1981-24rBILL 1981-24 TRANSITORY ORDINANCE NO. 1685 A TRANSITORY ORDINANCE PROVIDING FOR THE DISPOSITION OF CERTAIN REAL PROPERTY OF THE CITY City of Richfield does Ordain: Section 1. The following property of the city is hereby authorized to be sold and disposed of: Lot 5, Block 1 "FAIRWOOD SHORES" according to the recorded plat thereof, Hennepin County, Minnesota, Said Lot 5 is subject to a perpetual easement for street and utility purposes. Said easement lying northerly of a line parallel and/or concentric with a line 50.00 feet southerly of line A, hereinafter described: Line A Commencing at the northwest corner of the Southwest Quarter of Section 27, Township 28, Range 24, Hennepin County, Minnesota; thence East, assumed bearing, along the north line of said Southwest Quarter a distance of 475.00 feet; thence South 20 degrees 48 minutes 35 seconds West a distance of 6..00 feet to the point of beginning of the line to be described; thence South 88 degrees 51 minutes 44 seconds West a distance of 462.23 feet; thence southwesterly a distance of 226.37 along a tangential curve concave to the southeast having a radius of 572.96 feet and a central angle of 22 degrees 38 minutes 22 seconds; thence South. 66 degrees 13 minutes 30 seconds West tangent to said curve a distance of 133.72 feet; thence westerly a distance of 429.11 feet along a tangential curve concave to the north having a radius of 572.96 feet and a central angle of 42 degrees 54 minutes 40 seconds and said line "A" there terminating. Section 2. The terms and conditions of such sale shall be determined by the City Council. MORTENSON, being duly sworn, on oath says he is and during all times here stated has been the vice president and general manager of the newspaper know as The Richfield Sun and has full knowledg of the facts herein stated as follows: (1) Said newspaper is printed in the English language in newspape format and in column and sheet form equivalent in printed space to at least 900 square inches. (2) Sai~ newspaper is a weekly and is distributed at least once every week. (3) Said newspaper has 50% of it news columns devoted to news of local interest to the community which it purports to serve and does no wholly duplicate any other publication and is not made up entirely of patents, plate matter an advertisement. (4) Said newspaper is circulated in and near the municipalities which it purports t serve, has at least 500 copies regularly delivered to paying subscribers, has an average of at least 75° of its total circulation currently paid or no more than three months in arrears and has entry as second class matter in its local post-office (5) Said newspaper purports to serve the City of Richfield in th County of Hennepin, and it has its known office of issue in the City of Bloomington in said countl established and open during its regular business hours for the gathering of news, sale of advertisement and sale of subscriptions and maintained by the managing officer of said newspaper or persons in i1 employ and subject to his direction and control during all such regular business hours and devote exclusively during such regular business hours and at which said newspaper is printed. (6) Sai newspaper files a copy of each issue immediately with the State Historical Society. (7) Said newspaper is made available at single or subscription prices to any person, corporation, partnership or other unincorporated association requesting the newspaper and making the applicable payment. (I1) Saic newspaper has complied with all foregoing conditions for at least one year preceding the day or dates o: publication mentioned below. (9) Said newspaper has filed with the Secretary of State of Minnesota prior to January 1, 1966 and each January 1 thereafter and affidavit in the form prescribed by the Secretary of State and signed by the managing officer of said newspaper and sworn to before a notary public stating that the newspaper is a legal newspaper.
