City Council of the need for a City Council Worksession to discuss the proposed 2011
Utilities Budget and rates.
City staff will review the Proposed 2011 Utilities Budget and rates at the October 12,
2010 Worksession.
Staff is seeking guidance for the final draft of the 2011 Utilities Budget to be considered
by the City Council at their December 14, 2010 Meeting.

The meeting was called to order by Mayor Goettel at 7:00 p.m.

Council Member Fltzhenry acknowledged the success of the recent Cattail Days event.

Council Member Sandahl announced the October 8 Richfield Chamber of Commerce Gala.
Public Works Director Eastling explained the 76th Street lane reduction plan at Pleasant
Avenue related to the installation of railroad crossing arms this year. He also provided an update
on the Met Council sewer project as it relates to the Middle School area near 75th Street and
Oliver Avenue.
Mayor Goettel acknowledged the efforts of staff in informing the residents and police
monitoring of the MTC buses using 69th Street due to the closing of Penn Avenue at 75th Street.
Mayor Goettel requested Public Safety monitor the 64th Street/Xerxes Avenue area for
pedestrian crossing safety and work with Hennepin County and the City of Edina to possibly install
a stop sign or signal.
Mayor Goettel requested staff review information she received regarding the MAC issuing
an RFP for outdoor advertising concession on Cedar Avenue.

ANIMALS, UNLEASHED DOGS, DAMAGE TO PARK PLANTS AND TREES
AND REGULATIONS ON PUBLIC BODIES OF WATER IN PARKS,
AMENDING SECTION 840 OF RICHFIELD CITY CODE S.R. NO. 179
Council Member Fitzhenry presented Staff Report No. 179.
Mayor Goettel stated that the City Council had received correspondence from the-Twin
Cities Medical Society, Richfield Advisory Board of Health, Bloomington Board of Health, Richfield
Police Department and American Heart Association in support of the ordinance.
Recreation Services Director Topitzhofer provided a summary of the proposed ordinance,
including health impacts, .reduction of litter, and a comprehensive restriction of tobacco use.

Dr. Douglas Hotvedt and Dr. Brian Rank from HealthPartners spoke in support of the
tobacco-free ordinance related to improving health.
Mark Olson, American Heart Association, 6325 Knox Avenue, spoke in support of the
tobacco-free ordinance to promote positive a health message.
Jennifer Turrentine, 6743 Fourth Avenue, Richfield Advisory Board of Health, spoke in
support of the tobacco-free ordinance to promote healthy behavior.
Ken Severson, 7316 Lyndale Avenue, spoke in opposition to the ordinance as it relates to
regulations on public bodies of water in parks because it bans swimming, use of boats, canoes,
etc.
Recreation Services Director Topitzhofer explained the current ordinance prohibits such
use of public bodies of water and the proposed ordinance relaxes the regulations by allowing
portable ice fishing houses on Taft Lake. The Community Services Commission decided to wait
until necessary improvements, like a boat landing, were in place for increased safety.
City Attorney Heine clarified that the ordinance prohibits certain activities except as
authorized.
M/Wroge, S/Sandahl to close the public hearing.
Motion carried 5-0.
Council Member Fitzhenry stated the Fire Department may need to upgrade their equipment
to respond to water-related emergencies.
Council Member Sandahl suggested the Community Services Commission review
authorizing boats, etc. on bodies of water in the parks, including the safety impacts.
M/V1/roge, S/Sandahl that this constitute second reading of Ordinance No. 2010-20 amending
the ordinance relating to conduct within cit r~parks and recreation facilities; prohibiting tobacco use,
sales activity, feeding of wild animals, unleashed dogs, damage to park plants and trees and
regulations on public bodies of water in parks; amending Section 840 of the Richfield City Code;
and that it be published in the official newspaper and be made part of these minutes.

Item #6 CONSIDERATION OF AUTHORIZATION TO ADVERTISE REQUEST FOR
PROPOSAL FOR DESIGN AND CONSTRUCTION OF TIER-ONE SKATEPARK
S.R. NO. 180
Council Member Sandahl presented Staff Report No. 180.
Recreation Services Director Topitzhofer stated the Community Services Commission
preferred the Augsburg Park location for the skatepark. Soil testing and a site survey are needed
and will be included with the RFP recommendation.
Mr. Topitzhofer explained atier-one skatepark is considered like play equipment with no
special lighting and following the same park rules for closing. The City Council is authorizing the
RFP and after review, the best proposal will be presented to the City Council for consideration.
M/Sandahl, S/Goettel to approve the advertising of the request for proposal for design and
construction of a tier-one skatepark.

