Bill No. 1956-10 ORDINANCE N0. 12.01 'AN ORDINANCE AMENDING THAT CERTAIN OIDINANCE Id0. 12.01 OF TAE VILLAGE OF RICHFIELD, ENTITLID "AN OIDINANCE TO PSTABLISH A POSITION-CLASSIFICATION PLAN, A COMF'IDSgTION PLAN, A MERIT SYSTEM AND A BASIC PERSONNET POLICY FOR THE VILLAGE OF RTC2~ FIELD, MITINE,SOTA" AS PA;;ID FEBRUARY 26, 1951 AND AMEATDID DECEMBER 10,1951 AArD DP~EMBER 29, 1952 The Council of the Village of Richfield does ordain: Ordinance No. 12.01 of this Village. entitled "An Ordinance to Establish aPosition-Classification Flan, a Compensation Plan, a Merit System and a Basic Personnel Policy for the Village of Richfield, Minnesota" is hereby amended to read as follows: SECTION 1. PURPOSE OF THE ORDINANCE. Tt shall be the purpose of this ordinance to establish a uniform and equitable system of municipal ~rsonnel administration for all employees of the Village of Richfield. SECTION 2. DEFINITIONS. ''permanent ~nployee" shall mean an employee who has completed his probationary period and who serves in a position which is provided in the budget on a permanent baeie. "Temporary P~nployee" sha11 mean an employee who has not acquired the status of a permanent employee, and shall include any person who is engaged in part-tame, seasonal or casual employment and who is compensated on an hourly or monthly basis. "Benefits" means privileges granted to an employee in the form of vacation leave sick leave, overtime allowance, holidays, military leave, military induction pay or pay received in lieu of accrued leave upon termination of employment. "Budget `'ime" means that period during which budget requirements for the following fiscal year are estimated, considered and adopted according to law. "Fiscal Year" shall be January 1 to December 31 inclusive . "Appointing Authority" shall mean the Village Manager, provided by law under P]~aa B. SECTION 3. PQ~SITIONS COVERED BY THIS ORDINANCE All offices and positions in the municipal employ, now existing or hereafter created shall be subject to tha provisions of this ordinance, except that: 1. The following offices and positions shall be wholly exempt from the provisions of this ordinance. a. Officials elected bar the people. b. Members of boards and commissions. c. The Village Manager, V311.a,ge Attorney, Director of Finance, Director of Public Works, Liquor Store Manager and Health Officer. - 2. Those employees who are subject to the provisions of Civil Service .Statutes and ordinance shall be exempt from those provisions of this ordinance which are in- consistent with Civil Service Provisions and law. By Examination When required by law or by the appointing authority, merit and fitness may be ascertained by written oral or other examinations and shall relate to those matters which will test fairly the capacity and fitness of the candidate to dis- charge efficiently the duties of the position for which such examinations are held. B. Without Examination. Tn case of appointment to positions for which examinations arc not required, the appointing authority may appoint air person who appears to meet the require- ments listed in the class specifications and whom the appointing authority deems qualified to perform the ttuties of the position. C. Relationship to Other Vi11a~e Personpel and~Res-ide~nce. Whenever possible, and with due regard for merit and fitness, the appointing authority shall avoid the appointment of any person when .such person is related to .any elected or appointed officer or employee of the village. A person shall be regarded as "related" as used in this paragraph, if such person is a brother, sister, spouse, the lineal ancestor or descendant of the prospective employee, or the husband or wife of any such brother, sister, ancestor or descendant, or the first cousin, or the spouse of the first cousin of the pros- pe etive ~ employee . Any employee of the Police or Fire Department sha11 become a resident of the Village within one year after his original appointment and shall remain a resident of this Village thereafter during such employment. SECTION 5. PROMOTION FROM WITHIN TIiF SERVICE. It shall be the policy to fi11 vacancies in the Municipal Service by promotion of Pemnanent employees, insofar as practicable, to post notice of intent to fi11 such va- cancies far five {5) days, and in case of equal qualifications to give consideration to length of service. SECTION 6. PROBATIONARY PERIOD. A. Puruose. The probationary period sha11 be regarded as an integral part of the examination process and sha11 be utilized for closely observing the emplo~ree's work, for securing the most effective ad3ustment of the employee to this position and for rejecting any employee