86-7252R26 CITY OF~RICHFIELD RESOLIITION NO. .7252 RESOLIITION REGARDING RENEWAL OF ON-SALE WINE LICENSES TO CERTAIN ESTABLISHMENTS Davanni's piazza & North Star pizza Corporation WHEREAS, Hot Hoagies and dlbla Shak.ey's Pizza Parlor were previously issued annual licenses to permit the on-sale sale of wine in connection with the service of food at their business establishments; and WHEREAS, such licenses have been subsequently renewed from time to time; and WHEREAS, neither establishment has been charged or convicted of any violation of the alcoholic beverage control provisions of the Richfield Ordinance Code, and WHEREAS, both establishments have applied for an annual renewal for calendar year 1987; and. WHEREAS, the various departments of the City, to which the applications have been referred for investigation and recommenda- tion, have recommended approval of the 1987 on-sale wine licenses; and WHEREAS, the Council has determined that such establishments .may not have qualified for granting of the initial license due to the fact that they do not, in fact, provide table service to customers; and WHEREAS., the Council has determined that each applicant,. did, at the time of the in'tial application and at each renewal thereof, fully disclose the. nature of the food service to be provided to patrons; and WHEREAS, each establishment has expended substantial finan- cial resources in connection with preparing the licensed premises to provide wine, on-sale to its patrons in reliance on the licenses initially granted land WHEREAS, the City Council believes that it caould be mani- festly unjust to now deprive the applicants of the opportunity to sell wine, on-sale so long 'ias they do not violate the provisions of the City's liquor control regulations, NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF RICHFIELD AS FOLLOWS: 1. The 1987 renewals) of the on-sale wine licenses of the above-named applicants are approved. 2. In future years (except as provided in Paragraph 3) the renewal applicati'ions will not be denied on the sole basis that the applicant does not provide table ser- vice. 3. In the event that the applicants shall transfer their interest in the 1~censed establishments, any new owner shall, at the time of seeking application for an on-sale wine license, demonstrate that it meets the definition of al restaurant contained in the then current provisions of the Richfield Ordinance Code relating to the on-sale sale of wine.
