87-7378R48 RESOLUTION N0. 7378 RESOLUTION AUTHORIZING PIIjtCSASE OF LAND (7300 Pirst Avenue South) WHEREAS, la August of 1984 the City sold aad conveyed the tract of lead at 7300 First Avenue South. (Property) to David aad Lori Morgan (Morgans) such property being legally described in the attached E~chibit A; aad WHEREAS, at the time of such sale the City and the Morgans oars aware that, because of the Iow elevation of the Property, surface water occasionally could stand oa the property following rainstorms on occasion. would eater the basement of the structure through the windows and other non-watertight erase of the basement walls; and WHEREAS, although at the time of such sale the City had taken certain measures to improve the ratertight integrity of the basement, both the City and the Morgans were aware that those measures would neither elimiaata the standing water on the Property nor entirely grevent the infiltration of avatar into the basemsnt; aad WHEREAS, at the time of the ^ale, neither party was aware of the fact that is addition to the known problem of surface water accumulation aad iuf filtration, the basement was also subject to severe hydrostatic pressure during periods of heavy rain; and WHEREAS, following the unusually heavy zaiastorm of July 23, 1987, as upheaval of the basement floor occurred. apparently due to aevsre hydrostatic pressure, causing damage to the building; and WHEREAS, the Morgans have notified the City that they may aommeaoe litigation to seek a declaration setting aside the sale of the Property to them, and have asked the City to return their purchase price to WHEREAS, th• Morgans have attached hereto as Exhibit A, to rescind the vale voluntarily and to and ed the City with a Purchase Agreement, ng for the repurchave of the Property by the City for a price equal to thelprice ~-h3ch the Morgans had previously paid; aad WHEREAS, the Council has received the advice and recommendatiaas of the ' city manager aad city attorney. NOW, THEREFORE, BE IT RESO~.VED by the City Couacil of the City of Richfield, Miaaesota as foilaws: 1. The purchase of the Property',, is .accordance ~-ith the terms set forth aad described in Exhibit A is hereby approved. 2. The mayor and city manager are hereby authorized sad directed to execute Exhibit A on behalf of thel City, and to take all actioav aad do all things necessary to complete', the purchase of the Property in the meaner described in Exhibit A. 3. The Couacil finds that tie property acquisition approved in this reaolutioa has no relationship to the City'• Co r ensive plan.
