1957-06ORDINANCE NO. 3.3? AN ORDINANCE LICENSiNG FtZIVAT~ GUA~tDS AND 1vATCHIyiEN Bill No. 1957-b The Village Council of the Village of Richfield do ordain as follows: Section 1. Definitions. "Private guard" or'taatchman" as used in this ordinance shall mean the rendering of the service to any person or per- sons of patrolling, investigating, inspecting or watch ing any buildings, stores, residences, or other property, at regular intervals or f ram time to time, or acting as a guard or other watchman on behalf of the owner of such buildings, stores, residences, or other property, provided that the provisions of this ordinance shall not apply to an individual who is a regular employee of the owner or lessee of one or more premises served by him as a watchman or guard, nor shall the provisions of. this ordinance be applicable to any peace off icer of the United States, or of the State of I~iinnesota, the County of Hennepin or the `tillage of Richfield, while in th.e discharge of his official duties. Secti~~n 2. License ~~equired. No person shall engage in the business of rrivate guar or watchman for a fee or reward unless he shall have first obtained a license to engage in such business in the Vi11.~a8e of Ricnf field from the Village Clerk. r~o person shall be deemed qualified' to bald such a license who is not licensed pursuant tc~ Section 326.331 Zinnesota Revised Statutes, and who is not a citizen of the United States, or who has been convicted of a felony by the courts of this or any other state or of the United States, or who has been convicted anywhere of acts which if done in Minnesota would be assault, theft, larceny, unlawful en- try, extortion, defamation, buying or receiving stolen property, using, possessing or carrying weapons or burglar tools, or escape. Section 3. ,`_pplicat.~n. The a~sFlicati.~•n far such license shall set f~rtTi the name ~-+f tie applicant, his age, sex, address, and the name of the person in active charge or superintendence of such business, together with a list of all employees to be employed in conducting the business and finger prints of all such persons and employees. Each such application shall be supported by the verified certificates of at least five citizens of Hennepin County, not related to the applicant, who have known the applicant (or if a corporation, each officer and manager, or if a partner- ship, each partner) more than five years, certifying that the applicant or such off icer, manager or partners are of good character and that each statement in the application is true. The application shall also state the exact nature of the business to be conducted, and such further in- formation as the Village Clerk shall require. Section 4. License Fee. The annual license fee for such license shall be '50.00 plus lO.OG for each employee, working in the Village of ;3ichf field.. Section 5. Surety Bond. Each such application shall be accompanied by a surety bond, eexecuted by a company authorized to do business in the State of Ninrkesota, wherein the applicant shall tie principal, with cor- porate surety to be approved by the Village Clerk, to .tf~e Village of Richfield in the penal sum of $5,000.00 upon condition that the appli- cant (and each of app].ieant's employees j shall #'aithfully observe all the laws of the State of I~inn~ sota and ordinances of the Village of Richf field and shall pay all damages suffered by any person by reason of the v iolation of any such law by the applicant or any employee thereof, or by the commission of any willful wrong by e,ny such applicant in the Ordinance No. 3.37 Continued: (2) course of the conduct of such business. i~ction upon such bdnd may be brought by any person so aggrieved not later than two years after the act complained of . Sect ion 6 . Employees of Licensee . No person shall be employed by li- censee in the capacity of watchtr~an or guard until. he shall have executed under oath and furnished the licensee a statement setting forth his full name, age and residence, the business or occupation in which he has been engaged for the three years immediately preceding, disclosing the place or places of such business or occupation and the name or names of his employers, and showing that he has never been convicted of a felony or of any offense which would disnualify him from holding a license under this ordinance and setting forth such further information as the rTillage Clerk shall require. Such statement shall be filed forthwith upon em- ployment of such employee with the Village Clerk. Section 7. police Authorit of iicensee. No person licensed under this ordinance shall by reason of suc license be granted any authority as a peace officer of the Village of Richfield. Section 8. Impersonating Officer. It i s unlawful for any person who is not a village, state or federal peace officer or law enforcement agent to falsely represent himself as such peace officer or law enforcement agent, whether such representation be made orally or by use of a badge, uniform or other act or means. Section 9. kenalty. Any person who shall be convicted of any violation of this ordinance shall be fined not to exceed $100.00 or ir,±prisoned for a period not to exceed. 90 days.
