AN ORDINANCE CONCERNII~TG ANIl"iAL CONTROL IN THE
VILLAGE OF RICHFIELD AND PROVIDING FOR LICENS-
Il~'G OF CERTAIN ANIMALS
THE VILLAGE COUNCIL OF RICHFIELD ORDAIRTSs
Section 1. Subdivision 1. For the purpases of this ordinance, the terms
defined in this section shall have the meanings given them.
Subd.. 2. "Cwner" means any person, group or corporation owning,
keeping, harboring or having custody ~f a dog or cat.
Subd. 3. "Kennel" means a place where more than two dogs over
three months of age are kept, or a place at which the business of selling, boarding,
breeding, showing or treating dogs or cats is conducted.
Subd. ~.. A dog is "at large" when he is off the property of his
owner and not under restraint.
Subd. 5. A dog is "under restraint" if he is controlled by a
leash not exceeding six feet in length, or at heel beside a competent person
having custody of him and obedient to that person's commands, or within a vehicle
being driven or parked on a public street or within the property limits of his owner's
premises. An unattended dog on the pr operty of another, without the consent of such
property owner, is "at large" and not under restraint even though he is on a leash.
Section 2. No person shall own, harbor, keep, or have custody of a dog or cat
over three months of age within the village unless a current license for such animal
has been obtained as herein provided. Licenses shall be issued on an annual basis
and shall be made for the whole or unexpired portion of the year ending on the 31st
day of December next following the first effective day of the license.
Section 3. Subdivision 1. The license fee for each dog license shall be
$3.00.
Subd. 2. The license fee for each cat shall be $1.50.
Subd, 3. If the license for a dog or cat is obtained while the dog
or cat is impounded by the village, or after the required license period has commenced,
there shall be added to the regular license fee a late license fee of an additional
$5.00 for each such animal.
Subd. La.. Application for a dog or cat license shall be made to the
Village Clerk or the Pound Keeper. It shall include such descriptive information as
is necessary to provide reasonable identif ication of the animal and his owner.

Section 4. Subdivision 1. Upon the issuance of a dog or cat license by
the vi age ~ erk or the Village Pound Keeper, the licensee shall be provided
with a metallic tag bearing the license numb er, the word "Richfield", and the
year when the license period begins or has begun. Except when the dog or cat
for which the license is issued is indoors on the premises of his owner, the
animal shall have a collar or harness on which the license tag is affixed. No
person shall counterfeit any such tag of this village or use a counterfeit tag.
A license tag is not transferable to any other animal nor to a new owner for a
dog cr cat for which it is issued.
Subd. 2. If any such tag is lost or stolen, the owner may
obtain a r~ew tag by surrendering the receipt for the first tag and by paying the
sum of 50¢.
Section 5. No owner shall permit his dog to be at large in this village but
shall keep such dog in restraint at all times.
Section 6. The owner shall confine within a building or secure enclosure
any fierce, dangerous or vicious dog, except when securely muzzled and in the
control of a competent person. Every female dog in heat shall be confined in a
building, secure enclosure, veterinary hospital or boarding kennel, or shall be
controlled on a leash while being exercised.
Section 7. No person shall keep, harbor or maintain custody of a dog which
habitually barks or cries so as to annoy, or injure, or endanger the health, safety,
comfort or repose of any considerable number of persons. Any such dog is hereby
declared to be a public nuisance.
Section 8. The Village Council may provide for a village animal pound either
within or outside the limits of the village.
Section 9. The Village Manager shall designate the Pound Keeper and he may
appoint and deputize as special officers to enforce this ordinance such persons
approved by him who are employees or owners of any kennel, whether within or out-
side the village. Such persons sh all have police powers to cite owners of dogs
for cats for violations of this ordinance, to impound dogs or cats and to enf orce
the provisions of this ordinance.
Section 10. Such officers as the Village Manager shall designate to enforce
this ordinance may take up and impound any dog or cat found not to be kept, con-
fined or restrained or licensed in the manner required by this ordinance. To
enforce this ordinance, such officers may enter upon private premises where there
is reasonable cause to believe that a dog or cat is on the premises and is not
licensed as required by this ordinance or that there is a dog or cat on the premi-
ses which is not being kept, confined or restrained as herein provided. Any owner
shall produce for inspection his dog or cat license receipt when requested to do
so by such officer.

