental and secondary to the use of the dwelling for dwelling purposes and does not change the character thereof. Any ac- tivity to such an extent that it is noticeable that the property ~ is being used for non-resdential purposes shall not constitute a home occupation. Hotel: Any building or por- tion thereof where lodging is offiered to transient guests for compensation and in which there are more than five sleep- ing rooms with no cooking fa- cilities in an individual room ar apartment. Junk Yard: Land or building used for the storage or keeping of ~ unk, including scrap metals, or for the dismantling or "wrecking of automobiles or other vehicles or machinery, other than the storage of ma- terials which is incidental or accessory to any business or in- dustrial use on the same -lot. Lot, Corner: A lot situated at the intersection of two or more streets, or bounded on two or more adiacent sides by street lines. Lot, Interior: A lot other than. a corner lot. Lot, Hey: The first lot to the rear oP a corner lot, the front line of which is a continuation of the side line of the corner lot, exclusive of the width of any alley, and fronting on the street which intersects or in- tercepts the street on which the corner lot fronts. Non-Conforming Use: A use lawfully in existence on the ef- fective date of this ordinance and not conforming to the re- gulations for the district in which it is situated, except that such a use is not nonconform- ing if it would be authorized under special use permit where located. Story: That portion of a building included between the surface of any floor and the surface of the next floor above it, or if there is no floor above it, then the space between the floor and the ceiling next above it. Story, Half : That portion of a building under a gable, hip or gambrel roof the wall plates of which, on at least two opposite exterior walls, are not more than two feet above the floor of such story. Structure: Anything con- structed or erected, the use of which requires location on the ground or attachment to some- thing having location on the ground. Structural ..Alterations: Any change in the supporting mem- bers of a building such as beax- ing walls, columns, beams or girders. Use: The purpose for which land or premises or a building thereon is designed, arranged or intended or for which it is or may be occupied or maintained. Use, Accessory: A use inciden- tal and accessory to the princi- pal use ofi a lot ar a building located on the same lot as the .accessory use. Yard: Any open space other than a court on the same lot . with a building, whiich open ~ space is unoccupied and tnaob- ' structed from the ground up- ward, except as otherwise pro- vided in. Section 15 of this or- dinance. In measuring a yard, the line of a building means a line parallel to the nearest. lot line drawn through the .point of a building or the point of a dwelling group nearest to such lot line, exclusive of the respee- five architectural features enu- merated in Section 15 of this ordinance as not to be consid- erect in measuring yard dimen- signs or as being permitted to , extend into any front, side or I rear yard, respectively; and the measurement shall be taken from the line of the building to the nearest lot line. Yard, Front: A yard extend- ing across the front of the lot between the inner side yard lines and lying between the front line of the lot and the nearest line of the building. Yard, Rear: A yard extending across the full width of the lot and lying between the rear line of the lot and the nearest line of the building. Yard,. Side: A yard between the side line of the lot and the nearest line of the building and extending from the front line of the lot to the rear yard. Section 5. Establishment of Districts. For the purpose of this ordinance the Village of Richfield, Minnesota, is divided into the following use districts: R -Residential Districts MR - Multiple Residence Dwelling C-1 -Neighborhood Business District C-2 - Qeneral Commercial District T -Industrial District OD -Open Development Ds- trict The symbols opposite the names describing each use dis- trict above may be used in. place of the name of the use district in succeeding provisions ofi this ordinance. Restaurant, cafe and soda Fountain not including dancing, on-sale deer, or the serving of alcoholic beverages. 4. The businesses specified as permitted shall be conducted wholly within a completely en- closed building, except For the sale of automobile fuel, lubri- cants and fluids at service sta- tions and except for off-street parking and loading; goods shall consist of primarily new merchandise; goods shall not be stored, processed or sold which are abjectionable by reason of odor, dust, fumes, noise, vibra- tion, refuse matter or water car- ried waste. S. Height Regulations. In a "C-1" district no building shall hereafter be erected or struc- turally altered to exceed 3 stor- ies or 40 Peet in height subject to modifiucations and exceptions provided in Section 15. C. Lot Area, and Yard Re- quirements. The Following -mi- nimum requirements shall be observed for all buildings here- after erected ar structurally al- tered in a "C-1" District, sub- ject to modifications and ex- ceptions provided in Section 15. 1. Any dwelling shall conform to the requirements oP an "R" District as set forth in Section 7. 2. Front Yard: Each building shall have a Front yard oP not less than 40 feet. 3. Side Yard: No side yards shall be required except as Pou- lows: a. On a corner lot adjacent to a key lot in a residential dus- triet there shall be a side yard adjacent to the street of a width equal to not less than one-half the depth required for front yards on the lots to the rear of such corner lots. b. Along that side of every lot in a commercial district border- ing upon property in the "R" District there shall be a side yard of not less than 15 feet. 4. Rear Yard. There she'll be a rear yard in every lot in a "C-1" District equal to 20% oP the depth of the lot to a maxi- mum required depth of 25 feet Por such lot, provided that such rear yard may be reduced one foot for each one foot of front yard provided in excess of the minimum requurement for front yard set forth in this ordinance fora "C-1" District, and pro- vided that said rear yard must be at least ten feet. No tower, gable, spire, or similar structure shall be used for sleeping or eating quarters' or for any commercial purpose except one incidental to the per- mitted uses of the main build- ing. c. No building or structure in any district shall ever exceed a maximum height of 150 feet, ex- cept that the height limita- tions of this ordinance shall not apply to chimneys, church spires, flag poles, monuments and radio towers. 4. When the average slope of a lot is greater .than one foot rise or fall in seven feet of dis- tance from the established street elevation at the property line, one story in addition to the number permitted in the district ixi which the lot is sit- uated shall be permitted on the downhill side of any building if the height of the buildin is not increased above the lixni~ speci- fied for the district. B. Yards. 1. For the purpose of compu- ting front yard dimensions, measurements shall be taken from the nearest point of the front wall of the building to the street line, subject to the following qualifications: a. Cornices, canopies or eaves may extend into the required front yard a distance of not ex- ceeding two feet, six inches. b. Fire escapes ma.y extend into the required front yard a distance not exceeding four feet, six inches. c. A landing place or uncov- ered porch may extend into the required front yard to a distance not exceeding six Peet, if the'. landing place or porch has its floor no higher than the en- trance floor of the building. An open railing no higher than three feet may be placed around such place. d.
