07-12-2022 Resolution No. 11987Resolution No. 11987 1 RESOLUTION NO. 11987 RESOLUTION AUTHORIZING CONVEYANCE OF PROPERTY TO THE HOUSING AND REDEVELOPMENT AUTHORITY IN AND FOR THE CITY OF RICHFIELD, MINNESOTA WHEREAS, the Housing and Redevelopment Authority in and for the City of Richfield, Minnesota (the “Authority”), was created pursuant to Minnesota Statutes, Sections 469.001 through 469.047, as amended (the “HRA Act”), and was authorized to transact business and exercise its powers by a resolution of the City Council of the City of Richfield, Minnesota (the “City”) for the purpose of promoting economic development and redevelopment opportunities within the City; and WHEREAS, pursuant to the HRA Act, the Authority is authorized to acquire real property or interests therein and to undertake certain activities to facilitate the development or redevelopment of real property by private enterprise; and WHEREAS, the City currently owns certain property in the City (the “Property”), which is legally described as: That part of the North 180.26 feet of the South Half of the Southeast Quarter of the Southeast Quarter of Section 35, Township 28, Range 24, lying East of the West 722 feet thereof; Except that portion thereof contained in the following described tract: Beginning at a point in the East line of said Section 35, distant 383 feet North of the Southeast corner of said Section 35; thence West parallel with the South line of said Section 35 distant 158 feet; thence North parallel with the East line of said Section 35 distant 150 feet; thence East parallel with the South line of said Section 35 distant 158 feet; thence South along the East line of said Section 35 distant 150 feet to the point of beginning . PID No.: 35-028-24-44-0006 Torrens Certificate No. 1058854 WHEREAS, pursuant to Minn. Stat. Section 465.035, the City is authorized to convey real property to another governmental entity for a nominal consideration and pursuant to Minn. Stat. Section 471.64, the City may convey real property without regard to statutory or charter provisions when conveying real property to another governmental entity; and WHEREAS, the Authority has agreed to redevelop the Property; and WHEREAS, the City finds and determines that the conveyance of the Property to the Authority is for a public purpose and is in the public interest of the City. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield that: 1. The City Council approves the conveyance of the Property to the Authority by quit claim deed for a price of $1.00. The City Council authorizes and directs the Mayor and the City Administrator to execute the quit claim deed and any other documents deemed necessary to carry out the intentions of this resolution.
