12-20 HRA Resolution No. 1415 HRA RESOLUTION NO. 1415 RESOLUTION DESIGNATING BUILDINGS ASSTRUCTURALLY SUBSTANDARD WITHIN THE RICHFIELD REDEVELOPMENT PROJECT WHEREAS, the Housing and Redevelopment Authority in and for the City of Richfield,Minnesota(thewascreatedpursuanttoMinnesotaStatutes, Sections469.001through469.047,asamended,andwasauthorizedtotransact businessandexerciseits powersbyaresolutionoftheCityCounciloftheCityof Richfield, Minnesota (the and WHEREAS, under Minnesota Statutes, Section 469.174, subdivision 10(d), the Authority isauthorizedto deem parcels as occupied by structurally substandard buildings before the demolition or removal of the buildings, subject to certain terms and conditions as described in this resolution; and WHEREAS, the Authority intends to cause demolition of the buildings located on the mayin thefutureincludetheDesignatedPropertyin aredevelopmenttaxincrement financingdistrictasdefinedinMinnesotaStatutes,Sections469.174,subdivision10, within the Richfield Redevelopment Project; and NOW, THEREFORE, BE IT RESOLVED, by the Board of Commissioners of the HousingandRedevelopmentAuthorityinandfortheCityofRichfield,Minnesotaas follows: 1. TheAuthorityfindsthatthebuildingsontheDesignatedPropertyare structurally substandard to a degree requiring substantial renovation or clearance, based upon the analysis ofsuch buildings by LHB, Inc., dated November 30, 2018 and on file in CityHall. Inaddition,the buildingslocatedat6501and 6513 Penn Avenue Southhave been declared unsafe buildings bythe Chief Building Official pursuant to Minn. Stat. Rule1300-0180forunsafeelectricalwiringandunsafefence/guardrailattheupper parking lot. 6513 Penn Avenue South is also structurallyunsafe because of deteriorated concretemasonry bearing walls and water damage to the precastconcrete ceiling.. 2. Afterthedateofapprovalofthisresolution,thebuildingsonthe DesignatedPropertymaybedemolishedorremovedbytheAuthority,orsuch demolitionorremovalmaybe financedbytheAuthority,ormaybeundertakenbya developer under a development agreementwith the Authority. 3. TheAuthorityintendstoincludetheDesignatedPropertyin a redevelopmenttaxincrementfinancingdistrict,andtofiletherequestforcertificationof suchdistrictwiththeTaxpayerServicesDivisionManagerofHennepinCounty, date of demolition of the buildings on the Designated Property. HRA 1411 4.Upon filing the request for certification of the new tax increment financing district, the Authority will notify the County Auditor that the original tax capacity of the Designated Property must be adjusted to reflect the greater of (a) the current net tax capacity of the parcel, or (b) the estimated market value of the parcel for the year in which the buildings were demolished or removed, but applying class rates for the current year, all in accordance with Minnesota Statutes, Section 469.174, subdivision 10(d). 5.Authority staff and consultants are authorized to take any actions necessary to carry out the intent of this resolution.