whose performance does not meet the required work standards. B. Duration. A11 original a pointments shall be probationary and subject to a probat- ionary period of six (6~ months service after appointment. At az~y time during the probationary period an employee may be transferred or dismissed if his per- formance does not meet the required standards. An employee who sha11 not have completed six~(6) months of full-time service as of the effective date of this ordinance shall receive credit for such fu11-time service as they have performed in fulfilling the probationary period requirement. C. Applies to Promotions. All promotions shall be subject to a probationary period of six (6) months. Tf the employee who has been promoted is found unsuited for the work of the class of position to which promoted,-hta may be reinstated to the position and rats of pay or other position in-the cl~~s from which he was promoted. ~' -3- D. Affects Leave Benefits. During the initial probationary period, but not during a promotional pro- bationary period, an employee wi11 not ~ entitled to sick leave or vacation leave. ~• After six months of service an employee will be entitled to sick leave and vacation leave, the sick leave and vacation leave to be accrued from the start of the pro- bationary employment. E. How Completed. An employee who has completed six months of probationary service and who has not received before completion of six {6) months service a written notice from the ap~inting authority that his aervi.ces are terminated shall be considered to have successfully completed the probationary period and shall automatically receive status as a permanent employee.. SECTION 7. PROVISIONAL APPOINT~ITS. A. When~A~id`e. If necessary to prevent the stoppage of public business or inconvenience to the public; but not other~aise, the Village Manager may make a provisional ap- pointment to a position in a cl.a.ss for which examinations are ordinarily given and for which appropriate employment lists are not then available. B. Termination A provisional appointment shall terminate: a. By action of the Village Manager; or b. By expiration of the period during which any such appointment is limited by Civil Service or any other law; or c. By the effective date of a regular appointment to the position. C. Ben fits. No benefits shall be given for service rendered under a provisional ap- pointment unless said provisional appointee shall at the time of the provisional appaintment~ be a permanent employee in another capacity. SbI~TION 8. P~ITION- CLASSIFICATION PLAN. There shall be established and maintained. a position-classification plan for a positions covered by the provisions of this ordinance. All positions shall be grouped in classes having a definite range of difficulty. and responsibility. For each class or position there shall be: A class title description of the duties of positions within a class; a written class specification wh3.ch wi11 contain a description of the. nature of the work and •the relative responsibility of the positions in the class, examples of work which are illustrative of duties of positions allocated to the class, requirements as tv knowledge, abilities and skills necessary for ~rformance of the work and a state- ment of experience and training desirable for recrvitamont into the class. A. Allocation of New Positions. When a new position is created for which no appropriate class exists or when the duties of an existing position are sufficiently changed so that no ap- propriate class exists, the Village Amager shall create a new class and shall cause an appropriate class specificatj,on to ~ written for said class. B. Review of Plan. As often as necessary to assure continued correct classifications the position-classification plan sha11 be reviewed by the Village Manager and necessary 8djustments made therein. -4- C. Filing-of- Plan. TJpon adoption of this ordinance a dhpy of the position-classification plan shall be placed on file with the Village Clerk. The plan so filed and sub- sequently adjusted shall have•the same effect as though it were apart hermof SECTION 9. COMPENSATION PLAN. There shall be established a compensation plan for all positions sub3ect to this ordinance. A. Elements of the Plan. e Compensation Plan shall consist of: 1. •A Basic Table of Numbered_ Pay Ranges. a. Each numbered 'pay range in the basic table con- sists of a minimum and maximum monthly rate with two (2) intermediate pay steps at approximately five ' per-cent (5~} intervals, identified as steps "A", "B", "C", and "D". The compensation of persons serving in the following named positions shall not be computed or determined pursuant