WHEREAS, the City ofRichfield ispreparing plansforMSAH104 (W 65St)

from W 66Stto LyndaleAve;and
WHEREAS,MinnesotaRulesforStateAidOperation8820.9936requiring
horizontalcurveofroadwaymeetsdesignspeedand8820.9995requiringhorizontal
curve of trail meets design speed; and
WHEREAS,thereasonsforthisvariancerequestsarethehorizontalalignment
radius does not meet 30 mph design speed per MnDOT Road Design Manual Table 3-
2.03B (U.S. Customary). Minimum radius (ft) is calculated as 250' for non-superelevated
cross section (e = 0.02 ft/ft). The proposed roadway matches the existing condition with
a right-angle curve of approximately 30' radius to avoid right of way needs and impacts
totheUS PostOffice.Also,horizontalalignmentofadjacenttrailtothenorthofthe
roadwaycurvedoesnotmeetdesignspeedof20mph.Theminimumradiusfora20-
trail radius.
NOW,THEREFOREBE IT RESOLVED,thattheCityofRichfieldCityCouncil
does hereby request a variance from the Minnesota Department of Transportation State
AidOperationsRulesChapter8820.9936(MINIMUMDESIGNSTANDARDS,URBAN;
NEW OR RECONSTRUCTION PROJECTS) to allow design speed of 10 MPH in lieu of
30MPHduetoalignmentconstraintsandChapter8820.9995(MINIMUMOFF-ROAD
AND SHARED USE PATH STANDARDS)to allow design speed of 16 MPH in lieu of 20
MPH;
BE IT FURTHER RESOLVED, that the City of Richfield City Council indemnifies,
savesandholdharmlesstheStateofMinnesotaandits agentsandemployeesofand
fromclaims,demands,actions,orcausesofactionarisingoutoforbyreasonof
roadway reconstruction in accordance with Minnesota Rules 8820.9936and 8820.9995
andfurtheragreestodefendattheirsolecostandexpenseanyactionorproceeding
commencedforthepurposeofassertinganyclaimarisingasaresultofthegranting
this variance.
