I6.48 CF?ARTER Ar~:[ENDn1ENT ORDINANCE NO. 4~ APd ORDINANCE A!~IENDING THE CITY CHARTER OF THE CITY OE RICHFIELD CITY Or RICHFIELD DOES ORDAIN: The City Charter of the City of Richfield, adopted November 3, 1964, as subsequently amended, is hereby amended in the follo~r;ing respects: (1) Section 12.03 thereof, entitled "City Officers not to be Interested in Contracts" is hereby deleted. (2) Chapter 12, entitled "A:[i_scellaneous and Transitory Provisions" is hereby renumbered Chapter 13. Sections 12.01, 12.02, 12.04, 12.05, 12.06, 12.07, 12.08, 12.09, 12.10, 12.11, 12.12 and 12.13 are hereby renumbered 13.01, 13.02, 13.03, 13.04, 13.05, 13.OE, 13.07, 13.08, 13.09, 13.10, 13.11 and 13.12 respectively. (3) A new Chapter 12 shall be added to the City Charter, after Chapter 11 thereof, providing as follows: "CHARTER 1l Code of Ethics Sec. 12.01. The term 'public official' shall include all elected officials, the city manager, and all members of_ boards or commissions, as are authorized under this Charter. Sec. 12.02. No public official shall misuse such position to secure special privileges or exemptions for such person or_ any other person. Sec. 12.03. No public official shall directly or indirectly receive or agree to receive, any compensation, gift, reward or gratuity in payment for the performance of his or her official duties except as may be provided by law. Sec. 12.04. No public official shall enter into any contract with the City which is prohibited by law. Any public official who has a proprietary interest in an entity doing business with the City shall make }:no~,an that interest in writing to the City Council and the City C1_erk. Sec. 12.05. Any public official who in the discharge of said official`s duties would k~e required to take an action or make a decision which would substantially a:Efect such official's financial interests or those of a business with ~ti~hich such official ~ - ~. J is associated, unless the effect on such official is no greater than on any other citizens or other members of such official's business classification, profession, or occupation, shall take the following actions: a. A written statement shall be prepared which will include the name, address, office held, action presenting the potential conflict of interest, the nature of the financial interest, the person notified of the potential conflici of interest, the official's signature and the date; b. Said person shall deliver copies of the state?~ent to the City Clerk and to the official's immediate superior, if any; c. if a potential conflict presents itself and there is insufficient time to comply with the provisions of clauses "a" and "b" of this section the public official shall verbally inform the City Clerk and the official's superior of the potential conflict. The official1 shall-then file a written statement with the City Clerk within one week after the potential conflict presents itself which statement shall state the reason for the delay. Sec. 12.06. Any intentional failure to file such statement or any intentional filing of a false written or verbal statement or any intentional omission of any required information in any required statement shall be unlawful and shall be referred by the City Clerk or the public official's immediate superior to the City Attorney for appropriate action." RITCHAY, beix)g duly sworn, on oath says he is and during all times here stated has been the vice president and printer of the newspaper known as The Richfield Sun and leas full knowledge of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspaper fgrmat and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Said newspaper is a weekly and is distributed at least once each week. (3) Said newspaper has 50% of its news columns devoted to news of local interest to the community which it purports to serve and does not wholly duplicate any other publication and is not made up entirely of patents, plate matter and advertisements. (4) Said newspaper is circulated in and near the municipality which it purports to serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75°Jo of its total circulation currently paid or no more than three montgs in arrears and has entry as second-class rnatter in its local post-office. (5) Said newspaper purports to serve the City of Richfield in the County of Hennepin and it has its known office of issue in the City of Bloomington in said county, established and open during its regular business hours for the gathering of news, sale of advertisements and sale of subscriptions and maintained by the managing officer of said newspaper or persons in its emplpy and subject to his direction and control during all such regular business hours and devoted exclusively during such regular business hours aid at which said newspaper is printed. {6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to anv person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (8) Said newspaper has complied with all foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter an affidavit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
