1957-07Bill No. 1957-7 ORDNANCE N0. 3.35 AN ORDINANCErRt~VIDING FOr THE LICENSING OF FORTUNE TELLING PALMISTRY, CLAIRVOYANCE, ASTROLOGY A~tiD SIMI- LAR ACTIVITIES T.~ITHIN THE VILL~,GE OF RICrIFIELD The Village Council of the Village of Richf field do ordain as follows: Section 1. License .~teguired. No person shall engage in the practice or business of f Qrtune telling, palmistry, clairvoyance, astrology or similar activities or assist in carrying on such activity within the Village of Lichfield for a fee, reward, charge or compensation without first having obtained a license to conduct said activity in accordance with the pro- visions of this ordinance. Section 2. Definitions. The terms fortune telling, palmistry, clairvoy- ance and a stro~gy ineJ_ude any person who advertises by display sign, circular, handbill, newspaper, periodical, rr;.agazine or other publication or by any other r-~eans to tell fortunes or reveal the future or who shall claim or pretend by means of occaalt or psychic power, clairvoyance, psy- chology, psychometry, mediumship, prophecy, astrology, palmistry, necro- mancy or like crafty science, cards, talismans, charms, potions, magnetism magic or trick or device of any kind, to tell fortunes or reveal. the fu- ture or provide answers to questions relating to past events. Section 3. Application to Clerk. Any person wishing to engage in any of the foregoing activities for compensation within the Village of Richfield shall make application to the Village Clerk for a license therefor. The application shall be submitted to the Chief of rolice for investigation and recommendation. Thereafter, the' Village Clerk shall submit the ap- plication to the Village Council which shall determine whet~1er such ap- plication shall be granted. No license shall be issued by the Clerk pur- suant to authority of the Council until the license fee has been paid. Section 4. ypplication norm. The application for such license shall accurately state the following: (a) Name and physical description of the applicant, (b) Complete home and local address of the applicant and the address from which the proposed activity will be conducted, (c) A brief description of the nature of the business or activity to be conducted, (d) 'rhe dates anc~ hours of the day during which the activity will be carried on, (e) Two copies of a recent photograp~i of the applicant, a.pproxi- mately 22" x 22ti snowing the head and shoulders of the applicant in a clear and .distinguishable manner. (f) !: statement as to whether or not the applicant has been con- - vieted of a.E~y crime , rn.isdemeanor or violation of a.ny municipal ordinance, other than traffic violation and the nature of the offense and the punishment or penalty assessed therefor. Section 5, License Fee. The license fee shall be as follows: for one any, X10; for one week, $25; for one month, $50; for one year $300. Section 6. Compliance with License. Only the identical man or woman.named in the license may con- duct such activity pursuant to the license and such license shall not be transferable. Such activity shall be conducted only at the place and time authorized in the license, The license; shall be posted in a conspicuous place in the room or location where such activity is being carried on.
