1978-18Bill 1978-18 AI~•IENDP~sENT TO CHZ3PTER III, PART V, SECTION 3.47 OF THE RICI-FIELD ORDI~l~NCE CODE CITY OF RICHFIELD DOES ORDAIN: Chapter III, Part V, Section 3.47 of the Richfield Ordir~nce Cede dealing with the rc~gulati.or. cf signs and billboards is hereby amended in the follo~•~i_ng respects: A. By adding to Subdivision 1, thereof -the followi r_g new paragraph: "(16) 'Promotional Display Device' means and is limited to any beacon, banner or aerial balloon being used in connection with the promotion of any event or activity and situated entirely on premises where such activity or event is or will be conducted." B. By adding to Subdivision 3, thereof the following new paragraph: "(8) A promotional display device provided that the following conditions have been met. a. The person, firm, or corporation proposing to use such device makes application to the City 1`Ianager on forms provided for that purpose, and b. The City Manager, after review of the application together with any other information he deems necessary, approves the use of such device:.. I i I c . County of Hennepin J. R. RITCHAY, being duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as T'he Richfield Sun and leas full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspaper format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% oT its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication an¢ is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75°Jo of its total circulation currently paid or no more than three months in arrears and has entry as second-class matter in its local past-office. (5) Said newspaper purports to serve the City of Richfield in the County of Hennepin and it has its known office of issue in the City of Bloomington in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in its employ and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours acid at which said newspaper is printed. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (8) Said newspaper has complied with all foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 7, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper. By adding to Subdivision 1, thereof the following new paragraph: "(161 `Promotional Display De- vice' means and is limited to any beacon, banner or aerial balloon being used in connection with the promotion of any event or activ- ity and situated entirely on pre- mises where such activity or event is or will be conducted." B. By adding to Subdivision 3, thereof the following new paragraph: "(8) A promotional display de- vice provided that the' Following conditions have been met. a.
