84-6902RRESOLUTION N0. 6902 RESOLUTION ORDERING IMPROVEMENT, APPROVING PLANS AND AUTHORIZING ADVERTISEMENT FOR BIDS WHEREAS, a certain petition requesting the installation of a fire protection system on certain property located between Nicollet on the west, First Avenue on the east, 66th Street on the south and 65th Street on the north was duly presented to the Council on the 29th day of May, 1984; and WHEREAS, the construction of such public improvement and the assessment of 100 percent of the costs thereof against the benefited property owner (the petitioner) is determined to be :economically feasible. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF RICHFIELD, MINNESOTA: 1. The Council finds and determines that the said petition was signed by all owners'of real property upon which the improvement is to be located. 2. The .petitioner has provided the City with the following: a) Right of entry and access for the purpose of constructing the proposed improvement (Exhibit A) b) Waiver of right to challenge special assessment (Exhibit B) c) Release, Indemnity and Hold Harmless Agreement (Exhibit C) d) Construction Management Agreement (Exhibit D) e) Maintenance and Operation Agreement (Exhibit E) f) Agreement Regarding Purchase of Improvement (Exhibit F) 3. Such improvement is hereby ordered. 4. Plans and specifications, a copy of which is attached hereto as Exhibit G and made a part hereof, have been reviewed and accepted by the City Engineer. Such plans and specifications are hereby approved and shall be filed with the City Clerk. 5. The City .Clerk shall prepare and cause to be inserted in the official newspaper an advertisement for-bids upon the making of such improvement under such plans and specifications. ii The advertisement shall be published for one week, shall specify the work to be done, shall state that bids will i, be opened at 10:.30 a.m. on Thursday , June 21st '~ 1984, in the council chambers of the city hall, 67Q0 Portland Avenue South, Richfield, Minnesota, and that no bids will be considered unless ~- sealed and filed with the Clerk and accompanied by a cash deposit, cashie'r's check, bid bond, or certified check payable to the', City Clerk for five percent of the amount of each bid.
