1952-1543 AN ORDINANCE AM NDI[ttG ORDINANCE NO. 3.271 ENTITLED "AN ORDINANCE 110 REGULATE THE DESIGN, COKSTRUCTIONO INSTALLATIQV AND MAIN°i'mANCE (w sicus AND B"r' LBOAMS; PROVIDING FOR THE AUMISTRA71CN AND ENFORCE WT- `.THEREOF, AND PROVIDING PENALTIES FOR THE VIOLATION THEREOF" The VilUlle Council of the Village of Richfield do ordain as follows: Ordinance No. 3.271 entitled "An-Ordinance to Regulate the Design, Installation and Maintenance of Signs and Billboards; Providing for the Administration and Bnforce- ment Thereof, and Providing Penalties for the Violation Thereof ", is hereby amended to read as follows: "Section 1 Definitions: The following definitions shall be applicable for the purpose of this ordinance: A, Se: A display board, s creep, structure, project or part thereof, used to announce, declare, demonstrate, display or otherwise advertise and attract the attention of the public. B. Ground Signs A detached siga erected upon or supported by the ground, in- cluding billboards. C. Projecting Sign: A sign other than a wall sign suspended from or supported by a building or structure and projecting out therefrom. D. Roof Si�ga; A sign erected upon or above a roof or parapet wall of a building or structure. E. Nall Sign: A sign attached to or erected against the wall of a building or structure with the exposed face of the sign in a plane approximately parallel to the face of said wall. F. Pedestal Sign: A gigand- tbighedi6ated uponvadssngle post or shaft more than seven feet high, with the display .portion mounted on top thereof. "Section 2 Building Permits Re red-- E=eTtions It shall, be unlawful to install., construct, erect), alter, revise, reeonstact or move any outdoor sign or sign structure, in the village, without first obtain- ing a permit therefor, -The following signs shall be accepted. A. A sign displaying the name of the property or premises upon which displayed, or of the owner or lessee thereof, or the proprietor thereof and the nature of his business, ihich sign shall not exceed 30 square feet in area, and .shall not be more than 8 feet from top to bottom. B. A sign not exceeding ten square feet in area, pertaining only to the sales rental, or lease of the premise upon which displayed. 0, A sign on residential property stating only the name or the name and pro- fession of the occupant, which sign shall not exceed 2 square feet in area. K I OAMA D. A sign in which publicp charitable or religious institutions are located, stating the name and nature ' of the occupancy and information as, to the con- ditions of use of occupancy, or a sign on such property used by the institution as a bulletin board, which sign shall not exceed 10 square feet. E. A sign painted directly upon the outside wall of a building. F. A wall sighs advertising the business located in the - building upon which displayed where such sign is erected by the omner or proprietor of,the business located therein. Section 3, A1_icatcion for rermit;Plans Two copies of plans and specifications whall be submitted with application for a permit. Such plans shall show complete details, method. of attachment or sup- port., location, dimensions and materials to be used. Plans for support of all roof sigas,projecting signs, and other signs subject to excessive stresses shall be ac- oompanied by structural computations and shall show that the supporting structure and method of attachment are adequately strong to support the load. Where signs are illwminated by electric ligting, an electrical permit shall be obtained as required by ordinance. Sect3.on h. All Signs: Construction, Design, Location and Main A. Every sign shall conform to the standards of this ordinance, whether or not a permit shall be, required, and nothing in this ordinance shall be sonstrued as repealing any section of the building or zoning ordinances of the village. B. No sign shall be attached or placed upon any building in such a manner as to obstruct any fire escape, or any window or door, nor shall any sign be attached to -a fire escape. C. No sign erected beforethe passage of this ordinance shall be rebuilt, altered or moved to a new Location without being brought into compliance with the requirements of this ordinance. D. No swinging sign shall hereafter be erected or hung on or attached to any build- ing, within the village, and every such sign so erected, hung' or attached prior to the passage of this ordinance which is deemed unsafe by the Building Inspec- tor shall be immediately removed by the ouner thereof; or changed to conform With the ordinance requirement s when so ordered by the Building Inspector, E.* The minimum clearance of any sign from unprotected electrical conductors (whether poles or otherwise) shall not be less than thirty-six (Winches for conductors carrying not over six hundred (600) volts, and forty-eight (48) inches for conductors carrying more than six hundred (600) volts. F. No sign shall be erected in.such a manner as to interfere with, mislead or confuse traffic. G. There portions of a sign are subject to different classifications, each portion shall meet the requirements of its classification. H. Every sign requiring a permit shall have an identifying number to be provided by the Building Inspector, and except for ground signs, the weight of the 5- sign, plainly marked on the exterior surface of the'sign body in a, location where such information will be readily visible after installation and erection. I. Signs and sign structures shall be maintained at all times in a state of good repair. 