85-7062RRESOLUTION NO X062- - RESOLUTION APPROVING LAYOUT- AND CONTRACT FOR OFF-STREET PARKING WITH MICHAEL ORECK NAME: MICHEAL ORECK SUITE 103 4517 MINNETONKA BLVD. ST. LOUIS PARK, MN 55416 LOCATION : 64031-6435 LYNDALE AVENUE SOUTH USE: COMMERCIAL SHOPPING CENTER BE IT RESOLVED by the City Council of the City of Richfield, Minnesota as follows: 1. That the proposed geometric layout of the off-street parking is hereby approved subject to and upon completion of performance of the contract for such off-street parking as hereinafter authorized. 2. That the proposed off-street parking contract for the improvement of said off-street parking, be placed on file and that the city manager be authorized to sign said contract and the city clerk be authorized to seal the name for and on behalf of this city subject to the following provisions: A. That easement agreements be executed by the commercial and residential property owners as necessary concerning the use and maintenance of the vacated alley. B. That the design and location of the parking lot lighting be submitted to the city staff for approval. 3. That the off-street parking operator provide the City of Richfield with surety in the form of cash, letter of credit, performance bond or othe r-security in an amount to be determined by the community development director and city manager, to ensure the off-street parking lot is constructed within the terms and regulations of the off-street parking agreement. __, 4• That responsibility for the property upkeep and maintenance of off-street parking lot shall remain the responsibility of the off-street parking lot operator in accordance with Ordinance Code 4.05• Passed by the City Council of day of September, 1985- ATTEST: ~~ ~~Z~~ Thomas Ferber, City Clerk
