1966-03Bill #1966-3 AMENDMENT TO ORDINANCE NO. 2, O1 An Ordinance Amending Section 5 of Ordinance No. 2.01 of the City of Richfield Entitled "An Ordinance to Regulate the Construction and Alteration of Buildings and Structures Udithin the Village of" Richfield for the Purpose of Promoting the Public Health, Safety, Order, Convenience, Prosperity and General Welfare in Said Village". CITY OF RICHFIELD DOES ORDAIN : Section 5 of Ordinance No. 2,01 of the City of Richfield entitled: "An Ordinance to Regulate the Construction and Alteration of Buildings and Structures Within the Village of Richfield for the Purpose of Promoting the Public Health, Safety, Order, Con- venience,. Prosperity and General Welfare in Said Village" is hereby amended by adding, after Paragraph C thereof, the following: D. It is hereby determined and declared that a substantial depreciation of values in the neighborhood occurs upon the construction, moving, alteration 6f or repair to structures described in this paragraph. The building inspector, therefore, except as otherwise provided in this paragraph, shall not issue a building permit for any structure for which~a building permit is required if the proposed structure will have a front or side abutting upon or visible from a public street, which contains exterior facing mater- ials which are not of a permanent nature or have a tendency to deteriorate rapidly, or which for any reason are or quickly may become unsightly in appearance. The following are examples of such materials: Concrete masonry units, common clay brick, sand lime brick, concrete brick, unfinished structural clay tile, sheet metals either corrugated or plain, and exposed unfinished concrete. Such materials, however, may be used in a special arrangeme nt or combination with other materials of a permanent nature with gaod architectural design and appe al if in compliance with the following provisions of this Paragraph D. In the event an owner, intending to apply 'for a building permit, desires to use any of the materials excluddd under the foregoing paragraph of this ordinance as ex- terior finish materials, such owner may present to the building inspector a request for preliminary approval for the use of such materials prior to the preparation of final drawings and the application required by this ordinance. Such request for preliminary approval shall include any sketches and other information necessary to indicate accurately the use to be made of such materials and the appearance of the exterior of such structure when completed. If such request for preliminary approval of materials is granted by the building inspector, the sketch and other information shall be properly marked for identification and by him filed in his office and such data shall become a part of the building permit application when filed. Upon the filing of the application for building permit, together with'the additional information required by this ordinance and by other ordinances of the city,, showing compliance therewith and agreeable to such approved sketch without sub- stantial change therefrom, the building inspector is hereby authorized to issue a build- ing permit therefor; provided that in those instances where the authorization for the issuance of the building permit must be granted by the City Council, such authorization must first be obtained.. Amendment to Ordinance No. x.01 -2- Bill #1966-3 In any instance where the building inspector denies a permit or a request for preliminary approval hereunder, the applicant may submit a request based upon the plans and other papers on file in the office of the building inspector for granting of said request or application to the City Council, without payment of additional filing fees of any kind.. The provisions of this Paragraph D shall be deemed supplementary to the zoning ordinance of the city and shall be enforced in harmony and conjunction there- with. The Council, in determining whether or not to permit the use of any such materials, shall not grant any permit therefor if it finds that the structure for which the application is made, or other properties in the neighborhood, will be depreciated in value by reason of the use of a.ny such materials. Except as hereinbefore provided, the Council shall grant a building permit for a.ny building or structure which complies with the building code of the City of Minneapolis, three copies of which are marked as official copies and are on file in the office of the city clerk.
