CIVIL DEFENSE
ORDIN~3NCE NUJ. 8.02-
~ln ordinance to provide for civil defense and for the protection and
promotion o f public safety, health and welfare in the i~illage of Rich-
field during civil defense emergencies and emergencies caused by natural
catastrophes. The Village Council of the Village of Richfield do ordain
as follows
Section 1. Eor the purposes of this ordinance, the terms defined in
this section shall have the following rr~eanings:
'Civil Defenses' shall mean the preparation for and the carrying out of
all emergency functions, other than functions for which military forces
are primarily responsible, to prevent, minimize a.nd repair injury and
damage resulting from disasters., whether caused by ener:y attack, sabo-
tage, or other hostile action, or by any natural catastrophe or dis-
turbance. These functions shall include, ~~ithout limitation, fire
fighting service, police services, medical and health services, rescue,
engineering and air-raid warning services, communications, radiological,
chemical and other special weapons of defense, evacuation of persons
from. stricken areas, emergency welfare services, emergency transportation,
existing or properly assigned functions of plant protection, temporary
restoration of public utility services, and other functions related to
civilian protection, together with all other activities necessary or
incidental to preparation for and carrying out of the foregoing functions..
"Civil Defense Emergency" shall near. an emergency declared by the Cov-
crnor under the ~Ainnesota Civil Lefense 1~ct of 1951, Laws of 1951, Ch. 694,
Sec. 301, or where declared as hereinafter provided by the trillage of Rich-
field because of a.ny unprecedented accident or severe natural catastrophe.
Except in a declared emergency, "civil defense forces'Y shall mean any
personnel err,ployed by the Village and. assigned by Village department
heads for service anc~ for s pecif is a.ctivit ie s in preparation for civil
defense and any other volunteer or f~aid member of the local civil defense
agency engaged in carrying on civil defense functions in accordar_ce Frith
the provisions of this ordinance or ary rale or order thereunder.
Section 2. There is hereby created an adr~iinistrative department of
the Village of Richfield known as ttie Civil ~;efenseJepartment which shall
be under the supervision anc control of a Director of Civil flefense here-
inafter called the 'Director". The ~Jillage ~Iannager shall appoint or re-
rr~ove the director with the concurrence of the Village Council. The
director shall have direct responsibility for t:ie orgz~niza.tion, a dminis-
tration and operation of the Civil DefE:nse Department subject to the
direction and supervision of the Village iy~anager. The Civil ~)efense ~~e-
partment shall be organized. into such divisions and bureaus, consistent
with state and local civil defense plans, as the Director shall deem
necessary to provide for the effici~;nt perforr~~ance of local civil defense
functions during a civil defense emergency.
Section 3. To provide for any local natural catastrophe, unprecedented
acci~"c`Cent or disturbance, there is hereby established a board consisting
of Village Manager, hxayor and the ~:cting Mayor. ~~henever ir. tiie judg-
ment of any two or more me~r~~bers off' such board ar>y unprecedented accident
or severe natural catastrophe ~~r disaster s~rall warrant it, an emergF~r.cy
may be declared and the provisions of this ordinance may be invoked,
provided, hocaever, that there shal]_ be called a regular r~;eeting or special

rl~eeting of the Village Council within three days after the declaration of
such emergency for the ratification of such emergency declaration and if
such emergency declaration be disapproved at this or any subsequent village
meeting, it s'aall t~:rminate forthwith.

The Director shall rE1a1'e s~.~ch studies and surveys of the ma.npo~~er, indus-
tries, resources, and facilities of the City as he deems necessary to
determine their adequacy for civil defense and to plan for th=sir r,ost
efficient use in tune of a civil defense emergency.
The Director shall prepare a comprehensive general plan for the civil
defense of the Village, and for relief fr~.~r~. ar_y natural catastrophe, and
shall present such plan to the Council for its approval. ~~hen the Council
has approved the plan by resolution, it shall be the duty of all municipal
agencies ;nd all civil defense forc~;s of the 'tillage to perform. the L`~aties
anc~ functions assigned by the plan as approved. 'The plan mar be modified
in li%c manner from, time to tune. The Director ~~iall coordinate the civil
defense activities of the Village to the end that they shall be consistent
and fully integrated with the civil refense plan. of thy: federal government
anc? the state and correlated with the civil defense plans of other political
subdivisions within the state.