'Section 5. Ground SiM@: Construction., Design, Location and Maintenance. A. No ground sign, sign-board or billboard shall exceed 27 feet in. height above the average ground level of that part of the street toward which it - faces; nor shall it exceed 65 feet in length, including the base thereof. Every billboard or sign shall have an opening of at least two feet between the lower edge thereof and the ground; which space shall not be closed in any der. B, -No ground sign .s siga -board or billboard shall approach at any point nearer than three feet to any building unless such sign shall be placed parallel to the side of the building, nor within six feet of the side of any lot, nor nearer than fifteen feet to any street line where there is no established or customary build- ing• line, nor within 25 feet of any street corners (th& intersection of the prop. ertir lines). Whenever the established or customary uniform building. line upon the street where such ground sign shall be erected is more than fifteen feet from the street or property line, then said ground sign shall not approach nearer the street than the established or customary uniform building line. C. The owner, lessee, or manager of said ground sign, and the owner of the land on which the same is located, shall keep grass or weeds and other growth cut and debris and rubbish cleaned up and removed from the lot on which sign is located. D. All portions of such signs shall be designed for wind pressure of not less than 20 pounds per square foot,_ and the ground signs of wood shall have all members which extend into the ground protected with preservative approved by the Build•. ing Inspector. E. If any residence shall be located within 50 feet of the proposed location of any ground sign, or billboard, which billboard shall have an area of 40 square feet or more, no permit shall be granted unless the owner of such residence or his lawful agent shall consent thereto in writing. A permit may be granted in any such case in the absence of the necessary consent, by majority vote of the village council. F. Pedestal signs may be mounted adjacent to the street l ne,but all its parts shall be wholly upon the property of the business advertised thereon. "Section 6. Projection Signs; Construction and Design A. All portions of such signs shall be designed for a wind pressure of not less than 30 pounds per square foot. B. No such sign shall be less than 12 feet above the level of the sidewalk or public property; excepting signs which do not exceed four square feet, and which do not project more than two f set over the sidewalk or public. property, which must be at least eight feet above the level of the sidewalk or public-property. No projection sign shall project beyond the curb line, nor more than eight feet over the sidewalk or public property. C. In no case shall more than two feet of space intervene between the inner edge of any projecting sign and the face of the wall from which it projects, nor shall the street edge of the sign be more than 8 feet from the face of the wall. 46 D. The building or structure from which any sign projects and all attachements or fastenings must be so constructed as to safely resist the dead load and the wind load added by the attached sign. E. All such signs shall be of incombustible materials, or of not lesb than one. hour fire resistive constmetLon. " Section 7. Roof 21929; Construction and Design A. No roof sign shall exceed 25 feet in height above the roof level of the building unless constructed integral mi.th the building or structure, nor shall it project beyond the edge of the said roof in any direction. B, Zvery such sign shall be- either metal, metal clad, incombustible, open wire or open metal sign., except that such sign may have letters, figures, charac- ters, or borders of wood if such borders do not exceed four inches in width, and such wooden Letters, figures or characters. do not covermore than twenty - five per cent of the area of such sign, provided that in place of sheet metal, substitartii.on may be made of the following material; Tempered prestwood or other similar materials approved by the building inspector, having equal properties as to strength, fire and moisture resistance. C. No such sign shall be. so placed as to prevent free passage of persons from one part of said roof to another. ry D. The building or structure upon which such sign is placed, and all attach.- ments or fastenings must be so constmeted as to s afely resist the dead load and the wind load added by the attached siga. "Section a. Wall Signs .; Construction and Design . A. No wall sign shall have a projection over a sidewalk or public property or an a stablished building line greater than 'delve inches. B. The materials, construction and attachment of such sign shall be the same as required for roof signs. "Section 9. Approval of Location Upon presentation of an application for a sign, the village manager shall first pass upon the proposed location of such sign. If it shall . clearly appear that the sign mould not violate the ordinances of this village, or threaten the health, safety, order, convenience or general welfare, he shall approve the same and endorse his approval on said application. All other cases shall be submitted to the Village Council who may approve,such proposed location by a majority vote of all members of the council. do building permit shall be issued until such proposed location has been approved. "Section 19. Issuing Permits Upon presentation of application, permit fee, plans and specifications, and the necessary consents if required, and the approval of location, the building inspector shall issue a building permit for the alteration, erec- tion or construction of the sign* 1 1 F� .M " Section 11. Compliance Enforcement In the event of the failure to construct or erect a sign in accordance with the requirements of this ordinance, or to maintain a sign as required by ordinance, the building inspector may order the repair or removal of the same within the time stated in the order. In the, event of the failure. to comply with such order within the time stated, the same may be removed by the village at the expense of the owner or manager of said board or sign, or the- owner of the ground or building upon which such sign or board is placed. "Section 129 Renewal Permit It shall be unlawful to maintain any sign now or hereafter erected or con- structed without first obtaining an annual renewal permit; provided that no renewal permit shall be required for those signs excepted under Section 2 hereof, or for signs advertising the business upon the premises upon which displayed. Application for such renewal permit and the permit fee shall be submitted to the building inspector, together with such other information as he may