I. RECOMMENDED ACTION:
By motion: Approve the attached resolution authorizing the use of
additional Community Development Block Grant funding for the 2006
annual allocation.
I II. BACKGROUND I
The City Council conducted a public hearing on February 14,2006 to authorize
Richfield's use of the 2006 Community Development Block Grant (CDBG) allocation
of $192,960, as proposed. The amount of funds being acted upon by the City
Council at the February 14, 2006 meeting was the best estimate to date from
Hennepin County. Final amounts have since come in from Hennepin County and
have increased Richfield's allocation to $204,161, an increase of $11 ,201.
Hennepin County requires that these additional funds and their use be approved by
the City Council. The requirement is that the Council approves them by resolution.

It was noted in the staff report for the February 14th meeting that if there was an
increase in funding, it would be added to housing rehabilitation activities. The
additional $11,201 will be added to housing rehabilitation activities through a
rehabilitation home loan program for low-income homeowners. The Public Service
allocation will remain at $28,940 as approved by Council at the February 14th
meeting.
I III. BASIS OF RECOMMENDATION I
I A. POLICY I
. Allocation of federal CDSG funds is an annual activity.
. Hennepin County has an allocation system, which is unique in
providing an annual funding source that can be planned for.
I B. CRITICAL ISSUES I
. This year, funds are not contributed for first- time homebuyer housing.
The HRA was awarded $80,000 in Affordable Housing Incentive Fund
monies from Hennepin County to provide for first-time homebuyer
opportunities.
. Hennepin County allows up to 15 percent of available funds to go to
public service. The $28,940 available this year for public service was
distributed on a percentage basis as in the past, based on
recommendations of the Richfield Community Service Planning
Council.
. Staff is working with the Attainable Housing Committee to identify
other programs and resources that support lower income households.
. The attached resolution accurately depicts the dollars being
distributed.

RESOLUTION AUTHORIZING USE OF FUNDS FOR THE 2006 URBAN HENNEPIN
COUNTY COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM AND
AUTHORIZING SIGNATURE OF SUBRECIPIENT AGREEMENT WITH HENNEPIN
COUNTY AND ANY REQUIRED THIRD PARTY AGREEMENTS
WHEREAS, the City of Richfield, Minnesota, through execution of a Joint
Cooperation Agreement with Hennepin County, is cooperating in the Urban Hennepin
County Community Development Block Grant (CDBG) Program; and
WHEREAS, The City of Richfield developed a proposal for the use of CDBG funds
made available to it, and held a public hearing on February 14, 2006 to obtain the views of
citizens on local and Urban Hennepin County housing and community development needs
and priorities for the City's proposed use of $192,960 from the 2006 Urban Hennepin
County COBG Program.
WHEREAS, an additional $11,201 dollars is now available and consistent with the
results of the City Council's consideration for the uses for the CDBG funds on February 14,
2006, these additional dollars will be added to "Rehab of Owner-Occupied Property.
NOW, THEREFORE, BE IT RESOLVED that the City Council of Richfield,
Minnesota approves the following projects for CDBG and authorizes submittal of the
proposal to Hennepin County for review and inclusion in the 2006 Urban Hennepin County
COBG Program.

1. RECOMMENDED ACTION:
By Motion: Approve the attached resolution authorizing the Public
Safety Department's acceptance of a donation of $1,600 from the
Richfield American legion.
I II. BACKGROUND I
The Richfield Police Division is in the process of training two new police canines,
along with their police officer handlers, that will become a part of the K-9 unit in the
Public Safety Department. There are on-going costs that will occur for the care and
maintenance of the two police dogs.
Businesses, organizations and occasionally residents are proud of the law
enforcement programs and accomplishments in Richfield because the programs
and quality of service add to their sense of safety and security as they live and work
in Richfield. To ensure that programs continue, they will offer to contribute to
specified areas, such as a K-9 unit or protective vests for officers.
0314 Resolution Accepting Funds from American Legion
The Richfield American Legion has announced their intention of presenting the
Police Division with a check for $1600. These funds will be designated for use in
Richfield's K-9 Unit.
I III. BASIS OF RECOMMENDATION I
I A. POLICY I
. Public Safety does not accept financial support unless it is designated
for a specific program that will affect the department as a whole.
. Minnesota Statute 465.03 requires every acceptance of a grant or
devise of real or personal property on terms prescribed by the donor
be made by resolution of more than two-thirds majority of the City
Council.
. The Administrative Services Department issued a memo on
November 9, 2004 requiring that all grants and restricted donation to
departments be received by resolution and by more than two-thirds
majority of the City Council in accordance with Minnesota Statute
465.03.
I B. CRITICAL ISSUES I
. Police departments in the suburbs of Richfield, Bloomington, Edina
and the Airport Police often call upon each other to assist in the
pursuit of criminals and to put a stop to criminal activity in their cities.
. Richfield's K-9 Unit will assist in the safety of the Richfield community,
but will also be available to assist other cities, as they have assisted
Richfield in the past.