to Para- graph "a" above: 1 Laborer Public Works Maintenance Man Sewer Maintenance Man Maintenance Equipment Operator Maintenance Mechanic Engineering Aide I engineering Aide II Engineering Aide ITI Ciu3l Engineer I Civil Engineer II Superintendent of Sewers Street Foreman -~- As to such positions, the council shall fix the rate of compensation by resolution annually, after adoption of the annual budget, speci- Eying the maximum compensation for each such position and such other rates of lesser compensation as the council shall deem advisable. ' B. Modification of Plan e Vi]3age Council may change ar modify any or all of the pay ranges or position classification assignments as set forth in said plan whenever they shall deem it necessary in the interest of good personnel administration. C. Individual Pa Rate cry full time employee shall receive an increase in compensation of one step within the pay range of the position in which he is employed upon completion of each consecutive period of twelve (12} months satisfactory service computed as of the anniversary of his appointment to the position. None of the increases pro- vided by this section shall be made so as to compensate any employee in an amount exceeding the maximum step in such pay range. However, such increments will not be given on an automatic basis but shall be contingent upon favorable service re- ports and recommendation of the department head. The annual schedule of pay ranges shall be established by resolution of the Council annually, immediately after adoption of the annual budget and shall be filed with the Village Clerk and shall have the same effect as though it were a part hereof . D. Total Remuner~ anon. A~ salary range established fora class shall represent the total re- muneration for full time employment in the class, but shall not be considered ae reimb m~ement for official travel or other expenses which may be allowsd for the conduct of official business. Unless approved by the appointing authority, no employee shall receive pay from the municipality in addition to the salary au- thorized for any position or positions to which he has, been appointed: This shall not operate to prevent employees from working in more than one position when authorized b,~ the Village Manager. SECTION 10. WORK WEEK AND WORX DAYS, • Except for employees in the Fire Depar~nent, Po3.ice Department and Liquor Stare, the regular work week shall be forty (!~0) hours, Monday through Friday and the regular day shall be eight working hours. SECTION 11. FULL TIME SERVICE. By full time service is meant work for that number of hours which make up the regularly scheduled weekly or monthly period of service in the class, exclusive of Leave with pay . SECTION 12. PAY FOR TEMPORARY EMPLDYMEI~TT. A. Pro-Rata Basis. . Whenever an employee works for a period of less than the regularly estab- lished number of hours a day, days a week or weeks a month the amount paid shall bear the sane relationship to thQ full time rate for the class as the tame actually worked bears to the time required for full-time service. ~ B. Benefits. Persons whose employment is temporary shall not be entitled to sick leave i and vacation leave. F . SECTION 13. HOURLY AND DAILY RATES, A. B. How Determined. Such hourly rate shall be determined by dividing the monthly rate by 4 1/3 times the number of hours regularly worked by employees of the class in a weak . PAY RATES TN TRANSFER PROMOTIOAT OR DEMOTIONS. If an employee is transferred, promoted or demoted his rate of pay for the new class shall be determined as follows: A. In the case of u transfer or promotions if the rate of pay for the farmer class is less than the minimum rata established for the class pf the new position the rate aha11 be advanced to the minimum of the class to which transferred or promoted. B, In tkie ce.se of a transfer or demotion, if the rate of pay in the Former class is more than the maximum rate established far the class of the new position, the rate of-pay shall be reduced to the maximum rate or an intermediate snap of the range of the class to which transferred or demoted such determination to be made by the Village Manager. C. In case of transfer for the good of the service oaC the employee and not in .the nature of a promotion or demotion, the rate of pay shall remain the same. D. In ali cases of promotion the. pay shall be increased by an amount equal to at least one step of the pay range from which promoted. _ 'SECTION 15. OVER-TIME PAYMENT. VACATI(~N_ L ,VE. . A. How Much Each permanent employee having less than five (5) ve8rs consecutive fu11- time service sha~.l eaz~n vacation leave at the rate of one working