84-6931R65 RESOLUTION N0. 6931 RESOLUTION ADOPTING ASSESSMENT ON CITY PROJECT N0. 782, 1983 ,SIDEWALK IMPROVEMENTS WHEREAS, pursuant to proper notice duly given as required by law, the city council has met and heard and passed upon all objections to the proposed assessment for the improvement of the following locations by construction. of concrete sidewalk: ON SIDE FROM TO Lyndale Avenue West 74th Street 76th Street 65th Street North ~ Pen r. Avenue Russe ll Avenue 65th Street South Uptor_ Avenue Xerxe s Avenue Xerxes Avenue East 62nd Street 65th Street Rae Drive West 65th Street 66th Street Vincent Avenue East 65th Street 350' south 78th Street North 12th Avenue 250' west 78th Street North 12th Avenue 13th Avenue 78th Street North 14th Avenue Cedar Avenue Bloomington Ave. East 75th Street 76th Street 77th Street South Nicol let Avenue 130' west 76th Street South Xerxe s Aver_ue Sheri dan Ave. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield, Hennepin County, Minnesota, as follows: 1. That the city clerk has, with the assistance of the city engineer, calculated the proper amounts to be assessed for City Project No. 782, 1883 Sidewalk Improvements against every assessable lot, piece, or parcel of land specially benefited thereby in accordance with the provisions of law, and the proposed assessment so made up was filed with the city clerk for more than. 15 days prior to the assessment hearing and was open to public ir_spection during said period. 2. That the city council has heretofore duly established City Project No. 782 and after carefully considering all the facts, the benefits to each lot, piece or parcel of land and fully advising itself ir. the premises, has found and determined ar.d hereby declares that each and every lot, piece or parcel of land included in said proposed assessment roll was improved by reason of the construction. of said City Project No. 782 ar.d has beer. ar.d is specially benefited in the amount set out in the attached assessment roll opposite each such lot, piece or parcel of land. 3. The owner of ar.y property so assessed may, at ar.y time prior to certification of the assessment to the county auditor, pay whole of the assessment or. such property to the city treasurer and he may, at any time thereafter, pay to the city treasurer the entire amount of the assessment remaining unpaid, with interest accrued to December 31 of the year in which payment is made. Such payment must be-made before November 15 or interest will be charged through December 31 of the succeeding year . -2- 4. Said assessment is hereby affirmed, adopted, confirmed, and shall be certified by the city clerk and filed ir. the office of the city clerk, and shall thereupon be ar.d constitute a special assessment for said City Project No. 7$2 Sidewalk Improvements. 5. The assessment with accruing interest, shall be a lien upon the property included therein., concurrent with general taxes and shall be payable in equal installments extending over a period of five years unless prepaid or deferred. The first ir.stallmer.t shall be payable or. the first Monday in January of 1985• All assessments shall bear interest at a rate at ten (10) percent per anr_um. 6. The city clerk shall forthwith transmit a certified duplicate of this assessment roll to the county auditor to be extended on the proper tax lists of 'the county and such assessments and interest thereon shall be collected and paid over in the same manner as other municipal taxes.
