RESOLUTION TERMINATING CONDITIONAL USE PERMIT
APPROVED BY RESOLUTION NO. 8638
WHEREAS, a conditional use permit for a single family residence at the
Property, as hereinafter defined, was approved by Resolution No. 8638 on November 9,
1998, and recorded on October 27, 1999 as Document No. 3219177 with the Registrar
of Titles, Hennepin County, Minnesota (hereinafter referred to as the "Conditional Use
Permit");
WHEREAS, the property to which the Conditional Use Permit affects is legally
described as Lot 18, Block 1, Auditor's Subdivision Number 340, Hennepin County,
Minnesota (the "Property");
WHEREAS, the Property is currently owned by the City of Richfield ("City");
WHEREAS, Resolution No. 8638 provided that the Conditional Use Permit shall
remain in effect for so long as conditions regulating it are observed, and the Conditional
Use Permit shall expire if normal operation of the use has been discontinued for 12 or
more months, as required by the Zoning Ordinance, Section 546.05, Subd. 9;
WHEREAS, the City would like the Conditional Use Permit terminated on the
basis that the Conditional Use Permit is no longer required, that the City has no
intention of using the Property as a single family residence, that the home located on
the Property was removed on or about November 15, 2007, and that the Conditional
Use Permit constitutes a potential impairment to title.
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Richfield, Minnesota, as follows:
The Conditional Use Permit is terminated and the Property is hereby
irrevocably released from the terms of the Conditional Use Permit.
2. The City shall record this document with the Hennepin County Registrar of
Titles.
Adopted by the City Council of the City of Richfield, Minnesota this 13th day of
October, 2009.
