81-6417Rvi RESOLUTION N0. 6417 RESOLUTION `REGARDING COUNCIL AGENDA;->FORMAT ~tiiHEREAS, Section 2.03, 2'.05 and 2.07 of the Richfield City .Code establish the type of busine s and the general means by which such: business shall. be conducted, of the city council, and WHEREAS, Section 2.03 provides that the order of business shall be determined by reso ution of the city council. NOW, THEREFORE, BE IT RESOLVED by the, City Council of the City of Richfield that the following order of business shall be determined for conduct of city council meetings: 1. Approval of Minutes of Previous Meeting 2. Presentations ' 3. Public Appearances 4. Approval of Agenda 5. Public Hearings, Including Ordinance-Hearings 6. Proposed Ordinances 7.~ Public Improvements 8. Resolutions 9. Administrative Reports and Other Business ~` 10. Consent Calendar BE IT FURTHER RESOLVED that. the council agenda for each meeting will be established as follows: A. The city manager shall prepare an agenda for each regular meeting. The agenda shall include the items set forth above. B. The agenda for any regular meeting shall be compiled and .completed by 4:30 p.m. on the Wednesday preceeding a meeting. .Matters of an emergency nature not on the agenda may be -- consdered by the council only upon a unanimous vote of the Council Members present. Matters that need to be added. to the agenda shall be added when approval of the agenda is considered as outlined above, as requested by the City Council or City Manager and unanimous concurrence of the Council Members. BE IT FURTHER RESOLVED that the following conditions shall be established for the business item related to Public Appearances: A. The period from th.e time at which the meeting is called to order, and at least 15 minutes of the meeting schedule, shall be reserved for members of the general public wishing to appear and make comment before the city council. If no such individuals appear during that period, or if all indiv- iduals wishing to make such appearances have completed their comments before the 15-minute period is concluded, the city council may move on to the next item of business.` f~ B. Persons. wishing. to appear before the city; council shall state their name, address, and business clearly and succinctly, and no individual, or group of individuals representing-a single concern, interest, or issue, shall speak.. before the city council for. a period to exceed three minutes unless given exemption by the city council... C. The city council recognizes that any such items introduced during such a publicappearance period shall be of an informa- tional nature, and need not be regarded as items needing action at the meeting at which they are: introduced. Each appearance making. inquiry into matters of city practice may be answered immediately or at a subsequent city council meeting after study and review by the city staff and city council. BE IT FURTHER RESOLVED that the fallowing conditions shall be.estab- lished for the business item 'related to the Consent Calendar: A. In the preparation of the agenda for a council meeting, the city manager may place certain .items of business on a Consent Calendar. Matters proposed by tha city manager for the Consent Calendar shall be those which he/she deems to be of a routine, non-controversial 'nature. Any member of the city council wishing to remove any item from the Consent Calendar may do so when approval of the agenda is considered as out- lined above,. but must do so prior to a motion approving the Consent Calendar. B. Any item removed from the Consent Calendar shall become one of the. regular agenda items of the meeting and shall betaken up immediately after the Consent Calendar. All items not so removed from the Consent Calendar may be passed by a single, non-debatable motion'. BE IT FURTHER RESOLVED that the procedure hereinafter set forth shall be applicable to .the adjournment of the regular meetings of the City. Council: I 1. It is the policy of the City Council to adjourn such meetings of the City Council at 11:00 p.m. or as soon thereafter as adjournment may be appropriate in the circumstances; 2. At any such meeting of the city. council, any member of the council may, on or after 10:30. p.m., give notice that in one- half hour, the. hour ',of 11:00 p.m., will be reached or shall have passed, as the ',case may be, and that he/shee is invoking the provisions of this resolution. and. is calling for adjourn- ment of the meeting at the expiration. of such half-hour period. When such notice has'' been given, the presiding officer shall forwith adjourn the~';meeting when the half-hour period has expired unless,. befolre that time, all of the other Council rlembers present vote', to continue with the meeting. i 3. A motion to continue) in session or a motion to adjourn until a fixed date and. time shall take precedence over action to -' adjourn... 3_ 4. The provisions of this resolution shall not affect the ' ` validity of any action taken by the City Council at any meeting extending past the_hour of 1`1:00 o'clock p.m. BE IT FURTHER RESOL~IED that the following conditions shall be considered in the RULES OF .ORDER: A: 2.07 Subdivision 1. Presiding Officer. The Mayor, or in his/her absence the President Pro Tempore, shall preside at Council meetings ,.preserve order and decorum, and decide questions of order. The Mayor's duties under this subdivision shall be in addition to his/her duties, rights and privileges as a Council Member.. B. 2.07 Subdivision 2. S ecial Rules. The following. special .rules shall be applied:. (1) A member may be excused from 'voting on a matter duly before the. council only with unanimous consent of the other council members present. . (2) A motion before the Council shall be reduced to writing " by the Clerk at the request of any Council member.. C. 2.07 Subdivision 3. General Rules. In all other matters of parliamentary procedure, the Council shall be governed by the latest printed edition of "Robert's Rules of Order." ~ D. 2:07 Subdivision 4. Suspension of Rules. The operation and effect of any rule established or followed pursuant tt~, this section may be suspended upon. the unanimous vote of the Council.