Council Member Fitzhenry presented S.R. No. 181.
M/Fitzhenry, S/Sandahl to approve the following awards of contracts for the interior signage
and furniture for the new Richfield Municipal Center:
• Takeform Architectural Graphics in the amount of $30,766.10 for interior signage.
• KARNS Services Inc. in the amount of $28,151.32 for Dispatch work stations.
• KI in the amount of $31,970.84 for meeting room tables.
• Innovative Office Solutions in the amount of $89,876.77 for chairs, executive
conference room tables and lobby furniture.
• General Office Products in the amount of $23,013.17 for break room furniture and
children's size furniture.

Item. #8 DISCUSSION OF POLICY ISSUES RELATING TO PROPERTY EXCELLENCE
TASK FORCE RECOMMENDATION TO CITY COUNCIL REGARDING
SCREENING OF GARBAGE CONTAINERS S.R. NO. 182
Council Member Wroge presented Staff Report No. 182.
Bill Kilian, 6620-17th Avenue, and Jay Hermann, 2853 West 71 1/2 Street, Property
Excellence Task Force members, spoke in support of screening garbage containers and believed
there were reasonable alternatives if cost is an issue to the resident.
Council Member Wroge stated the intention is to improve the look of the City.
Public Safety Director Fritz asked for clarification on the acceptable standards for the
percentage of visibility from the street and the citing of aesthetics as the reason for the code
change.
City Attorney Heine stated she needed to review the aesthetic issue but that she was not too
concerned.
The City Council consensus was to proceed with the ordinance and include an enactment
date of July 1, 2011, abatement of 30 days, lattice work as an acceptable screening and
communication to the public should include screening options.

Item #1 DISCUSSION REGARDING 2011 PROPOSED BUDGET AND TAX LEVY
Mayor Goettel requested an explanation regarding the proposed financial plan if no Local
Government Aid is received in 2011.
City Manager Devich discussed options that could be presented to the City Council;
including potential service and staff reductions, spending cash on hand, capital expenditures and
on-going- operations costs.
Mayor Goettel suggested the creative budget management that is taking place to reduce
costs be' communicated to the public.
Public Works Director Eastling discussed the street maintenance program.
Council Member Wroge suggested the City Council discuss establishing a bond or permit
process required by property owners of vacant property, similar to the City of Minneapolis.

Council Member Sandahl questioned if funding was in the budget for City Council
attendance at out of state conferences, i.e., National League of Cities. She encouraged Council
Members to attend because of the importance of networking and learning about other cities.
City Manager Devich responded that funds for travel are budgeted but reduced.
Council Member Sandahl discussed budgeting for the renaming of 76th Street for better
identification.
Public Works Director Eastling provided an update on MnDOT's regional re-prioritization of
projects, including the 77th Street underpass.
Council Member Fitzhenry requested an update on the Fire Department delivery services
models.
Fire Services Director Sveum discussed the first responder reimbursement revenue source
authorized by the joint powers agreement with the State and the residency response time
legislation.
City Manager Devich discussed the recent grant received to hire two Firefighters for two
years which reduces overtime costs and provides time to review the models. ;Discussion by the
City Council will still need to take place regarding fire services"delivery.
Mayor Goettel requested the future budget include a curbside cleanup and residential
garbage pickup. options.
Council Member Wroge requested the City Manager discuss the financial reserves.
City Manager Devich explained the City's level of financial reserves and that governmental
accounting requires segregation of some funds. He discussed the General Fund, Enterprise
Funds, Special Revenue Fund, Internal Services Fund and Debt Service Fund.
Finance Manager Regis discussed the City's financial investment portfolio.

II. BACKGROUND
Appendix D to the Richfield City Code consists of the schedule of fees adopted by
the City Council, including those adopted by resolution and those adopted by
ordinance.
On an annual basis, as part of the budget process, departments are asked to review
the schedule of fees that apply to their department. The departments review their
fees for services and compare the fees charged with the costs incurred in providing
that service. If it is found that costs exceed the fee charged, the respective
.departments-will adjust their fees accordingly.
The proposed resolution includes fees for rental licensing and point of sale
inspections that are established by resolution. Fees established by ordinance will
be considered by the Council as a separate item.

