1974-02Bi11 No, 1974-2 AN ORDINANCE RELATING TO THE OUTSIDE PARKING AND STORAGE OF RECREATIONAL VEHICLES: AMENDING SECTION 3.27, SUB- DIVISION 3, BY ADDING PARAGRAPHS: AMENDING SECTION 3.38, SUBDIVISIONS 3, 4 and 6; AND ADDING A NEW SECTION TO THE CITY CODE OF ORDINANCES CITY OF RICHFIELD DOES ORDAIN: Section 1, Section 3.27, Subdivision 3 of the City Code of Ordinances is amended by adding new paragraphs (35) and (36) to read: "(35) The term 'recreational vehicles and equipment' means travel trailers, including those which telescope or fold down, chassis mounted campers, house cars, motor homes, tent trailers, slip-in campers, converted buses, and con- verted vans; 1. Travel trailers, chassis mounted campers, house cars, motor homes, tent trailers, slip in campers, converted buses, con- verted vans and units that are designed and used for human living quarters and meeting the following qualifications: a) Are not used as the residence of the owner or occupant, b) Are used for temporary living quarters by the owner or occupant while engaged in recreational or vacation activities. c) Are self propelled or towed on the public streets or highways incidental to such recreational or vacation activities. Slip i either box The term includes snowmobiles and snowmobile trailers, boats and boat trailers, and all terrain vehicles and all terrain vehicle trailers. The term does not include mobile homes or house trailers as defined in Minnesota Statutes 168.011 Subdivision 8. "(36) The term 'established drivewav' means a permanent concrete, asphalt or other surfaced area of a lot designed to provide ingress and egress for motor vehicles from the street to a garage or other off-street parking area authorized herein. The term does not include any non-contiguous a~°ea exclusively set aside or used for the parking and storage of recreational vehicles and equipment~or arking lots. Section 2. Section 3.38, Subdivision 3 of the City Code of Ordinances is amended by adding a new paragraph to read: "(2) Recreational vehicles and equipment.11 Section 3. Section 3.38, Subdivision 4 of the City Code of Ordinances is amended to read: "Subd. 4. Unlawful Storage - Special Use Permit. It is unlawful for any person owning, keeping, driving, or in charge of any house trailer, mobile home /vacation trailer, vacation bus/ airplane, construction or home-occupation machinery, equipment or supplies, or other machinery, equipment, supplies or materials not customarily used or needed in connection with the occupancy of residential property for residence purposes, to cause or permit the same to be stored outside of a building on any residence district property for a total of more than 30 days during any calendar year without first obtaining a special permit to do so in accordance with subdivision 5 of this section; /provided that no special permit is required for a house trailer, mobile home or vacation trailer less than 20 feet in length./" Section 4. Section 3.38, Subdivision 6 of the City Code of Ordinances is amended to read: 1 (a) On any rear or side yard of a lot exc~t the side yard of a corner lot adjacent to the street. (b) Not closer than three feet to any building or structure, in- cluding fences. (c) In an established driveway of a lot but not closer than three to any building or structure nor beyond the lot line and not closer than twelve feet to the curb line of the street abutting an established driveway. (d) A recreational vehicle may be stored on a lot without regard to the location on the lot for the sole and express purpose of loading and unloading for a period not in excess of 48 hours. (e) Unmounted slide-in pickup campers must be stored no higher than 20 inches above the ground and must be securely supported at least at four corners by solid support blocks. "Subd. 6. Conditions Governing Issuance of Permit. No such permit shall be granted if the manager or his designate determines that granting the permit will create, or be likely to create an adverse influence upon the residence district involved, or upon persons or property in the vicinity of the location for which the permit is sought. /No house trailer, mobile home or vacation trailer, regard- l.ess of length, shall be parked or stored on residence property in any front yeard or side yard area where a structure would be prohibited by the provisions of this chapter./" Section 5. The City Code of Ordinances is amended by adding a new division to read: "3.38A Recreational Vehicles and Equipment: Parking and Storage. vehicles and equipment in this section are designed to regulate their storage and commercial use and to protect the health, safety, and general welfare of the community. The standards are established to promote the safe use, storage, and parking of recreational vehicles and equipment and to eliminate those conditions or misuses which are unsafe and cause deterioration of property and property Subdivision 1. Declaration of Purpose. The standards established for recreational values. Subd. 2. Permitted Uses. Recreational vehicles and equipment may be parked or stored in a residential district in accordance with this erection and other provisions of the City Code as follows: feet Subd. 3. Prohibited Uses. A recreational vehicle may not be stored, parked, or utiliz ed in a residential district as follows: (a) Recreational vehicles and equipment shall not be used as a permanent residence. (b) A recreational vehicle which is in a state of externally visible disrepair or partial construction must be stored or parked in a rear or side yard but not closer than three feet to any building, or structure and for not more than one year." 1974.
