1973-15Ei11 No. 1973-15 ORDINANCE NO. 16. 1g AN ORDINANCE PROVIDING FOR THE DISPOSITION OF CERTAIN REAL PROPERTY OF THE CITY LOCATED AT THE NORTHV~TEST CORNER OF NICOLLET AVENUE AND 72ND STREET CITY OF RICHFIELD DOES ORDAIN: "Section 1. The following property of the city located at the Northwest Corner of. the intersection of Nicollet Avenue and 72nd Street is hereby authorized to be sold to thy: County of Hennepin. That part of Government Lot 4, Section 34, Township 28, Range 24, described as follows: Beginning at the southeast corner of said Government Lot 4; thence nc:,rth along the east line of said Government Lot 4 a distance of 599.74 feet; thence west, at a right angle, a distance of 120.00 feet; thence southwesterly deflecting to the left 45 degrees 00 minutes 00 seconds, a distance of 185.00 feet; thence south, deflecting to the left 45 degrees 00 minutes 00 seconds; a distance of 13S . 00 feet; thence southwesterly, deflecting to the right 45 degrees 00 minutes 00 seconds, a distance of 111.97 feet, more or less to the intersection with a line drawn parallel with the east line of said Govern- ment Lot from a point onrr the south line of said Government lot distant 330.00 feet west from the southeast corner of said Government Lot; thence south, along said parallel line, a distance of 257.36 feet; more or less, to said south line; thence easf., along said south line, a distance of 330.00 feet to the point of beginning. , Section 2. The terms and conditions of such sale shall be determined by resolution of the city council and the proceeds of such sale shall be used in accordance with the provisions of Section 12.05 of the city charter. RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as The Richfield Sun and has full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% oL its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said) newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75% of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter irl its local post-office. (S) Said newspaper purports to serve the City of Richfield in the County of Hennepin and it has its known office of issue in the City+ of Bloomington in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and main- tained by the managing officer or persons in its employ and subject to his direction and con- trol during all such regular business hours and devoted exclusively during such regular business hours to the business of the newspaper and business related thereto. (8) Said news- paper files a copy of each issue immediately with the State Historical Society. (7) Said news- paper has complied with all the foregoing conditions for at least two years preceding the day or dates of publication mentioned below. (8) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1. 1988 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the publisher oL said newspaper and sworn to before a notary public stating that the newspaper is a leRai newspaper.