The TJirect~.~r shall utilize the personnel, services, equipment, supplies
and f acilities of existing departrrtent ar~d agencies of the Village to the
maximum extent practicable. The officers and personnel of all such de-
partments and agencies shall, to the maxin;um extent practicable, c7~perate
with and extend such services and facilities to the local civil defense
agency and to the Governor upon request. The head of each departr~.~=nt and
agency, in cooperation with and under tine direction of the director, shall.
be responsible for the planning anc~ programming of such civil defense ac-
tivities as will involve the utilization •of the facilities of his depart-
mnnt or agency. The :iireetor shall , in cooperation with existing*, Village
departments and agencies affect, organize, recruit and train air-raid
wardens, police reserves, fire reserves, er~_ergency medical j~er.sonnel, and
any other personnel that Wray be required on a volunteer basis t~~ carry out
the civil defense plans of the village and the state. To the extent that
such emergency personnel is recruited tc augrr_ent a regular Village govern-
rr~ent or agency ~:or civil. defense erriergencies, it shall be assigned t~, such
departrc~ent or agency for purposes of command. The Director m.a.y suspend

any civil defense volunteer at any time and. require him to surrender any
equipment and identification furnished by the pillage. The Director may,
with the advice anc+ consent of the ~soarci, provided for in Section 3 here-
of, disrniss any civil defense volunteer.
Consistent with the civil defense plan, the Director shall provide and
equip emergene~T hospitals, casualty stations, ambulances, canteens,evac-
uation centers, and other facilities or conveyances for the care of injured
or homeless persons .
The Director shall carry out all. orders, r:xles and regulations issued by
the Governor with reference to civil defense.
The Directo r shall direct 2nd coordinate the general operations of all
local civil defense forces during a civil defense emergency in conformity
with controlling regulations and instructions of state civil. defense
authorities. The heads of departments and agencies shall be governed by
his orders in respect thereto.
Consistent ~~rith the civil defense plan, the Director shall provide and
equip at some suitable place in the Tillage a control center and, if
required by the state civil defense plan, an auxiliary control center to
be used during a civil defense emergency as headquarters for direction
and coordination of civil defense forces. ile shall arrange for represen-
tation at trio control center by municipal departments and. agencies, public
utilities and other agencies authorized by federal or state authority to
carry on civil defense activities during; a civil defense emergency. %~e
shall arrange for the installation at the control center of necessary
facilities f'or cor~~munication with ar:d. between heads of civil defense
division, the station and operating units of municipal services and. other
agencies concerned with civil defense and for communication with other
communities a.nd control centers within the surrounding area and with the
federal-and state agencies concerned.
Section 5. i~o person shall be employed or associated in any capacity in
the civil defense agency who advocates or has advocated a change by force
or violence ir; the constitutie~na l f ors. of government in tie United States
or in this state or the ~werthrow of any government in the United States
by force or violence or who has been convicted of or is under indictment
or information charging any subversive act against the ~Jnited States. Each
person who is appointed to serve in the civil defense agency shall upon
entering upon his duties, take ar3 oath in wri~.ing as prescribed by the
Tinnesota Civil ~~efense het of 1851, "ection 403.
Civil defense volunteers shall be called into service only in case of
a civil defense emergency for `~~hich the regular municipa7_ forces are inad-
equa to or for necessary training and preparation for such emergencies, or
when deemed necessary by the ~ia.nager to carry out the provisions of t~iis
ordinance relating to relief from unprecedented accidents, natural catas-
trophe or disturbances.
Each civil defense volunteer shall b~; provided with such s:~itable insignia
or other identification as r;ay be required by the Director. Such iden-
tification shah be in a form and style approved by the federal government.
i~o volunt~~~-r shall exercise any authority over the persons or property of
others without his identification. too ~~erson except an authorized volun-
teer shall use the identification of a volunteer or otherwise represent

himself' to be an authorized volunteer. Tdo such identification shall be
used except at duly authorized civil defense activities.

