84-6982R.,- ~ . 24 RESOLUTION NQ . .6982 RESOLUTION t•IAIVI2JC- SUBDIVISION WHEREAS, Chapter III, Part IV of the Ordinance Code of the City of Richfield contains provisions regulating the subdivision of land within the City of Pichfield; and WHEREAS, the Housing and Redevelopment Authority in and for the City of Richfield (HRA} is the owner of that tract of Land described in attached Exhibit A (the Property); and WHEREAS, the HRA is under contract with P4arket Plaza Corporation to sell to such corporation the Property described in Exhibit A, together with other lands, for redevelopment purposes; and PIHEREA5, Market Plaza intends, upon the conveyance of the Property, to divide the Property into two separate parcels as described in Exhibit B for conveyance to two separate entities for development; and WHEREAS, Richfield Ordinance Code, Section 3.54, Sub- division 4 prohibits the conveyance of parcels described in metes and bounds which are Less than five acres in area and 300 feet in width without being platted; and WHEREAS, Richfield Ordinance Codes, Sectian 3.54, Sub- division 5 provides for the waiver cf t.~e recuirement of Subdivision 4 in certain circwmstances; and t•IHEP~,AS, application has been made by :~arket Plaza Ccrp. for such a waiver and has been duly ccnsidered by the City Council; and i i .• •^ ~ / . ~- i t^IHEREAS, the City Council has duly considered such application and has concluded that tre division of such Exhibit A into the two separate parcels described in Exhibit B without platting wouldlnot interfere with the platting regulations of the ordinance; and that to require platting would result in an unnecessary hardship to the applicant. NOL~, THEREFORE, BE IT RESOLVED by the City Council of the City of Richfield that the platting requirement contained in Richfield Ordinance Code, Section 3.54 is hereby waived and that the applicant may divide the Property described in Exhibit A on the basis of the division contained in Exhibit B.