require with respect to size, types location, construction and condition of such sigh or structure. Upon determining that the provisions of this ordinance have been complied with, the building inspector shall issue an annual renewal permit, which shall expire on December 31st of the year for which such permit is issued. "Section 13. Fees A. The building permit fees shall be as follows: For a sign not exceeding one hundred square feet in area, $2.00; for each additional fifty square feet or fraction thereof, $1.00; independent block letter signs without background or connection between letters, shall be calculated on the basis of the sum of the areas of the squares or rectangles wfLtch wholly include each letter. B. The annual renewal permit fee shall be as follows: For a sign not exceeding one hundred square feet in area, $1.00; for each additional fifty square feet or fraction thereof, fifty cents. C. The fees required hereby shall be submitted at the time of application for permit. D. The Council, at its discretion, may waive the fees required by this ordinance in the case of signs erected by civic and religious groups. "Section 14. Separability The invalidity or unconstitutionality of any section, subdividion or pro- vision hereof shall not affect the validity of any other part. "Section 15. Penalty Any person, firm or corporation violating any of the provisions of this ordinance shall, upon conviction thereof, be punished by a fine of not more than $100.009 or by imprisonment for not more than 90 days. Where portions of a sign are subject to . different classifica- tions, each portion shall meet the requirements of its classification. H. E. All such signs; shall be of incombustible materials, or of not less than, one-hour fire resistive con- struction. "SECTION 7. ROOF SIGNS; CONSTRUCTION AND DE- SIGN A. No roof sign- shall exceed 25 feet in height above the roof level of the building unless constructed integral with, the building or struc- ture, nor shall it project beyond the edge of the said roof in any direction. B. Every ,such sign shall be eith- er metal, metal clad, incombustible, open wire or :open metal sign, ex- cept that such sign may have let- ters, figures, characters, or borders of wood if such borders do not exceed four inches in width, and such wooden letters, figures or characters do not cover more than twenty -five per cent of the area of such sign, provided that, in place of sheet metal, substitution may be made of the -following material: tempered prestwood or other simi- lar materials approved by the build- ping inspector, having equal prop- erties as to strength, fire and mois- ture resistance. C. No such sign shall be so placed as to prevent free passage of per- sons from one part of said roof to another. D. The building or, structure up- on which such sign is placed, and all attachments or fastenings must be so constructed as to safely resist the dead load and' the wind load added by the attached sign. "SECTION S. WALL SIGNS; CONSTRUCTION AND DESIGN A. No wall sign shall have a projection over a sidewalk or pub- lic property. or an established build- ing line greater than twelve inches. B -The materials, construction and attachment of such sign shall be the same as required for roof signs. "SECTION '8. APPROVAL OF LOCATION Upon presentation of an applica- tion for a sign, the village manag- er shall first pass upon the pro- posed location of such sign. If it shall clearly appear that the sign would not violate the ordinances l of this village, or threaten the health, safety, order, convenience or general welfare, he shall ap- prove the same and endorse his approval on said application. All other cases shall be submitted to the Village Council who may ap- prove such proposed location by a majority vote of all members the council- No building permit shall 1)e sued until such proposed loco has been approved. "SECTION 70. ISSUING PERMITS Upon presentation of application, permit fee, plans and specifications, and the necessary consents if re- quired,-and ;,the .approv4,.,.of: 'lo- cation, the building inspector shall issue a building, permit for the alteration, erection or construction of the sign. "SECTION 31. COMPLIANCE ENFORCEMENT In the event of the failure to con- struct or erect a sign in accordance with the requirements of this ordin- ante, or to maintain a sign as requir- ed by ordinance, the" building in- spector may order the repair or re- moval of'-the same within the time stated in the order. In the event of the failure to comply with such order within the time stated, the same may be removed by the vil- lage at the expense of the owner or manager of said board or sign, or the owner of the ground or building upon which such 'sign or board is placed. "SECTION 12. RENEWAL PERMIT. It shall be unlawful to maintain any sign now or hereafter erected or constructed without first obtain- ing an annual renewal permit; pro- vided that no renewal permit shall be required for those signs ex cepted under Section 2 hereof, or for signs advertising the busk* - ness upon the premises ups which - displayed. Application for such renewal permit and the permit fee shall be submitted to the building inspector, 'together with such other information as He may require with respect to size, type, location, construction and condition of such sign or struc- ture. Upon determining that the provisions of this ordinance have -been- ecmplied with, the- Uuildina newal permit, which shall expire) on December 31st of the year for which such permit is .issued. "SECTION 13. FEE'S A. The building permit fees shall be as follows: For a sign not ex- ceeding one -hundred square feet in area, $2.00,; for each additional fifty square feet or -fraction there- of, $1.00; independent block letter signs without background or con- nection between letters, shall be calculated on the basis. of the sum of -the areas of the squares or rec- tangles which wholly include each letter. PENALTY Any person, firm or corporation violating any of the provisions of this ordinance shall, upon convi'c- ttion thereof, be punished by a fine of not- more than $'100.00, or by imprisonment for not more than 90 days.