day-far each calendar month of full-~tima service or major fraction thereof. Each permanent employee with moxe than five (~} but less than ten (10) consecutive years of full-time service shall earn vacation leave at the rate of one and one-quarter (]~-) working days for~each calendar month of full-time service or major fraction thereof; and each permanent employee with ten (10) years or more of consecutive full-time service shall earn vacation leave at the rate of one and one-half (1~) working days far. each calendar month of full-time service or major fraction thereof. B. ldhen Taken . Vacation leave may be used as earned, provided that the Village N18nager shall approve the time at which the vacation leave may be taken. No employee shall be allowed vacation leave until after completion of the initial probationary period. ~~ C - _ C . Accrual. ployees may accrue vacation leave to a maximum of twenty-four (24) working clays, In the event an employee has been unable to take advantage of vacation leave as earned, with the result that said employee has accumulated a -7- total of twenty-four (21~) working days vacation, he may absent himself from work with notice to take vacation leave and thus prevent the loss of vacation leave beyond the maximian of twenty--four (2.L,.) days, D. Terminal Learoe. Ater employee leaving the municipal service in good .standing after giving proper notice of such termination of employment shall be compensated for vacation leave accrued and unused to the date of separation. E. Waiving Vacation Prohibited. As vacation leave is granted to employees for ~z period of recreation, no such employee shall be permitted to ~,~aive such leave for the purpose of receiving double pay. SECTION 17. SICK LEAVE. A. Eli.~ibil3.ty. Sick leave with pay shall be granted to all probationary and permanent employees at the rate of one working day for each calendar month of full time service or mayor fraction thereof, except that sick Leave granted probationary em- ployees shall not be available for use until satisfactory completion of the initial (not promotional) probationary period. H. Accrual. Sick leave may be granted only for absence from duty because of personal illness, legal quarantine, or death or serious illness in the immediate family. ~;: Sick Leave shall be computed on a calendar year basis and may be accuaaulated to e total of not more than 100 days. Worl~en's Compensation benefits shall be credited against the compensation-due an employee during sick leave. C. Proof Required. In order to be eligible for sick leave with pay, an employee must: 1. Report promptly to his department head the reason for his absence. 2. Keep his department head informed of his condition, if the absence is of more than three (3) days duration. 3. Submit a medical-certifYOate-for-axiy-~rbsenceexceedingtheeef 3}-days- i~rec}uired_b~ the_ Village Manager. D. Penal `,r;: Claiming sick leave when physically fit, except as pexmitted in this sec- - tion may be cause for d3scip]_inary action, including transfer, suspension, demotion or dismissal. E. No germinal Sick Leave. No sick leave benefits of any kind shall be granted upon termination of employment. SECTION l8. ACCRUAL DURING LEAVE. E~ployees using earned vacation leave or sick leave shall be considered to be working for the purpose of accumulating additional vacation leave or sick Leave. SECTION l9. MILITAP'Y LEAVE. A11 municipal employees who: 1. Are members of the National Guard ~ i 2. Are members of the Officer's Reserve Corps of the United States of ~nerica ~or of the Enlisted Reserve 3. Sha11 be subjected to call or induction into Federal Service by the Presi- dent of the United States, or when ordered by proper authority to active non-civilian duty, -g- shall be entitled to a leave of ab~en~e for the period of such active service without loss of status and if such employee shall have been in the fu11-time service of the municipality for at least six months iimnediately preceding call to service, he shall receive the d3.fferenee between his regular municipal pay and the lesser military pay for a period of 15 days of Much military leave in the case of Reserves of National Guard personnel and full pay for 15 days in the case of active military duty of pro- longed duration. SECTION 20. LEAVE OF ABSENCE WITHOUT PAY . Upon request of an officer or employee, leave of absences without pay may be granted by the Village Manager taking into consideration good conduct, length of service, and efficiency of the employee and the general good of the municipal serv3.ce. Such leave of absence sha11 not exceed a period of ninety (90) days provided that the same may be extended