Section 6. ~~hentver necessary to ~.~eet a civil defense emergency or to
prepare for such an emergency fur which adequate regulations have not
been adopted by the Governor or the Village Council, the Piana.ger may by
proclamation promulgate regulati~~ns consistent ~.ith applicable federal or
state law or regulation, re,spe:cting: protection against air-rains, the
sounding of air-raid alarms, the conduct of persons and the use of prop-
erty during alarnis; the repair, maintenance, and safeguarding of essential
public services; emergency health, fire, and safety regulations; trial
drills or practice periods required for preliminary training; and all
other rrnatters which are required to protect public safety, health, and
welfare in civil defense emergencies, No regulation governing observation
of enemy aircraft, a.ir attack, alarms, or illumination during air attacks
shall be adopted or take effect unless approved by the state director of
civil defense.
:very proclamation ,~f emergency regulations shall be in writing anc? signed
by the Manager, shall be dated, shall refer to the particular civil defense
to which it pertains, if so 7.imitcd, and shall be filed in tYie office of
the Village Cleric, where a copy shall be kept posted and available for
public inspection during business h~~urs. Notice of the existence of such
.regulation and its availability for inspection at the Clerk's off ice shall
be conspicuously posted at tr?e frnrat of the 'tillage Hall or other head-
quarters of the Tillage and at such other places in the affected area as
tlae Manager shall designate in the proclamation. Thereupon the regulation
shall take effect immediately or at such later time as may be specified
in the proclamation. by like proclamation the Manager may modify or rescind
any such regulation.
The Village Council n:ay rescind any such regulation by resolution at any
time. If not so~:~ner rescinded, every such regulation shall expire at the
end of 3~ days after its effective date or at the end of the civil defense
emergency to which it relates, whichever occurs first. ~~ny ordinance,
rule or regulation inconsistent with an emergency regulation pro~,ulgated
by the r'i.~,.nager shall be suspended during the period of time anG to the
extent that suc:~ c~:7nflict exists.

account tc~ be known as th:; civil defense fund. In this Fund shall_ be
placed t~ze proceeds of taxes levied .for civil defense, money transferred
fron~~ other funds, gifts ar~c~ other revenues of the civil defense agency.
From it shall be made exp~:nditures for the operation anc1. m.ainte.nance of
the civil defense agency and other expenditures for civil defense. 3egu-
lar acc9unting, disbursement, purchasirg, ~.udgeting, and other financial
procedures of the Village shall apply to the civil defense fur~.d except
~~hen an emergency exists.
:Section S. Every officer and agency ~~f the Village shall cooperate with
federal anc~ state authorities ~~nrl with authorized agencies engaged in
civil defense and emergency r~ieasures to tl1e; fullest possible extent

consistent with the perforr.,~.ancc of their other duties. The provisions of.
this ordinance ~,nd of all regulati,~ns mac! e t~lereunder shall be subject to
all applicable and controlling provisions of federal :end state laws and of
regulations and orders issued thereunder anal shall be deemed to be sus-
pended and inoperative so far as there is a.ny conflict trierewith. The
P~ianager may appoint any qualified person holding a position in any agency
created under federal or state authority for civil defense purposes as a
reserve policeman of the Village, with such police powers and duties within
the Village incident to the functions of his position, n7t exceeding those
of a regular policeman of the Village, a.s z~tay be prescribed in the appoint-
ment. every such reserve policeman shall be subject to the supervision and
control of the Chief of police and such other police officers of the Village
as the Chief may designate.

Section 10. The civil defense agenc~l shall not P.~a.rticipate in any fora? cf
rolitical activity, nor shall it be erployed directly or indirectly for
po]_itical purposes, nor shall it be employed in a legitimate labor dispute.
Section 11. hny person who vi~~lates any provision of this ordinance shall,
upon convicti~~n, be punishecs by a fine of not r.±ore than $106 or by im-
pris.~nment for not more than ~0 days.

