1997-010 BILL NO. 1997-1 AMENDMENT TO CHAPTER XIII OF THE CITY CODE OF THE CITY OF RICHFIELD THE CITY OF RICHFIELD DOES ORDAIN: Chapter Xlll, Traffic, Motor Vehicles, and Other Vehicles, of the ordinance code of the City of Richfield is hereby amended by adding Section 1327 entitled "Parking: Truck tractors, semi-trailers, truck-tractor and semi-trailer combinations or trucks" as follows: Section 1327. Parkins: Truck-tractors. semi-trailers. truck-tractor and semi-trailer combinations or trucks 1 1327.01. Declaration of purpose. The standards established for truck-tractors. semi- trailers, truck-tractor and semi-trailer combinations or trucks in this section are designed to regulate their parking within all zoning districts in the City With the deregulation of the trucking industry and subsequent increase of independent truckers, parking of trucks throughout the citescould become a nuisance and unsightly. It is the ~uraose ofof this subsection to regulate truck-tractor. semi-trailer. truck-tractor and semi-trailer combinations or truck parking to eliminate those conditions which are a nuisance. unsightly and cause the deterioration of property and property values. 1327.03. Definitions. Subdivision 1. For purposes of this section the terms defined in this subdivision have the meaning given them. Subd. 2. The term "truck-tractor" means a motor vehicle designed and used primarily for drawing other vehicles and not constructed to carry a load other than a part of the weight of the vehicle and load drawn. Subd. 3. The term "semi-trailer' means a vehicle of the trailer type so designed and used in conjunction with struck-tractor that a considerable part of its load rests upon and is carried by the truck-tractor and includes a trailer drawn by a truck-tractor and semi-trailer combination. fl J Subd. 4. The term "truck" means for this subdivision only, a motor vehicle which is self-propelled and has a gross vehicle weight of 10.000 pounds or more. used for the transportation of property. and does not include a recreational vehicle as defined in the City Code. or a school bus as defined in Minnesota Statutes. Section 169.01. Subd. 6. Bill No. 1997-1 -2- 1327.05. Prohibited Uses. Subdivision 1. The uses set forth in this subsection shall not be considered as permitted uses or accessory uses in commercial or industrial or multi-family districts. Subd. 2. The parking of any truck-tractor. semi-trailer, truck-tractor and semi- trailer combination or truck is unlawful except: (a) where such parking is necessary in connection with construction activity which is actually occurring on the property pursuant to a valid and current building hermit: (b) for a period of up. to twelve hours. or such longer time as permitted by the Director of Public Safety. where such parking is for the purpose of unloading or loadinq_materials. supplies or inventory to be used in connection with the business activity occurring on the property; but not for the puroose of storage of such materials. supplies or inventory pending sale: (c) where such vehicles are actually being offered for sale or lease by the business located on the property, but only if such sale or lease activity is permitted by this code; (d) where such parkin~is in connection with paper recycling or other similar activi~ conducted by non-profit organizations: or (e) a vehicle customarily used in connection with a business where the vehicle is parked. Subd. 3.