beyond such period if the leave of absence is for continued disability or other good and sufficient reasons, but in no case to exceed one (1) year except when the em- ployee is detailed for military service or is disabled far disability incurred while in the service of the Village. No vacation or sick leave benefits shall accrue during a period of leave of absence without pay. B. Jury Dut~r. In the case of jury duty or subpoena for witness in court, however, an employee shall receive an amount of compensation which will equal the difference between the employees regular pay and compensation paid for jury duty or witness fee. C. Approval Required. Leave without pay sha11 require the advance approval of the department head and the Village Manager. SECTION 21. REST PERSODS .AND HOLIDAYS. A. All regular employee when working under conditions where the use of a break period is practicable shall be granted a fifteen (15) minute break period in the forenoon and a fifteen (15) minute break period in the afternoon of each work day. B. The following 1ega1 holidays will be observed as paid holidays for Village em- ployees: New Yearts Day Lincolnts Birthday Washingtonts Birthday Good Friday Memorial Day Independence D~,y Columbus Day Labor Day Armistice Day Thanksgiving Day Christmas Day When New Year's Day, Memorial Day, Independence Day, or Christmas Day fall on Sunday, the following day. shall be observed as a holiday. A11 employees who are required to be on duty on any holiday sha11 either be given the following day as a holiday or given an additional day of vacation leave, at the discretion of the Village Manager. SECTION 22. RESIGNATION. Any employee wishing to leave the municipal. service in good standing shall file with ~ his department head at least fouxteen (l/~) days before leaving a written resignation stating the effective date of the resignation and the reason for leaving. Failure to comply with this procedure may ~ considered cF.use of denying such employee future em- ployment by the municipality and denying terminal leave benefits. Unauthorized absence from work for a period of three working days may be considered by the department head~as a resignation without benefits. -9- S ~.,CTION„ 2~. GRIEVANCE POT,ICY . ~t is the policy of the Village insofar as possible to prevent occurrence of griev- ances P.nd to deal pr~-ptly with those which occur. )hen any grievance comae or is di- rected to the attention of any supervisory employee of the V3J1age, the supervisor shall promptly discuss all relevant circtmistances with the employee and his representative if he so desires, consider and examine the causes of the grievance and attempt to resolve it to the. extent that he possesses authority. Failing at that level, the grievance may be carr3.ed up to higher authority to e.nd including the Village Manager. SECTION 2~,. I.AY-t~'S . .. The appointing authority may lay off arty employee whenever-such action is made necessary by reason of shortage of work or funds, the abolition of a position or cause of changes in organization provided, howe~r, that two (2) weeks advance written notice shall be given. However, no permanent employee shall be laid off while there are tem- porary, provisional or probationary employees serving in the same class of positions for which the permanent employee is aualifi©d, eligible and available. Length of service in the sake position class may be given consideration. S~TIOAT 25. SUSPE<tTSION. The appointing authority may suspend an employee without pay for disciplinary reasons. Such suspensions stall not exceed thirty (3O) days in any one calendar dear. SF,CTION 26. DEMOTIOt~TS . An employee may be demoted by the appointing authority for inefficient performance f' of his I duty for disciplinary reasons or for good and sufficient reasons. SECTION 27. DISMISSAL. Any officer or employee subject to the provisions of this orditaflnee may be dismissed from the municipal service by the Village Manager. Evidence of the following shall be sufficient cause for dismissal: 1. Incompetence or inefficiency in the performance of his duties. 2. Conviction of a criminal offense or a misdemenaor involving moral turpitude. 3. Violation of any lawful or official regulation or order or failure to obey any lawful direction made and given by his superior officer where such violation or failure to obey amounts to an act of insubordination or a breach of proper discipline or has resulted or reasonably might be expected to result in loss or injury to the municipality or to the public. 