1954-2.08ORDINANCE N0. 2.08 AN ORDINANCE REGULATING THE MOVING Or' BUILDINGS AND STRUCTURES INTO OR WITHIN THE VILLAGE OF RICHFIF,LD, REQUIRING PERmZTS THEREFOR, AND PRO- ~' VIDING PENALTIES FOR VIOLATIONS THEREOF. The •;illage Council of the Village of Richfield do ordain as follows: Section 1. It shall be unlawful for any person, firm or corporation to move any building or structure into the Village of Richfield from any place outside the Village, or wholly within the Village of Richfield from one lot or parcel to another, or from the village of Richfield to a polrt outside of this Village without first making application to the Building Inspector and securing a permit therefor as hereynafter prov~.ded. Upor. making application for a'permit to move such building or structure there shall be paid a fee of five {5.00) dollars. Section 2. No moving permit shall be required for the moving of any hoarse, build- ing, or structure or part thereof in size smaller than the following dimensions: 8 feet high, lO feet wade, and 15 feet long. Section 3. Whether or not a permit is required no building shall be moved to a location w~.thin this~V~'D.age unless such building or structure conforms to the re- quirements of the building, plumbing and zoning ordinances of this Village for new structures, and unless the required permits have been obtained for the altering or remodeling of such structure so as to make it conform to the. requirements of such ordinances within •9O days of the day when such building is located or relocated on property within this Village. Failure to make such building or structure con- - form to the said ordinance requirements within said 90 days shall be a violation ~~ of this ordinance. Section !~. Upon making an application required by this ordinance, the applicant shall furnish the Building Inspector with such information as he may require relative to the size, location, method of construction and type of building or structure, the equipment proposed to be used in the moving, the length of time that such building or structure will be on village streets, the days and hours when such moving is to~be~made, the financial responsibility of the applicant and the insurance pro- tection carried by the applicant. The applicant shall give access to said building • or structure to the Building Inspector for the purposes of inspection and shall permit the Building Inspector to inspect. the equipment to be used in such moving. No such application for a moving permit shall be granted by the Building Inspector unless such building or structure can be moved with reasonable safety to persons - or property within this Village. The Building Inspector may impose such conditions as are $ecessary to assure compliance with the ordinances of this Village and to assure the public safety from injury to persons or property within this Village. Section 5. After examination of said application and the facts relative thereto if the Building Inspector shall be satisfied that the ordinances of this Village will not be violated by such moving and that the public safety will not be jeapor- dized thereby, he shall refer the application to the Chief of Police of this Village. Section 6. The Chief of Police and the Village Engineer of this Village shall ex- amine such application and the facts relative thereto to determine the advisability ~ of any. proposed use of the Village streets from the. viewpoint of traffic and public safety on the days and hours when the proposed moving would take place. He may i rose such conditions with respect to the days or hours of moving, or the route to be followed within the Village or traffic or safety devices to be used as he shall determine to be necessary to assure traffic and public safety. If any conditions are imposed upon the proposed moving operation, said permit sha 1 not be granted until the applicant shall have agreed and assented to ', such conditions in writing. r Section 8. Before any permit is issued the applicant shall make a cash deposit of 10000 with the Building Inspector to reimburse the Village for any expense ins carted by the Village in connection with said moving and to guarantee that all rubbish and materials will be removed from premises within this Village from which the building or structure has been moved, and that all walls and excavations be filled and leveled to existing grade and left in a safe and sanitary condition. If such conditions with respect to such premises are not met, the Village shall proceed to do the necessary work and charge the cost thereof against the cash deposit. After all work under said permit is completed and after deducting any expense incurred by th® Village, any moneys remaining in the cash deposit shall be returned to the person making such deposit. If said deposit is inadequate, the applicant shall, by reason of such application and permit, be obligated to pay any such additional expense within 30 days after the Village. has completed such work. Section 9. $efore moving any house or structure, the mover or owner of the premises wi ht in a Village from which it is moved shall plug the sewer line with a concrete stopper, shut off the water, and pey for all sewer and water service previously pro- vided. The electric,--telephone and gas services which might ~ connected vrith the house or structure shall be removed by the service company. Section 10. In every case in which a moving operation shall require the displace- ment of any overhead wires, it shall be performed by the~persbn; ~f3rlrr-or corporation owning, operating and controlling such wires. Section 11. Prior to the issuance of a permit for moving operations ~ ich will entail ~he~moving of overhead wires, the applicant shall furnish the Building Inspector with satisfactory proof that the displacement of such wires will be made by the person, firm or corporation owning, operating and controlling such wires, on the dates and at the times designated for the passage of such house or structure. Section 12. At any tip during such moving operatinn the Building ]nspector or the Chief of Police may issue any .further order, whether of an emergency nature or otherwise, which such person shall find to be necessary to compel compliance with the ordinances of this Village, the terms of the application and permit, or to insure the public safety. Section 13• Refusal by the permit holder or any person acting on his behalf to comply with the terms or provisions of this ordinance or to adopt any safety or pre- cautionary device or method imposed upon such moving operation shall be a violation of this ordinance end shall be cause for iYrmiediate revocation of the permit. Section 11t. Any flares, street barriers, parking signs or similar safety devices requ rely law or required pursuant to the terms of this ordinance shall be prov- ided by the permit-holder at his own expense. Section 15. The continued violation of any of the provisions of this ordinance or any condition or order. imposed hereunder shall be and constitute a separate. offense under this ordinance for each and every day such violation shall continue. ~~ Section 16. Any person, firm or .corporation who shall violate any provision of this ( ~ ordinance shall, upon conviction therefor, be punished by a fine of not to exceed X100.00 or by imprisonment for a term of not to exceed 90 days. Section 17. If any section or clause or part of this ordinance is found to be invalid the validity of the remainder of said o~r~dinance shall in no way be affected thereby.