The Director shall make
studies and surveys of the
power, industries, resources,
facilities of the City as he de
necessary to determine their
quacy for civil defense and to plan
for their most efficient use in
time of a civil defense emergency.
The Director s h a l l prepare a
comprehensive general plan for
the civil defense of the Village, and.
fox• relief from any natural catas-'
trophe, and shall present such plan
to the Council for its approval.
When the Council has approved the
plan by x•esolution, it shall he the
duty of all municipal agencies and
all civil defense forces of the Vil-
la;ge to perform the duties and
functions assigned by the plan as
approved. The plan m,ay be modi-
fied in li]:e manner from time to
time. The Director shall coordinate
the civil defense activities of the
Village to the end that they shall
be consistent and fully integrated
with the civil defense plan of the
federal government and the state
and correlated with the civil de-
fense plans of other political. sub-
divisions within the state.
In accordance with the state and
Village civil defense plan, the Di-
rector shall institute such train-
ing programs and ,public informa-
tion programs and take all other
ixT°ep~,ratoty steps, inicluding the..
partial or full mobilization of -civil
defense forces in advance oP actual
disaster, as may Le necessary to
the prompt and effective operation
of the Village civil defense g'lan in
time of a civil defense emergency.

The Director shall utilize t

sonnel of. all such department

oxtent practicable, cooperate with
and extend such services and fa-
cilities~ to~ the local civil defense
agency and to the Governor upon
request. The head of each depart-
ment and agency, in cooperation
with and under the direction of
the Director, shall be responsible'
for theplanning and programming
of such civil defense activities as
will involve the utilization of the
facilities of his department or
agency. The Director shall, in co-
operation with existing Vi1'Lage de-
partments and agencies affect, or-~
ganize, recruit and train air-raid
wardens, police reserves, fire re-
serves, emergency medical pers~on-
n.el, and any other personnel that i
may be required on a volunteer
basis to carry out the civil defense
plans of the villak,~e and the state.
To the extent that such emergency
personnel is recruited to augment
a regular Village government or
a„enc,y Yor~ civil defense emergen-
cies, it shall be assigned to such
department or agency for purposes
of command. The Director m a y
suspend any civil defense volun-
teer at any time and require him
to surrender any equipment and
identification furnished by the Vil-
lage. T'he Director may, with the
advice and consent of the ,Board,
provided for in Section 3 her-eof,
distniss any civil defense volunteer.
Consistent with the civil defense
plan, the Director shall provide and
equip emergency hospitals„ cas-
ualty stations, ambulances, can-
teens, evacuation centers, and other
facilities or conveyances fpr the
care of injured or homeless persons.
The Director shall carry out all
orders, rules and regulations issued
by the governor with reference to
civil defense.
The Director shall direct and co-
ordinate the general. operations of
ttuu weuare to civil defense emer-
gencies. No regulation governing

drtring air attacks shall be adopted
or take effect unless approved by
the state director of civil defense.
Every proclamation of emergency
regulations shall be in writing and
signed by the Manager, shall b'e
dated, shall refer to the particular
civil defense to which it pertains,
if so limited, and shall be filed in
the office of the Village Cleriz,
where a copy shall be kept posted
and avail le for.:public inspection
during ~ess hours. Notice of
the exi of such regulation

as the Manager shall designate in
the proclamation.. Thereupon the
regulation shall take effect im-
mediately or at such later time as

such regulation.
The Village ~C'ouncil may rescind
any such regulation by resolution
at any time. If not sooner rescinded,
every such regulation shall expire
at the end of 30 days after its ef-
fective date or at the end of the
civil defense emergency to which
it relates, whichever occurs first.
Any ordinance, rule or re;:;ulation
inconsistent with an emergency
regulation promulgated by the
Manager shall be suspended dur-
ing the period of time and to the
extent that such conflict exists.
Section i
There is hereby established in
the Ueneral Fund a special account
to be known as the civil defense
fund. In this -fund shall be placed
the proceeds of taxes levied for•
civil defense, money transferred
from other funds, gifts and other
revenues of the civil defense
agency. From it shall be made
expenditures for the operation and
maintenance of the civil defense
agency and other expenditures for
civil defense. Regular accounting,
disbursement, purchasing, budget-
tng, and other financial procedures
of the Village shall apply to the
civil defense fund except when an
me xists.
