AMENDMENT TO SECTION 3.68 OF THE
ORDINANCE CODE. OF THE CITY OF
RICHFIELD, MINNESOTA
CITY OF RICHFIELD DOES ORDAIN:
Section 3.68 of the ordinance code of the City of Richfield, Minnesota,
relating to the planning commission of the city is hereby amended to read as
follows:
"3.68. ESTABLISHMENT.
Subdivision 1. Creation by Ordinance. Pursuant to Minnesota Statutes
462.354, Subd. (1), there is hereby created a city planning agency.
Subd. 2. Commission Form Sha11 be Used. The agency created in subdivision
1 of this section shall operate as a planning commission. This commission may
be provided with a staff which shall be a part of the administrative structure of
the city. The commission shall serve directly in an advisory capacity to the
council.
Subd. 3. Composition of Commission. The commission shall consist of nine
(9) members to be appointed by the council to serve terms of office as established
by the council. The commission shall also have four (4) ex-officio members in-
cluding the manager, the Superintendent of Schools for Independent School District
No. 280, one (1) councilman and one other representative of the Board of Education
of Independent School District No. 280. 1-27-69 (69-2)
Subd. 4. Council May Promulgate Additional Powers and Duties. In addition
to the powers and duties prescribed in this section and other applicable provisions
of law, the council may promulgate such additional powers and duties for the plan-
ning commission as it shall deem advisable.
Subd. 5. Dismissal of Commission Members. Commission members shall serve at
the pleasure of the council. The council may dismiss appointive members of the
commission at its discretion with or without cause.
Subd. 6. Powers and Duties of the Commission. The planning commission shall
have all of the powers and shall undertake all of the duties ascribed or imposed
by Minnesota Statutes 462.351 to 462,364. The commission shall exercise these
powers and acquit these duties with diligence and efficiency.
3.68 ESTABLISHMENT.
Subdivision 1. Creation by Ordinance. Pursuant to Minnesota Statutes 462.354,
Subd. (1), there is hereby created a planning agency.
Subd. 2. Commission Form Sha11 Be Used. The agency created in Subdivision 1
of this section shall operate as a planning commission of the city. Staff services for
the commission shall be furnished by the planning department of the city. The Com-
mission shall serve in a direct advisory capacity to the city council.

Subd. 3. Composition of the Commission. The commission shall consist of
nine (9) members to be appointed by the city council to serve terms of three
years, with terms of members to be staggered so that as nearly equal number of
terms as possible shall expire each year. Members shall be appointed in January
of each ear to serve for three years beginning on the first day of February in
the same year. The commission shall also have four (4) ex-officio members in-
cluding the city manager, the superintendent of schools for Independent School
District No. 280, one (1) councilman and one other representative of the Board of
Education of Independent School District No. 280.
Subd, 4. Powers and Duties of the Commission. The planning commission, in
its capacity as the planning agency for the city, shall undertake all of the duties
ascribed to or imposed upon such agency by Minnesota Statutes 462,351 to 462.364.
In addition, the planning commission shall deliberate and make recommendations on
(a) all proposed subdivisions and resubdivisions of land, (b) all proposed amend-
ments to the zoning ordinance of the city, (c) all land development applications re-

action on specific planning matters.

planning efforts of the community.
Subd. 6. Dismissal of Commission Members. Commission members shall serve at
the leasure of the council. The council may dismiss appointive members of the
commission with or without cause b a majority vote.
Subd. 7. Vacancies. Any of the following shall cause the office of a member
to become vacated:
(a) Death.
(b) Disability or failure to serve.
(c) Removal of legal residence from the city,
(d) Resignation in writing.
(e) Removal with or without cause by the council.
(f) Election or ~.ppointment to a public office.
Should a vacancy occur for any of such reasons the commission shall notify the council
of the vacancy and request appropriate action to fill the vacancy.
Subd. 8. Additional Powers and Duties. The council may assign additional
duties and responsibilities to the planning commission to assist the commission in
effectively carrying out its general objectives, powers and duties."
Subd. 5. General Objectives of the Commission. The planning commission, as
a public service, shall endeavor to perform the following functions in behalf of
the community:
