1986-19Bill No. 1986-19 AMENDMENT TO CHAPTER XI OF THE ORDINANCE CODE OF THE CITY OF RICHFIELD Cit_>~ of Richfield Does Ordain: Chapter XI of the Ordinance Code of the City of Richfield is hereby amended in the following respects: 1. Paragraph (4) of Subdivision I of Section 11.01 is amended to read as follows: "(4) 'Minor' means any person under the age of 19 21 years rime-hae-mot-~tt~=*ef}-t-ire-~c~e--o-i -~ 8--y~rs ex-ems-tie-€o-re-7,t~t•~ ~ ~_,~,~~ _ persons born on or before September 1, 1967 shall be treated as being 2I vears old for the purpose of this section." 2. Paragraph (2) of Subdivision 4 of Section 11.01 is amended to read as follows: "(2) The Liquor Operations Director shall be assisted by such other employees as the council may authorize ; -~oy3gea ;-~`ire=re~L,_-rxj--mi-r~or-~a~-tee at~the~}see-te-be-a~-erng~e~+ee . " 3. Paragraph (3) of Subdivision I of Section 11.02 is amended to read as follows: "(3) 'Minor' means any person under the age of ~9 21 years wipe-?gas-~o±_~tt~~-}ire-~g~-cs~ _I-&_vears e~-°=`-~=~~=~`e""t-'~~ ~-I-,--1-9-i-6. Persons born on or before September 1, 1967 shall be treated as help 21 vears old for the purpose of this section." 4. Subdivision 2 of Section 11.02 is amended to read as fol- lows: "Subd. 2. Limitation on Application. Nothing in this section shall be construed to prohibit or restrict the serving of nonintoxicating malt liquor to guests in a private home, except that it shall be unlawful for a minor pe~ser~-t~r~ee~-the-age e~--?~- .'-'ears to consume any intoxicating or non- intoxicating malt liquor unless in the household of his or her parent or guardian. The council may also permit any nonprofit social organization, lodge, labor organization, political party, church or corporation not included in the definition of bona fide club to serve nonintoxicating malt liquor without a license free of charge, for a period not exceeding 12 hours and not more than three times per calendar year. 'Political party' as used in this subdivision includes city-wide political organizations but does not include individual candidates or the campaign committees of individual candidates." 5. 6. 7. Paragrach (I) of Subdivision 8 of Section 11.02 is amended to read as follows: " { I ) No person under the acre of 18 ears a-ir:er shall be pe_^,;;itted to enter or remain on that part of the licensed premises where nonintoxicating malt liquor is being sold or served, unless accompanied by his parent or guardian." Paragraph (13) of Subdivision 8 of Section 11.02 is amended to read as follows: "(I3) No Denson under the aqe of 18 ears nt~e~ shall be er:p-cyed in any rooms constituting the place in which nonintoxicating malt liquor is sold at retail 'on-sale', except that persons under 18 years of ace ~i:~g~-q may be employed to perzorm the du~~es of a bus boy or dishwashing services in restaurants in which nonintoxicating malt liquor is sold at retail 'on-sale'." Paragraph (14) of Subdivision $ of Section 11.02 is amended to read as follcws: " (I4 ) No person under the ace of 18 years rn3:~e~ shall offer _or sale, sell, or in any way assist in the sale of nonintoxicating malt liquor at retail 'off-sale'; said prohibition shall not extend to activities merely incidental to the sale of nonintoxicating liquors such as stocking beer on shelves or carrying beer from the store customer's re at quest." 8. 9. By adding to Subdivision 1 of Section II.03 the following new paragrap;~ ( 7) °(7) 'Minor' means any person under the aae of 21 years. Persons born on or before September 1, 196 =rail ~e treatea as be~ncr 2I years old for the curcoses of this section." Paragraph (6) of Subdivision I4 of Section 11.03 is amended to read as follows: " (6) No Denson under 18 years of aae xt~r~e~ shall be employed in a room where 'set-up' sales are made and no such person shall be allowed to be or remain in such room unless accompanied by his parent or legal guardian except that persons under I2 `'ears o-` ace :~~=e~s may be employees to perform to cuties c: a bus boy or dishwashing services in rest,ura.^.ts ir: which set-ups are sold. Subd. 3. Inducencr Minor to Enter Saloon. Any persor: who shall assist, procure or induce any minor as that term is defined by statute or other persor. to whom tre sale of liquor is by law forbidder. to enter or visit any saloon, bar, be "~°-~ or other public drinking place for the purpose of obtaining intoxicating liquor or norintoxecatirg malt liquor is guilty of a misde- meanor." I1. Subdivision I of Section 11.05 is amended to read as fol- lows: "Subdivision I. Loeterinc. No person under the age of 21 ;8 years who kas-Ret-attaipee-the-ege-e~ }a_vAa=`°-e:~-e=`-be~ere-:~tzge~st-31--}9;.6 was not born on or .~,efore September 1, 1967, shall loiter in or near any place where liquor or nonintoxicating malt liquor is sold unless accompanied by his parent or legal guardian." 12. 13. Paragraph (1},of Subdivision I6 of Section 11.06 is amended to read as follows: "(1} No licensee, its agent or employee shall serve or dispense upon the licensed premises any intoxicating liquor to a minor, nor shall such licensee or his agent or employee permit a minor to be furnished or consume any such liquors on the Iicer.sed premises, nor shall such licensee or its agent or employee permit a person under 18 years or ace :!ti-see to be present at any part or the licensed premises where intoxicating liquor is sold unless accompanied by his parent or legal guardian." I5. Paragraph (5} of Subdivision 1 of Section 11.08 is amended to read as follows: " (5) `~~iiror' means any person under the age of }9 21 years. Persons born on or before September 1, 1967 shall be treated as being 21 years of acre for the :.ur~ose of this section." 16.
