1980-17BILL 1980-17 AMENDMENT TO CHAPTER III, SECTION 3.39 OF THE ORDINANCE CODE OF THE CITY OF RTCHFIELD ~~ (' CITY OF RICHFIELD DOES ORDAIN Chapter III, Section 3.39 of the Ordinance Code of the Cite of Richfield dealing with e:~emptions and modifications to the zoning code is hereby amended by amending subdivision 2, paragraph e:, thereof to read as follows: (e) A wall, fence or hedge may occupy part of the recuired yard; except~that.(1) no wall, fence or hedge more than four feet in height shall be constructed or permitted between the front line of the lot and the front line of the building extended to the side lot lines. (2) no wall, fence or hedge more than six feet in height shall be constructed or permitted on any rear yard or sideyard, and (3) no wall, fence or ;Hedge more than four feet in t'r~e side abutting upon a street or corner lot which abut upon a key lot. All posts on any fe::ca located on or near t_:e lot line shall be cn the insiue o~ the fence unless they are designed as a integral part of the fence. The term "hedges" as used in this paragraph shall not include trees. All walls, fences and hedges abutting on the public right-of-way shall be set back three feet from the public right of way [ . ] except that walls, fences and hedges abutting on public ria_^~- of-wav which is contiguous to non-collector or non-arterial roadways as designated by the adopted comprehensive plan may be exempted from this set back provision when in the opinion of the city manager such exemption will not conflict with anv existing city side~~ralk policy nor create anv potential snow storage problem. Barbed wire and electric fences are prohibited. Fences shall t:e set back three feet from parking areas. On anv corner lot nothing shall be erected, placed, planted or allowed to grow in such a manner as to obstruct vision between the height of two and one-half feet above and ten feet above the intersection of the center lines of the intersecting streets in the area bounded by the street curb lines abutting said corner lot and a line connecting points on the abutting curb lines fifty feet from the intersection of the e:~tensions of the curb lines. All fences, walls and hedges legally existing on the ef~ective date of this amendment shall be allowed to continue to exist ..nd to be repaired and maintained. (6) Said newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (8) Said newspaper has complied with all foregoing conditions for at least one year preceding the day or dates of publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter and affidavit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
