b ~~ O 1 1 ORDINANCE 3.2b AN ORDI~TA@tCE REGiTLATIA~G AND I,IC~a1S]NG TIC SALE OF FOOD AND MINK SECTION 1, RTo person, firm or corporation shall conduct or operate any restaurant, cafe, Mulch room, lunch counter, soup kitchen boarding house, inn, tav- ern, hotel dining room, coffee shop, tea room, or any other public eating house or~~place, or any meat market, butcher stall, shop or stand, slaughter house, poultry slaughering and dressing establishment, packing house, grocery, fruit or vegetable stand, confectionery, dairy, creamery, butter factory, cheese factory, ice cream plant, soft drink bottling works °or bakery where meat, poultry, fish, grocer3.es, vegetables, dairy or bakery products, fruit, confectionery', ice cream, or any =other provisions axe handled, sold or dispensed without first obtaining a food license therefor, and complying with the provisions of this ordinance. The villa ge Council of the Village of Richfield do ordain as follows: SECTIt~ 2. Any person, firm or corporation desiring a food license as herein defined., shall make written application to the Village Clerk, stating his full name and address, the address of'the premises for which a license is sought, the' na~a.re of the business to be conducted, the place or places where he has pre- viously held a food license, whether any such license held by him has ever been revoked, anal if so, the reasons for such revocation and the license number of any trailer, wagon, or vehicle from which food or drink will be sold. Failure to give complete and accurate 3.nfo~rmation on said application shall constitute a violation of this''ordinance. The application whall be accompanied by the license fee as hereinafter provc~eci. SECTI~i 3. The license application shall. thereafter be presented to the Village Council :for action. if granted, the Village Clerk shall issue a written license 'signed by the ,Mayor. SECTION !~. Licenses shall expire on December 31st following the date of issuance, and no ~.icense shall be transferable. The license fee for any year or fraction thereof shall be X12.00. SECTION 5. Licenses may be revoked by the Village Council for violation of any of the provisions of this ordinance, or for good cause upon notice to and hearing of the licensee. SECTI~V 6. Licenses. for the sale of soft drinks, confectionery and loch for a perio~ss than one week at community celebrations, circuses, and other similar entertaiments 'may be issued by the Village Manager upon application as 3n the case of licenses where he is satisfied that the terms of this ordinance shall be comp]-i.ed with. The perm3.t~ fee for such permit shall be X3.00. ~~ SECTIGIV 7. No license shall be required for any person who may sell. or peddle ~ e~prod~ucts of the farm or garden occupied and cultivated by him, but such persons shall. meet applicable sanitation requirements of this and other sanitation ordinates of the Village. SECTTCN 8, Sanitation Requirements.:.. All establishmmns named in Sect3.on 1 of this ordinance shall meet the following requirements of sanitation .for the pro- tection of the public health, . ~~ A. Establishments covered by Village ordinances regulating pubic eating and drinking establishments shall conform to the provisions thereof. B. Establishments where fruits, vegetables, meats, dairy products and sea foods are prepared for sale, slaughtered, manufactured, packaged, re-packaged, stored or offered for sale shall be maintained in conformity with the applicable pro- visions of Section 6 of the ordinance regulating eating and drinking establishments except Iteans 9 and ].I~ thereof, Storage of root vegetables, canned foods or other fodcJitems normally stored without light need not conform to Item ~ or 5 if the public health isnot affected thereby. All show and display cases or windows, coiuiters, shelves, tables, refrig- erating equipment, sinks or other equipment or utensils used in cormection with the handling of food shall be so constructed as to be easily cleaned and shall be kept in good repair. All food and drink shall be clean, wholesome, and free from spoilage, and be so prepared or packaged as to be safe for human consutaption. All milk, fluid milk products, ice cream and other frozen desserts shall be from approved. sources. Milk and fluid milk products shall be dispensed in the original containers in which they were received from the d3.stributors. All oysters, clams and mussels sha]1 be from approved sources and if shucked, shall be kept until dispensed, in the con-tain_ ers in which they were placed at the shucking plant and be properly refrigerated. SECTI~t g. Ih.sease Control: No person who is affected with any disease in a communicab a form or is a carrier of such disease shall work in any food handling establishment or no such establishment shall employ any such person or any person suspected of being affected with any disease in a commtmi.cable form or of being a carrier of such disease. If the food establishment manager suspects that any employee has contracted any disease in a communicable form, or has become a carrier of such disease, he shall notify the health officer immediately. A placard containing this section shall be posted in all toilet rooms. A physical examinat- ion p~o>" to employment shall a].sc be required of all food handlers and the results of said examination shall be sent to the health officer. ' SECTIQN 10. Procedure when Infection Suspected:' When suspicion arises as to the possibi ity of transmassion of infection from any food establ'~.shment-. employee, the health officer is authorized to require any or all of the following measures: (1) the immediate exclusion of the employee from all food handling es- tablishments; (2) the immediate closing of the establishment concerned until no fur- ther danger of disease outbreak exists, in the opinion of the health officer; C3) adequate medical-examinations of the employee and of his associates, with such laboratAry examinations as may be indicated. SEC_ TT~T 1]-. Any person, firm, or corporation violating any of the provis- ions of this ordinance shall, upon conviction thereof, be punished `by a find of not more than ~1Q0.00 or by imprisonment for not more than 90 days. SECTI®V 12. Re eale and date of Effect: All ordinances and parts of ordi- nances in conf ' ct wa s or anoe are ereby repealed, and thisordinance shall be in full force and effect immediately upon its passage.
