Amendment to the City Code
of the City of Richfield
The City of Richfield Does Ordain:
A.
Section 1. Section 425 of the Richfield City Code is amended to read as follows:
Section 425 - Access~~~~ntennae~ and towers.
425.03. General rule. Except as otherwise provided in this section, no antenna or tower may be erected,
constructed, placed, re-erected or replaced in ^ ~°^'~~zoning district of the city except in conformance
with this section.
45.11 Performance Standards. Subdivision 1. These performance standards anpl ty~~v accessojy tower.
antenna or satellite antenna that is erected,, constructed. placed. re-erected or replaced in a_n oni g district in the

Subd. 2 Siggage. No advertising message shall be on the tower or antenna structure.
Subd 3 Screening, Such structures shall be screened to the greatest extent practicable to minimize
visual impacts on surroundine~roperties. Screening_plans shall be approved by the Community Development
Director.
Subd 5. Lighting. Towers and antennas shall not be a ' i ial y lighted unless it is required by Lbe
Federal Aviation Administration or other federal or state authority.
425.137. Variances. The council may grant variances to the literal provisions of this section in the same manner
and subject to the same requirements that apply to variances granted under section 543¢ of the zoning code.

Section 2. The Richfield City Code is amended by adding a new section to read as follows:
426 O1 Purpose Subdivision 1. The purpose of this ordinance is to provide for the safe installation and usaee
of public commercial wireless telecommunication services (CWTS) towers and antennas. The provisions of this
section are intended to protect the health. saferv and general welfare of the community. while providi g for well

Subd. 2. "Com_mercial Wireless Telecom_mv_nication Services" means an_v licensed telecnmmunicarinn
services including cellular. personal com_mLnication services (PCS). specialized mobilized radio ( MR). enhanced
,specialized mobilized radio (ESMR). pag~g_ nd similar ervice hat are marketed to he public.
Subd. 3. "CWTS Antenna" means any structure or device which transmits and receive electrom~etic
waves. including but not limited to directional antennas such as panels. microwave dishes. satellite dishe . nd
om_ni-directional antennas.
Subd. 4. "CWTS Tower" means any p to e. spire.. structure. or combination thereof. including~g
lines. cables. wires. braces. and masts. intended primari y for the purpose of mou_ntine an_ antenna or similar
apparatus above grade. for the p~pose of provide CWTS to the public.
426.05. Location. Subdivision 1. The requirements in this subsection ~ppjv to CWTS towers and rite pas
erected. constructed;=nlaced. re-erected or replaced in the Citv.
Subd. 2. CWTS towers and related eq~pment shall be allowed in_ the following zoni g distri_c_t__s with a_
conditional use ~,rmit:
a) C-2. C-3. MR-3 and I districts:

~) Planned unit development districts as approved in the final development plan.
426.07. CWTS Tower Performance Standards. Subdivision 1. These performance standards apply to ~qY
CWTS tower that is erected. constructed. placed. re-erected or replaced in any z, opine district in the city.
~ Towers in the C-2. C-3. MR-3 and I districts shall meet the setback requirements fnr a_n
accessory structure for the underlying district.

Districts" is amended by amending Section 521.05, Subds. 5, 11 and 13; Section 521.07, Subds. 8, 9
and 10; Section 521.83, Subds. 9 and 10; and Section 521.85, Subds. 6, 7 and 8 to read as follows:
