RESOLUTION DISAPPROVING GRANTING OF CLASS B
GAMBLING LICENSE TO VFW POST N0.5555 BY CHARITABLE
GAMBLING CONTROL BOARD FOR PURPOSE OF SETTING
LAWFUL GAMBLING OPERATION IN THE FRENCHMAN'S, INC.,
1400 EAST 66TH STREET, RICHFIELD, MINNESOTA
WHEREAS, the City did on April 23, 1986 receive notification
from the Minnesota Charitable Gambling Board (Board) that it was
seeking City consideration of an application from VFW Post No.
5555to.conduct lawful gambling on premises located at 1400 East
66th Street and operated under the name of The Frenchman's, Inc.;
and
WHEREAS, the Department of Public Safety has reviewed and
investigated the proposed licensed gambling activity and made its
report to the Council on such investigation; and
WHEREAS, Minnesota Statute §349.213 provides that the Board
not issue licenses for lawful gambling, if within 30 days of the
giving of notice of the pending of the license application the
City in which the activity would occur adopts a resolution
disapproving such license.
NOW THEREFORE BE IT RESOLVED, by the City Council of the
City of Richfield, Minnesota, as follows:
1. The City Council finds that establishment of or the
conducting of lawful gambling in a private enterprise would
hinder the protection of the public health, safety, and welfare,
and would hinder guarding against the proliferation of gambling
activities which are not in the public interest.
2.. The City Council finds that establishment of a lawful
gambling enterprise in a private establishment would increase the
difficulty. of preventing commercialization of lawful gambling and
insuring the integrity of the operation.
3. The City Council finds that it would be difficult to
monitor the operation of lawful gambling in a private enterprise
and to ascertain that at all times the gambling operation is not
being operated in conjunction with the conduct of the private
commercial lessors' business operation, in violation of subpart
7860.0100 of the Rules of the Minnesota Charitable Gambling
Board.
4. The City Council therefore disapproves the request for a
Class B Lawful Gambling License made to the Charitable Gambling
Control Board on behalf of VFW Post No.5555 for lawful gambling
to be conducted on the pre ises of the Frenchman's, Inc., at 1400
East 66th Street, Richfiel~, Minnesota.
5. The City Council directs the City Manager to convey to
the Charitable Gambling ontrol Board its disapproval of the
license request by VFW Post No. 5555 to conduct lawful gambling
operation in the Frenchman's, Inc., 1400 East 66th Street,
Richfield, Minnesota.

City of Richfield.
