RESOLUTION APPROVING LAYOUT AND CONTRACT FOR
'~ OFF-STREET PARKING IN ACCORDANCE WITH APPLICATION
', NO. 80-3, CONTRACT NO. 2322

BE IT RESOLVED by the City Council of .the City of Richfield,
Minnesota, as follows:
l~. That the proposed geometric layout of the off-street park-
ing as contained in Off-Street Parking Application No. 80-3,
Contract No. 2322, is hereby approved subject to and upon
completion of performance of the contract for such off-street
parking as hereinafter authorized.
2. That the proposed off-street parking contract for the
improvement of said off-street parking, bearing Contract No. 2322
be placed on file and that the manager be authorized to sign said
contract and the clerk be authorized to seal the same for and
on behalf of this City.
3. That the off-street parking operator provide the City of
Richfield with Surety in the form of cash, passbook saving with-
drawal authority, or performance bond in an amount to be
determined by the community development director and city manager,
to ensure the off-street parking lot is constructed within the
terms and regulations of the Off-Street Parking Agreement with
the following stipulations: _
1. That. parking lot design be altered to facilitate 20 off-
street parking spaces.
2. That the applicant construct a solid fence on the east
property line to buffer the adjacent property from lights
and noise.
3. That the applicant is informed that the special use permit
is for the restaurant now being proposed, and that for
any expansion in the future a special use permit will be
necessary, and if seating is to be proposed at a future
date, the off-street parking requirement may change.
4. That responsibility for the proper upkeep and maintenance
of said off-street parking lot shall remain the responsibility of
the off-street parking lot operator in accordance with Ordinance
Code 4.Q5. .