Section 11. Any dog or cat, that has bitten a person shall immediately be
impounded for at least 14 days and kept apart from other animals, under the
supervision of a veterinarian, until it is determined whether such animal had
or has a disease which might have been transmitted by such bite. Such impound-
ing may be done by the owner, and need not be at the village pound, but if it
is not at the village pound, the owner shall notify the village pound keeper
immediately and shall furnish proof in writing that such dog or cat is being so
impounded. Upon the expiration of such 14 days, if it is determined that the
dog or cat does not have a disease which might have been transmitted by such
bite, he may be released, and the village pound keeper shall be notified just
prior to such release. If the dog or cat is impounded at the village pound,
it may be reclaimed as hereinafter provided. Any dog that has been bitten by a
rabid dog or is believed to have been exposed to rabies shall be impounded and
kept in the same manner and for the same period of time as provided in this
section in the case of a dog or cat which has bitten a person.
Section 12. If a dog or cat is diseased, vicious, dangerous, rabid or ex-
posed to rabies and such dog or cat cannot be impounded after a reasonable effort,
or cannot be impounded with out serious risk to the persons attempting to impound
it, such dog or cat may be immediately killed.
Section 13. Any dog or cat which is impounded in the village pond shall be
kept, with kind treatment and sufficient food and water for the animal's comf ort.
If the animal is not known or suspected of being diseased and has not bitten a
person, it shall be kept in the village pound for at least five days unless it is
sooner reclaimed by its owner. If such animal is known to be or is suspected of
being diseased with a disease which might be transmitted to persons, it shall be
kept in the pound for at least l~. days.
Section 14. The owner may reclaim his dog or cat by paying an impounding fee
of `~10.C0 plus the cost to the village of keeping such dog or cat in the village
pound. Such $10.00 impounding fee shall be in addition to the $5.00 late penalty
license fee hereinbefore provided.
Section 15. If the impounded dog or cat required a Richfield license, pur-
suant to this ordinance, at the time it was impounded, such license shall be ob-
tained before the dog is released.
Section 16.. If, at the end of the impounding period, the dog or cat is not
reclaimed by the owner, such animal shall be deemed to have been abandoned and may
be sold to any person or disposed of by the pound keeper in a humane manner. If
the purchaser of any such animal is to keep such animal in this village, a license
shall be obtained by such person before possession of the animal is given to the
purchaser.
Section 17. Not more than two dogs over three months of age shall be kept on
any one premises except at a licensed kennel.

Section 18. Subdivision 1. No person shall operate a kennel in this village
with out first obtaining a kennel license. Application for such license shall be
made to the Village Clerk and shall be accompanied by the license fee. The Clerk
shall refer the application to the Council which may grant or deny the license.
Licenses issued for kennels shall be on an annual basis, expiring on June lst
follooaing the first effective day of the kennel license.
Subd. 2. A kennel license may be revoked by the Village Council
by reason of violation of this ordinance or any health or nuisance orders ordinance,
law or regulation..
Subd. 3. The kennel license fee is $50.00 per year, or fraction
thereof.
Subd. ~.. Each month that a kennel is operated, the owner of such
kennel shall report to the Village Manager, accurately stating in writing, the
greatest number of dogs kept in his kennel premises during the preceding calendar
month. Dogs kept by a kennel in its capacity as the village pound need not be so
reported.
Subd. 5. Kennels shall be kept in a clean and healthful condition
at all times, and shall be open to inspection by any health officer, sanitarian or
other persons charged with the enforcement of this ordinance or any health or sanitary
regulation of the village, at all times..
Section 19. The Pound Keeper shall account for and pay over monthly to the
village all moneys received by him on behalf of the village as license fees or as
other fees. The Pound Keeper shall also give an accurate written report each month
to the village stating all licenses issued by him, all fees collected, all sales made,
all dogs or cats impounded, the duration of any such impoundment, all animals des-
troyed, and any other pertinent data relating to animal control which may be requested
by the Village Manager.
Section 20. Any person violating any of the provisions of this ordinance shall,
upon conviction therefor, b e punished by a fine of not to exceed $100.00, or by im-
prisonment for not to exceed 90 days.

hereto attached, said newspaper was published in the Village of Rich-
field, in the County of Hennecpin, State of Minnesota, on TYr'ursday of
each week; that during all said time said newspaper has been printed
in the Eruglish language from its office of publication within the Vil-
lage of Richfield, Hennepin County, Minnesota, from which it is issued
as above stated and in newspaper format and in column and sheet
form equivalent in space to at least 450 running inches crf single col-
umn, two inches wide; has been issued as aforesaid once each week
from a known office established in said place of publication and em-
ploying skilled workmen and tine necessary material for preparing
and printing the same; that the press work an that part of the news-
paper devoted to local news of interest to the community it purports
to serve has been done in its known office of publication; that during
alI said time in its makeup not less than twenty-five percent of its
news columns have been devoted to local news of interest to the com-
munity it purports to serve; that during all said time it has not
wholly duplicated any other publication, and has not been entirely
made wp of patents, plate hatter and advertisements; has been cir-
culated in and near its said place of publication to the extent of at
least two hundred and forty (24U) copies regularly delivered to pay-
ing subscribers and has entry as second class matter in its local post-
