10-11-2022 Resolution No. 12015RESOLUTION NO. 12015 RESOLUTION GRANTING APPROVAL OF BOTH A PRELIMINARY AND FINAL PLAT FOR RICHLYN RILEY WHEREAS, North Bay Companies (“Applicant”) has requested approval of both a preliminary plat and a final plat that subdivides land generally located at 600 - 64th Street West, legally described as Lot 1, Block 1, Henley Two; and WHEREAS, the proposed subdivision is to be known as RICHLYN RILEY; and WHEREAS, a public hearing was held on the proposed preliminary plat of RICHLYN RILEY on Monday, September 26, 2022 at which all interested persons were given the opportunity to be heard; and NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, as follows: 1. The proposed plat of RICHLYN RILEY satisfies the requirements of the City’s subdivision ordinances. 2. Approval of both the preliminary plat and the final plat of RICHLYN RILEY is granted subject to the following conditions: a. Prior to the City sign-off on the final plat, the applicant must address to the City Attorney’s satisfaction all items listed in the plat opinion letter prepared by the City Attorney’s office, dated August 23, 2022. b. The applicant shall dedicate a separate 15-foot wide sidewalk easement over the trail to the park along the east side of the property. c. The as-built drawings must be approved by the City Engineer prior to City sign-off on the final plat. d. The final, executed copy of the construction maintenance agreement must be recorded with the Hennepin County Recorder’s Office. Proof of such shall be submitted to the City prior to City sign-off on the final plat. 3. The Applicant must submit two mylar copies of the plat for signature by the City. 4. The Applicant must file the final plat with the Hennepin County Recorder or Registrar of Titles within two years of the approval of this resolution, along with: a. the declaration of easements, b. a copy of this approved resolution, c. the sidewalk easement dedication document, and d. the certificate of completion of vacation proceedings.