These proposed changes to rental licensing fees include an increase of $10.00 for
single-family homes and for the first unit in duplex and multi-family complexes as
well as an increase of $5 for the second unit in duplex properties. Overall, this
recommended action represents a 2.6% increase in rental licensing fees.
A $5.00 increase in the Point-of-Sale (aka Certificate of Housing Maintenance
Compliance) fee is also being recommended. This represents a 3.5% increase for
single-family homes.
The proposed changes are indicted by bold text on page 11 of the attached fee
schedule. These proposed increases are recommended in order to ensure that
they are adequate to cover the costs of administering the rental licensing and point-
of-sale inspection programs.

• The City is required to establish fees that appropriately reflect the
City's costs of administering the permit or application .for which the fee
is charged.

Consideration of a resolution regarding an agreement between the Minnesota Department of
Public Safety and the City of Richfield, Public Safety Department, pertaining to the Safe and
Sober Enforcement Program.
I. RECOMMENDED ACTION:
By Motion: Approve. the attached resolution allowing an agreement
between the Richfield Public Safety Departmen# and the Minnesota
Department of Public Safety, authorizing the acceptance of grant
funds to be used for the payment of overtime for police officers
involved in the Safe and Sober Program.
II. BACKGROUND
• Edina, Airport and the Richfield Police Departments submitted a joint grant
application to the State of Minnesota for funds that are to be utilized for
enhanced traffic enforcement during the upcoming year. These departments
have been jointly awarded 55,000.00 dollars and plan on scheduling joint traffic
enforcement campaigns.

A. POLICY ,
• The State of Minnesota requires that the City approve a resolution
accepting the funds prior to their issuance.
B. CRITICAL TIMING ISSUES
• .The Resolution needs to be signed by all three agencies' City
Councils before the release of funds to the police departments.
• Traffic law enforcement is a critical function of the police division.
Approval of the resolution makes available funds to cover the costs
associated with focusing on this area of law enforcement.

• The overtime paid to officers will come from the Grant Fund.

WHEREAS, the Governor has designated the State of Minnesota, Office of Traffic
Safety in the Minnesota Department of Public Safety (hereinafter called the STATE) as the
agency responsible for administration of a project entitled Safe a& Sober communities; and
WHEREAS, the STATE is authorized to make contracts from state funds to
qualified applicants; and
WHEREAS, the City of Richfield, Public Safety/Police (herein after called the
GRANTEE) is authorized to accept state funds for overtime for traffic enforcement
programs; and
WHEREAS, GRANTEE represents that it is duly qualified and will carry out the
tasks described above.
NOW, THEREFORE, BE IT RESOLVED that the City of Richfield enter into a
cooperative agreement with the Office of Traffic Safety in the State of Minnesota
Department of Public Safety for the project entitled Safe & Sober Communities. Steven
Devich, City Manager, and Barry Fritz, Public Safety Director, are hereby authorized to
execute such agreements as are necessary to implement the project on behalf of the City
of Richfield, Department of Public Safety.

I. RECOMMENDED ACTION:
By Motion: Approve the reappointment of the firm Malloy, Montague,
Karnowski, Radosevich & Co., P.A. (MMKR) as the City's auditor for
the financial reporting fiscal years 2010-2012, and to authorize the
City Manager and the Mayor to execute an agreement for such
services.
II. BACKGROUND
For the last three years the City of Richfield has used the auditing firm of MMKR to
perform the annual City and HRA audit. The engagement of that firm was the result
of a selection process performed in the fall of 2007.
MMKR is a leader in the metro area in auditing municipalities. Many of their clients
consistently receive the Government Finance Officer Associations Certificate of
Achievement in Financial Reporting.
The City has received a proposal from MMKR for audit services for the fiscal years
ending 2010-2012. They have proposed to freeze. their fee for that three year period
at the fiscal year 2009 fee ~of $42,225.
1012Audit Firm Reappointment
City staff has developed a solid working relationship with MMKR and consequently
recommend their reappointment for the audit of fiscal years ending 2010-2012.
III. BASIS OF RECOMMENDATION
A. POLICY
• It is most important to note that the selection of an auditing firm is
exclusively within the purview of the City Council. The function of any.
auditor is to audit work performed by staff and report directly to the
City Council with the results.
• .The agreement with MMKR will be for a three year period, fiscal years
ending 2010, 2011, and 2012. The agreement will be subject to the
annual review and recommendation of the Finance Manager,
satisfactory negotiation of terms and the concurrence of the City
Council
B. CRITICAL TIMING ISSUES
• It is critical to select an audit firm now as firms are in the process of
setting their schedules for the upcoming audit period.
C. FINANCIAL
• The price submitted by MMKR for the fiscal years ending 2010-2012
will be $42,225. MMKR has proposed to freeze their fees for the next
three years at the 2009 level.
• MMKR is a leader in auditing municipalities in the Twin Cities' area
and audits numerous municipalities that consistently receive the
GFOA Certificate of Achievement.
MMKR can also provide the City-with considerable finance and
accounting expertise in addition to their standard audit services.

