OF TIDE ORDINANCE CODE OF THE
CITY OF RICHFIELD
CSTY OF RICHFIELD DOES OP.DAIN:
Chapter III, Part IV of the Ordinance Code of Richfield
entitled 'Zoning Regulation" is hereby amended in the following
rsspect:
Section 3.29, subdivision 2 is amended to read as follows:
Subd. 2. Nonconforminff uses. Ary use., building or
structure lawfully existing as of the date Which it was
rendered nonconforming by this part or any previous zoning
ordinance of the city or its corporate predecessory may be
continued even t:*:ou~,h such use, buildin, or structure may
not conform with the provisions of this chapter for t.~:e
district in which it is located, with the following
exceptions and restrictions: _.
(7) No existing building or premises devoted to a use
not permitted by this chapter in-the district in which the
building or premises is located may be enlarged, extended,
recanstructed, substituted or structurally altered, unless
the use thereof is changed to a use permitted in the
district in which it is located, except when required by law
to do so .
(2) No such nonconforming use may be extended to
occupy a greater area of land, or be moved to another part
of the parcel.
{3) A nonconforming structure may be exaanded if the
expansion meets all aoDiicable city ordinance requirements.
{3) {4) A nonconforming use may be extended throughout
an existing building provided non structural alterations.

(4) {7) If such nonconforming use ceases for a period
of two years, any subsequent use shall be i_n conformance
with. the provisions of this chapter.
(5 ) { o ) If any nonconfo rmi_ng use of lands on which
there is no substantial building is discontinued for any
period of tine, any subsequent use of land shall be in
conformity with the provisions of this chapter.
( o ) ( 7 ) Ii at any time a nonce ~,_ _ _ - ~ g building or
structure is damaged by fire, earthquake, wind, water,
explosing, riot, war or an act of God to the extent of more
than 50~ of its then market value at the time of the damage,
then without further action by the council, the said

shall from and after the date of such damage conform to alI

noncorforming single family residential use which existad at
the time of the adoption of this: amena~eni, nay be
reccnstructured if it..is damzged or .destroyed .by _fire; ,

nonconformity is not increased, The determination of the
extent of the damage and the `'air market value of the
building or structure shall be made by the city council

(7) (_ Notwithstanding any ot:~er provisions of this
Code, no junk yard existing as a nonconforming use in a
Residential or Ccmmercial District shall be cantinued unless
in a Commercial District, such junk yard be completely
enclosed within a building or within a continuous solid
fence not less thar. eight (8) feet in height and in any case
of such height as to screen completely all the operations of
such jw~k yard. The plans of suc:~ building or fence shah
have first been approved by the Chief insaector.
(e) (9) Nothing i~ this Cade shall be construed to
prevent t:~e strengthening or restoring to a sale condition
of any part of any building ar structure declared unsafe by
a proper authority.
