Village Council of the Village of Richfield do ordain as fol- lowas Ordinance No. 3.071 of the Village of Richfield emit led sAn Ordinance Concerning Dogs and Providing for the Licensing Thereof n, assed lay 3l, 1951, as amended, is hereby amended to read as follows: Section 1. Definitions. As used in this ordinance the following terms have the following meanings. Owner: A person, group or corporation owning, keeping or harboring a dog. Kennel: A place where more than two dogs over three months of age are kept, or a place at which the business of selling, boarding, breeding, showing or treating dogs is conducted. At large : A dog is Pat large to when he is of f the property of his owner and not under restraint.. Restraint: A dog is under restraint if he is controlled by a leash not exceeding 6 feet in length, or at nheel+~ beside a competent per- son having custody of him and obedient to that persons commands, or within a vehicle being driven or parked on a public street, or within the property limits. of his owner's premises. An unattended dog on the property of another, without the consent of such properly owner, is Peat largeTM and not under restraint even though he is on a leash . Section 2. Licenses ~~,equired. No person shall own! harbor or keep a dog over three months of age within this village unless a current license for such dog has been obtained as herein provided. Li- censes shall be issued on an annual basis and shall be for the whole or unexpired portion of the year ending on the 31st day of December next following the first effective day of the license. Section 3. License Fee and Application. License Tags. Upon the issuance of ~, dog license by the village cleric the licensee shall be provided with a metallic tag beading the license number, the word ~o~ichf field°P, axed the year when the lice:sse period begins .sr has begun.. ~,xcept r,~hen the dog for which the license is issued ~.s indoors on the premises of his owner the dog shall have on a collar gar hs,rness on which the license tag is affixed. 1'?o person shall counterfeit an official dog tag of this village, or use such a counterfeit tag , or aid or abet in any such violation of this ordinance. ~. license tag is not transferable to any other dog nor to a new owner of tizc dog for which it is issued. If any official tag is lost or stolen the owner may obtain a new tag by surrendering the receipt for the first tag and by paying the sum of fifty cents. Section 5. :restraint of ,All Dogs at tall Times. Tdo owner shall permit his dog to be at large in this village, but shall keep such dog in restraint at all times. Section 6. Confinement Indoors of Certain Dogs. The owner shall con~~ fine within a building ©r secure enclosure every fierce, d~.ngerous or vicious. dog, except when securely r~cuzzled and.in the cchtrol of a com- petent person. ':.very femals c'.og in heat shall be conf fined in a building, secure enclosure, veterinary hospital or boarding kennel.. _ Section ?. Keeping of Nuisance~~Dogs Prohibited. Rto person shall keep or harbor a dog which habitually barks or.-cries at night between the hours of 10:00 F.R. and 7:00 A.A~1. Any such dog is hereby declared to be a, public nuisance. Section S. Do mound. The village council may provide for a village owned dog pound, or may designate as the dog pound a suitable kennel either within or outside the village. Section 9. Foundkeeper and Assistants. The village manager shall designate the poundkeeper, and he may appoint and deputize as special. officers to enforce this ordinance persons approved by him who are employees or owners of any kennel. Such persons shall have police powers to cite owners of dogs for violations of this ordinance, in addition to their powers in impoundin;~. dogs. Section 10. Impounding Dogs. Such officers as the village manager shall designate to enforce this ordinance, z~ay take up and impound any dog found not tv be Dept, conf rood or restrained ~.n the manu~r required by .this ordinance. To enforce this ordinance such officers may enter upon private premises where it appears or where there is reasonab 1e cause to believe that a dog is not licensed or is not being kept, conf fined or restrained as herein required. Any owner shall pro- duce fir inspection his license receipt when requested to do so by such off a.cer. Section 11. Impounding Dogs After Person Bitten. Any dog that has bitten a person shall immediately be impounded for at least 14 days, and i;.ept apart fran. other dogs or animals, under the supervision of a veterinarian, until it is deter~rined whether said dog had or has rabies. Such impounding may be by the owner, and need not be at the village pound, but if it is not at the village pound the owner shall ~~~' not ify the village poundkeeper immediately,. and shall furnish proof Ordinance No. 3.0?1 (3) i.n writing that such dog is being so impounded. .Upon the expiration of `such ].4 days if the dog does not have rabies he may be released, and the village poundlceeper shall be notified dust prior to such release. If the dog is impounded at the village pound such dog may be reclaimed as hereinafter provided. Luny dog that has been bitten by a rabid dog or is believed to have been exposed to rabies shall be ir~:p~unded and kept in the same manner and for the saffie period of time. erection 12. milling Logs ~ihich Cannot be Impounded.' If a dog is diseased, vicious, dangerous, rabid or exposed to rabies and such dog cannot be im- pounded after a reasonable effort, or canLOt be impounded without serious risk to the pens©ns attempting to impound, such dog may be immediately killed. Section 13. Length of Impoundment. kny dog which is impounded in the village pound shall be kept, wit:i kind treatment and sufficient food and water for the ci.ogts cop~.fort. If such dog is not I;.nown or suspected of being rabid and has nit bitten a person it shall be kept in the village dog pound for s.t least five days unless sooner reclaimed by his owner. If such dog is known to be or suspected of being rabid or has .bitten a person it shall be Dept in the pound #~or at least fourteen days. Section 1~. ~ceclaiming or Disposing of Impounded Dogs. The owner may reclaim his dog by paying an impounding fee of X5.00 plus the cost to the vil].a.ge of keeping such dog in the village pound. If the dog re- quired a Lichfield license, such license shall also be obtained before the dog is released. If, at the end of the impoundment period the dog is not reclaimed by the owner such dog shall be deemed to have been abandoned and may be sold to any person. If the purchaser will Deep or harbor the dog in this village a license shall also be obtained before possession of th dog is given to the ,purchaser, If such dog is not so sold it may be killed in a humane manner, .Section 15. Limit of Two Dogs. Not more than two dogs over three months of age shall be I:ept on any one premises except at a licensed kennel. Section 16. Kennels -Licenses. No person shah. operate a kennel in this village without first obtaining a kennel license. ~pplicatian for such license shall be made to-the village clerk anti shall be accompanied by' the license fee. The clerk shall refer the application to the council who may grant or deny the license. Licenses issued shall be on an anr..ual basis, expiring on June first following the first effective day of the kennel license. ~ kennel license may be revoked by the village council by reason of violation of this ordinance or any health or nuisance order, vrdinan ce, law or regulation. The kennel license fee is $5U.00 per year or fraction thereof . Each month thy. owner. of each kennel shall report to the village manager, accurately stating in writing the great- est number of dogs kept in his kennel premises during the preceding calendar month. Dogs which are kept by a kennel in its capacity as the village pound need not be so reportod.