• The fund was created to account for private donations restricted by donors to
certain programs or to be used for general community center programs.
• It has been determined that the Community Center Contribution Fund can be
consolidated into the Recreation Contribution Fund and still achieve the
purpose of the original fund.
• The 2010 Revised and 2011 Proposed budgets were prepared with the closing
of the Community Center Contribution Fund into the Recreation Contribution
Fund.

A. POLICY
• The City's financial policies do not directly address the closing out of
accounting funds.

Public hearing regarding the special assessment roll for weed elimination from private property

RECOMMENDED ACTION:
Conduct and close the public hearing and by motion: Approve the
attached resolution adopting the assessment for weed elimination
from private property and removal or elimination of public health or
safety hazards from arivate nronerty.
II. BACKGROUND
• The special assessment for elimination of public health or safety hazards from
private properties is for costs incurred by the City in connection with abatement
of these hazards on certain properties in the City, which are not properly
maintained.
• The owners of the subject properties are notified by the City to correct the public
health or safety hazards and have failed to do so within the proper timeframe.
• The property owners were notified that if the public health or safety hazards
were not abated within the proper time limit, the City would take the corrective
action necessary and bill the property owner.
• Finally, each year the City utilizes City Public Works staff to cut weeds on certain
properties in the City not maintained by the owners. If the owner fails to cut the
weeds in a timely manner after notification by the City, the City undertakes the
weed destruction and bills the property owner for the service.
• In all cases, property owners will be notified that any unpaid charges of fees may
be assessed against the property.

A. POLICY
• The nuisance properties were not maintained by the owners and the
City incurred costs to abate the nuisance.
• Minnesota State Statutes provide that the City may levy a special one-
yearassessment for these costs.
• Notice of the certification was published in the Sun Current September
23, 2010.
B. CRITICAL TIMING ISSUES

C. FINANCIAL
• The proposed special assessment for the elimination of public health
or safety hazards from private property is $5,878.19 with an additional
6% interest penalty.
• The proposed special assessment for weed elimination from private
property is $9,070.00 with an additional 6% interest penalty.
• Costs incurred for city staff time in the clean up of the properties or to
remove the weeds are included in the special assessment amount.
• A $50.00 administrative fee is, charged to all properties.
• The affected property owner may prepay the original principal amount
without interest within 30 days from the date the Council adopts the
assessment. If the original principal amount is not paid, the
assessment will be charged 6% interest.

• No legal issues are apparent at this time. The City Attorney will be in
attendance at the Council meeting should a legal question arise.

1. Such proposed assessment roll,. in the amount of $14,948.19, is hereby accepted and
shall constitute the special assessment against the lands named herein, and each tract

• Alarm users fees must be paid to the City within 30 days from the date of written
notice by the City to the alarm user. Fees not paid within the time specified will

is to recover costs incurred by the City in connection with the response by public
safety to an alarm call on certain properties in the City that turns out to be false.
Properties are allowed two false alarm calls before any billing will take place.
III. BASIS OF RECOMMENDATION
A. POLICY
• Richfield City Code section 915.07 Subd. 3 and chapter 8.02 of the
City Charter allows the City to specially assess delinquent false alarm
user fees against the respective properties.
• Minnesota State Statutes provide that the City may levy a special one-
yearassessment for these costs.

