78-5858R,, .~ RESOLUTION N0. 5858 RESOLUTION AUTHORIZING ACQUISITION OF CERTAIN REAL PROPERTY BY EMINENT DOMAIN PROCEEDINGS (Hub Property - Adjacent to Nicollet Avenue) WHEREAS, the City of Richfield, Minnesota, has undertaken a program of public improvements on and adjacent to Nicollet Avenue between 65th and 66th streets; and WHEREAS, such public improvements include improvements to or con- struction of streets, sidewalks, landscaped areas, bus stops, pedestrian and crosswalk areas and other public amenities; and WHEREAS, in order to construct such improvements, the City~Council finds it necessary, proper and expedient in the interest of the public health, convenience and general welfare of the citizens of the City of Richfield, for the City to acquire the easement hereinafter described for the public purposes hereinafter set forth; and WHEREAS, in order to expedite the making of such improvements it is necessary and in the public interest that title to and possession of such property be acquired before the filing of an award by court appointed commissioners, NOW THEREFORE, be it resolved by the City Council of the City of Richfield, Minnesota: The City Manager, City Attorney and other appropriate officals are hereby authorized and directed to commence and prosecute eminent domain proceedings to acquire a perpetual easement over, under, upon and across that part of Block 2, Richfield Plaza, lying easterly of the following described line: 128 129 iT K ,, Resolution No. 5858 - 2- r Beginning at a point on the south line of said Block 2, distant 20.00 feet westerly from the southeast corner thereof; thence northerly 200.00 feet!Iparallel with the east line of said Lot 2; thence northwestgrly deflecting. to the left 45 degrees 00 minutes, a distance of 83.5 feet; thence north- easterly deflecting to the right 90 degrees 00 minutes, a distance of 90.57 feet to a line 15.00 feet west of and parallel with the east line of said Lot 2; thence northerly along said parallel line to the north line of said Lot 2 and there terminating. ', Such easement shall be for street; sidewalk, landscaping, bus stop, pedestrian and crosswalk areas and related public amenities. In the prosecution of such proceedings, such officials are authorized and directed to take such actions as are necessary to acquire title and possession to such easement at the earliest date that this may be accomplished under applicable law.
