1962-06Bill No. 6 ORDINANCE No. 7.02 AN ORDINANCE RELATING TO THE FIRE DEPARTMENT, FIRE PREVENTION AND RELATED MATTERS, AND REPID~ALING ORDINANCE No. 7.01 The Village Council of the Village of Richfield ordainse Section 1. It shall be the responsibility of the Richfield Fire Department to engage in the fighting of and the prevention of fir es so as to protect life and property. Section 2~ The chief administrative officer of the fire department shall be the Fire Chief, who shall perform the duties prescribed for his office subject to direction and control by the village manager. Section 3. The department shall consist of full-time firemen only, except that any volunteer fireman serving with the Richfield Fire Department at the time of the adoption of this ordinance, who has served as such volunteer fireman for more than 19 years, may continue to serve in such capacity until November 1, 1962_. Section ~.., Personnel of the fire department shall be selected subject to applicable rules and regulations of the Fire Civil Service Commission of the village Section 5.~ Sub-division 1. Duties of members of the fire department shall be determined from time to time and the duties of individual persons shal7i be subject to redefinition from time to time subject only to such supervisory author- ity as may exist on the part of the Fire Civil Service Commission. Subd. 2'. Members of the department are considered to be available at all times. An employee who wishes to engage in work outside of village employment shall comply with the following procedures (a) He must receive prior approval from the Fire Chief and the Village Manager. (b) He must make his request for permission to engage in off-duty em- ployment in writing. Such a written request shall include a description of the proposed employment showing that the condition and nature of employment w.n.ll permit him to respond to afire call within a reasonably short peri od of time, and that such employment will be within a f our mile radius of the central fire station of the village. Such written request shall also contain an agreement to notify the Fire Chief dr the members superior officer of any change in his outside working conditions, and that if his employment is proving incompatible with village em- ployment as a member of the department, he will terminate his outside employment. Subd, 3,. Permissible off-duty employment of a member of the Department shall not include the selling or servicing of any type of fire fighting equipment or accessories. Ordinance No. 7.02 (continued ) -- 2 Subd. 4. If a member of the department is injured while engaged in off- duty employment he will not be entitled to sick leave or workman~s compensation from the village for any resulting absence from duty with the department, but his position as a member of the department shall not be vacated for a period of three (3) months after the commencement of such absenteeism. Section 6. One or more members of the fire department may be designated by the village manager as fire marshals whose duty shall be to cause inspections to be made of all buildings within the village at such times as they shall deem necessary to prevent the existence of fire hazards., and shall enforce all laws of the State of Minnesota and all ordinances of the Village of Richfield relating to fire prevention. Any such fire marshall is authorized to enter any buildi ng or upon any premises. in the Village of Richfield at reasonable times for the purpose of inspection and is empowered to enter any building which constitutes an imminent fire hazard at any time for such purpose. Such marshall shall have the power to order abatement of any unnecessary fire hazard, in writing, and any person in charge of the property on which the fire hazard exists, or the owner thereof, when served with any such order shall abate such fire hazard within such reasonable time as may be specified in such order. Section 7. No unauthorized person shall ride upon, race with, trail or follow within 0~0 feet of any apparatus belonging t® the fire department when such apparatus is actively responding to afire call.. Section 8.. No person shall drive any vehicle over afire hose except upon specific orders from a member of the police or fire departments of the village, and then only with due caution. Section g, No person shall park any vehicle or place any material or other obstruction within 20 feet of the entrance to any fire station or within 15 feet of any fire hydrant or fire cistern nor shall any person park any vehicle within 300 feet of a place where afire, requiring fire fighting by the fire department, is in progress. Section 10.. No person shall sound a false fire alarm knowing such alarm to be false. Section 1Z. No person shall use any fire apparatus or equipment for any reason except as such as may be described by the chief of the fire department. Section 12. Nothing contained herein shall be deemed to deprive any person of any rights which he may have to any funds, general or special, in the Richfield Fire- menis Relief Association. Section 13. Any person violating any of the regulatory provisions of this ordinance shall, upon conviction therefor, be fined in an amount not exceeding $100 or by imprisonment for a period not to exceed 90 days.