pertains to a fee schedule for variance and variance appeal
applications.
II. BACKGROUND
Appendix D to the Richfield City Code consists of the schedule of fees adopted by
the City Council, including those adopted by resolution and those adopted by
ordinance.
On an annual basis, as part of the budget process, departments are asked to review
the schedule of fees that apply to their department. The departments review their
fees for services and compare the fees charged with the costs incurred in providing

that service. If it is found that costs exceed the fee charged, the respective
departments will adjust their fees accordingly.
The proposed ordinance includes all fees that are required to be established by
ordinance. Other fees, including rental licensing fees, are established via resolution
(as opposed to ordinance). Revisions to these fees require only one hearing and
are to be discussed as a separate matter, with a separate staff report.
Only one change to fees governed by ordinance is being proposed by Community
Development staff; an increased processing fee for variances. It is anticipated that
additional legal review will be required when processing variances due to a recent
ruling by the Minnesota Supreme Court. This ruling makes it more difficult to obtain
a variance based on a new interpretation of the "undue hardship" requirement. The
increase in the variance fee is equivalent to one hour of the City Attorney's time.
Other Planning and Zoning fees are not increasing at this time because the staff
and other administrative costs associated with providing the fee-based services and
programs are not anticipated to increase. Increases in fees related to building
permits are also not proposed because the fees collected for such programs have
met program costs for the past fifteen years.
III. BASIS OF RECOMMENDATION
A. POLICY
• Minnesota Statutes, Section 462.353 requires that certain fees be
established by ordinance.
• The City attempts to establish fees that appropriately reflect the City's
costs of administering the permit or application for which the fee is
charged.
• Section 3.12 of the Richfield City Charter allows the City Council to
authorize by unanimous vote summary publication of an ordinance
when the summary clearly informs the public of the intent and effect of
the ordinance.

Section 1. Background
1.01 Appendix D to the Richfield City Code consists of the schedule of fees

1.02 Minnesota Statutes, Section 462.353 requires that certain fees be adopted
by ordinance. The City Council has previously established certain fees by
Transitory Ordinance No. The City Council has established other
fees by resolution, which resolution is also part of Appendix D.
1.03 The City Council has determined the need to update the schedule of fees
under Transitory Ordinance No.
Section 2. Fee Schedule Adopted
2.01 The fees set forth in the attached Exhibit A are hereby adopted by
ordinance.
2.02 The fees adopted at Section 2.01 of this Ordinance shall be amended only
by ordinance. Any fees established by resolution, other than those
adopted at Section 2.01 of this Ordinance, may be amended from time to
time by resolution of the City Council.
Section 3. Effective date; codification.
3.01 This ordinance is effective as of January 1, 2011.
3.02 A copy of this ordinance shall be included in Appendix D to the Richfield
City Code, immediately prior to the resolution establishing fees.
3.03 This ordinance supersedes Transitory Ordinance No. to the extent
that Transitory Ordinance No. is inconsistent with this ordinance.

A. Investigation Fees: Work without a Permit:
Investigation. Whenever any work for which a permit is required by this code has been
commenced without first obtaining said. permit, a special investigation shall be made before a
permit may be issued for such work.
Fee. An investigation fee, in addition to the permit fee, shall be collected whether or not a
permit is then or subsequently issued. The investigation fee shall be equal to the amount of the
permit fee required by this code. The minimum investigation fee shall be the same as the

City's advisory commissions.
II. BACKGROUND ~
The City Council conducted their annual recruitment for advisory commission
members near the end of 2009 to fill expiring or vacant terms. Several
appointments were made in January 2010 but vacancies remained to be filled.
There are staggered term length vacancies remaining on the Advisory Board of
Health, Arts Commission, Civil Service Commission, Community Services
Commission, Friendship City Commission and Human Rights Commission. The
Planning Commission and Transportation Commission do not have vacancies at
this time.
The Human Rights Commission and Friendship City Commission have youth term
vacancies.
Advertisements were placed in the Richfield Sun and the City's Website. Notices
were also sent to Richfield High School, Academy of Holy Angels and local
churches regarding the youth vacancies.
Terms are effective upon appointment.
Applicants were interviewed at a Special City Council meeting on October 12, 2010.

Subject: Council Direction for Winter Maintenance of Multi-Use Path
(Worksession Agenda Item No. 13)
Council Members:
As part of the October 12, 2010 City Manager's Report, the Council will be asked to
provide direction to staff on how to proceed with winter care of the newly constructed
blacktop path adjacent to 75th Street, Humboldt Avenue and Diagonal Boulevard.
The paths along 75th Street and Humboldt Avenue will become the property of the
Three Rivers Park District upon the completion of the project and execution of a non-
exclusive, permanent easement across the right-of-way. Three Rivers Park District
paths are not plowed by District staff in the winter.
City staff is proposing to plow the new paths starting this winter at the same priority as
other neighborhood sidewalks, that is, after sidewalks on arterial and collector streets
are plowed. The additional plowing would add less than 2 hours of labor and equipment
for each snow event.
Staff will be seeking City Council policy direction in this matter.