4. Intoxication on duty. ~ 5. Contraction of an infectious disease. ~ 6. Physical or mental defect which in the judgment of the appointing authority incapacitates the employee for the proper performance of the duties of his position. An examination by a licensed medical doctor may be required. 7. Wantom use of offensive conduct or language toward the public or municipal officers or employees. 8. Failure to pay or make reasonable provisions for future pa~nent of 3ust debts due or owing by him causing thereby annoyance to officer and employees of the - municipality. 9. Carelessness and negligence in the handling or control of municipal property. 10. Inducing or attempting to induce an officer or employee of the municipality to commit an unlawful act or to act in violation of any lawful and reasonable of- ficial regulation or order. 11. Taking any fee, gift or other valuable thing in the course of his work or in connection with it from any citizen for his personal use, when such gift, fee " or other thing, is given in the hope or expectation of receiving a favor or better treatment than that accorded other citizens. 12. Conduct in private life which brings discredit upon the municipal service. 13. Proven dishonesty in the performance of his duties. 11~. Violations of the provisions of this ordinance. In all cases of suspension, demotion and dismissal the reasons for such act~ci~i ~us`t be presented in a dated written statement to the employee affected. Upon the em~ili~~oefs dated written request to the Village Manager filed within five (5} working days of r©- ceipt of the statement of reasons, an employee shall be granted a hearing before the Village Manager, said hearing to be held not later than ten (10) days from the date of filing of a request for hearing. SECTION 2g. PROHIBITI('NS. No person shall wilfully or corruptly make any false statement, certificate, mark rating or report in regard to any test, certificate or appointment held or made under the municipal personnel system or in arty manner commit or attempt to canmit arty fraud preventing the impartial execution of the provisions of this_ordinance. No person seeking employment to or promotion in the municipal service shall .either directly or indirectly give, render, or pay any money, service or other valuable consideration to any person, for or on account of or in connection with his test, proposed appointment, promotion or proposed promotion. SECTION. 30. POLITICAL ACTIVITY. No employee shall seek or accept election, nomination or appointment as an officer of a political club or organization ~~rhich is tFE?ring r•z:~ n.Cf~ivA r€rt in a ~:=znicip~,1 +political campaign, except on behalf of his own candidacy, nor shall any employee serer as a member of a committee of such club or organization nor seek ..signatures to any petition provided by law, nor act as a worker at the polls, nor dis- tribute badges or pamphlets, dodgers or handbills of any kind favoring or opposing ar~y candidate for election or for nomination to a mun~.cipal public office. However, this section shall not be construed to prevent arty employee.#`t~n becoming or continuing to be a member of a political club or organization or from attendance at a political meeting or from enjoying entire freedom from all interference in casting his vote or from seeking or accepting election or appointment to public office. em lv ee who shall become a candidate for an elective ublic office exec t c - ~Y P 3'' y p , p on stable, shall automatically receive a leave of absence without pay and shall perform no duties connected with the position held by him until he is no longer a candidate. How- ever, if the needs of the municipal service require, the vacancy created by his absence may be filled Pnd his services terminated. SECTTO~T 31. EMPLOYEES t ADVISORY BOARD. There shall be established and maintained an ~nployees~ Advisory Board to serve in an F.dvisory capacity in the formulation of personnel policy and administration of the personnel program and in the consideration of any matter affecting the quality of ser- vi oe. of the municipa3 depar-tsnents. Such board may investigate, consider and report or make recommendations on personnel matters. A. Make-Up and Selection. The ~aployees' Advisory Board shall consist of 1. Three employees subject to the provisions of this ordinance elected by the employees subject to the provisions of this ordinance. 2. The Village Manager and orye Councilman to be selected by a majority of the Council at the first meeting of each January. Members shall ' ~ be selected during the month of January to take office the following February 1. It shall be the duty of the Village Clerk to arrange for necessary elections and to notify the Council when vacancies occur ,~ which must be filled from the Council.
