AN CRDINANCE REGUTATING GASOLINE AND OIL SERVICE
STATIONS
CITY OF RICHFIELD DOES ORDAIN:
Section 1. It is hereby determined that gasoline and oil service stations
may pose particular problems in achieving compatibility with abutting and adjacent
land uses because of potentially detrimental aspects of their operation. The
public health, safety and general welfare requires that, because of traffic hazards,
noise, light glare, outdoor storage of merchandise, indiscriminate advertising
inadequate incineration facilities, insufficient maintenance, unsightliness and
inadequate storage of debris and used materials, such service stations be specific-
ally regulated. The term "service station", as used in this ordinances is a retail
place of business engaged primarily in the sale of motor fuels, but also may be erg-
gaged in supplying goods and services generally required in the operation and main-
tenance of automotive vehicles and the fulfilling of motoristst needs. These may
include sale of petroleum products; sale and servicing of tires, batteries, auto-
motive accessories and replacement items; washing and lubrication services; the
performance of minor automotive maintenance and repair; and the supplying of other
incidental customer services and products.
Section 2. Any building used as a service station shall be constructed and
maintained as required by the rules and regulations of the state fire marshal.
Every facility, whether underground or above ground and whether indoors or out of
doors, for the handling, storage and movement of flammable liquids shall be con-
structed and maintained in accordance with the rules and regulations of the state
fire marshal.
Section 3. Such stations shall be operated in accordance with the other ordin-
ances of the city, including Section 11-A-3 of the zoning ordinance of the city.
Section ~.. Service station premises shall not be used as a place of sale or
resale, or as a place for display for sale or resale, of new or used motor vehicles.
Service station premises shall not be used as a place of storage
for wrecked, abandoned or junked automobiles. No motor vehicle in need of repair
shall be stored on the premises of a service station for a continuous. period of more
than 7 days, except when so stored pursuant to a police directive.
Section 5. No materials shall be burned on the premises of a service station,
except in an approved commercial incinerator complying with the ordinances of the
city. Barrels and similar containers shall not be used for incineration.
Section 6. Used oil cans, discarded auto parts, discarded tires and similar
items of debris sha 11 not be stored on service station premises, unless such items
of debris are located in an enclosure and are completely outside of public view.
Such debris shall be removed from the premises at least once each week..

Section 7. The entire area of service station premises shall be improved
with either (a) concrete or bituminous surfacing or (b) landscaping with grass,
flowers and shurbs, or both. The premises shall be well maintained at all times
and shall be kept free from refuse, weeds and debris (except such debris as is
suitably enclosed as provided above).
Section 8. Tires for sale shall not be stored or displayed outside the service
station structure, except (a) in a display rack during business hours, or (b)
in a permanent outside display container located in conformance with the setback
requirements of the zoning ordinance of the city and completely encloseable. Such
display container shall be closed when the station is not open for business.
Section 9. Any person violating any of the provisions of this ordinance
sha 11 be guilty of a misdemeanor and upon conviction thereof shall be punished
by a fine not exceeding $100 or imprisonment not exceeding 90 days.