. The $1,600 donation will be used for the maintenance of the K-9 Unit.
. Funds for the K-9 Unit are taken from the Forfeiture Fund and,
therefore, the donation would be deposited in that particular fund.

WHEREAS, the Public Safety Department/Police Division, through its Director, has
b"een notified that the Richfield American Legion will present a check in the amount of
$1,600 to the K-9 Unit; and
WHEREAS, Minnesota Statute requires every acceptance of a grant or devise of
real or personal property on terms prescribed by the donor be made by resolution of more
than two-thirds majority of the City Council; and
WHEREAS, the donated funds will be used towards the maintenance and care of
the two canines belonging to the department and the K-9 Unit.
NOW, THEREFORE, BE IT RESOLVED that the Director of Public Safety will
acceptthe donation of $1,600 from the American Legion to be placed in the forfeiture fund

Consideration of receiving Richfield's Wellhead Protection Plan Part 1 and of setting the date
and time for a Public Information Meeting.
I. RECOMMENDED ACTION:
By Motion: Receive Richfield's Wellhead Protection Plan Part 1 and
set the Public Information Meeting for 5:00 p.m. April 6, 2006.
I II. BACKGROUND I
Minnesota Health Department (MHD) rules require municipal water systems such
as Richfield's to prepare Wellhead Protection Plans to identify any possible threats
to the groundwater source that Richfield uses for its water system. The
groundwater serving Richfield is fed from aquifers that extend many miles away
from the City's wells. The attached letter from Stephen Robertson, MHD
Hydrologist identifies the Public Information Meeting required by law.
Also attached is the City of Richfield Part 1 Wellhead Protection Plan that includes:
1. Delineation of the 1 O-year capture zone, the area of the aquifer that supplies
water to the wells over a 1 O-year time frame.
2. Delineation of the parcels of land in the Drinking Water Supply Management
Area (DWSMA).

3. A vulnerability assessment of the aquifer underlying the DWSMA.
Notice of the meeting will be published in the Richfield Sun on March 23, 2006.
Part 2 of the Wellhead Protection Plan will include a management plan to mitigate
any risks of contamination reaching the aquifer. The engineering firm of Bonestroo
Rosene Anderlik is preparing the Plan.

. The Richfield Water Utility operates under the rules and regulations
established by the Minnesota Department of Health.
I B. CRITICAL ISSUES I
. The Public Information Meeting must be held by April 8, 2006 to meet
the timeline that is identified in the attached letter from MHD.

. Richfield's Water Utility is subject to the rules and regulations of the

CITY OF RICHFIELD PART 1 WELLHEAD PROTECTION PLAN
March 2, 2006
BACKGROUND:
On June 12, 2002, the City was officially entered into the Minnesota Department of Health's (MDH)
wellhead protection program. Wellhead protection planning is a means by which to identify the area of
the underlying aquifer that is supplying water to the City's wells over a lO-year time span and to develop
a plan to protect that aquifer from human-caused contamination. The program is mandated for all public
water suppliers in the State of Minnesota.
The City of Richfield has just completed their Part 1 Wellhead Protection Plan. The Part 1 plan includes:
1. Delineation of the 1 a-year capture zone for the City's wells, which was created using a computer-
generated groundwater flow model. This is the area of the aquifer that supplies water to the wells
over a la-year time frame.
2. Delineation of the Drinking Water Supply Management Area (DWSMA), which is a
representation of the capture zone using features (such as roadways, parcel lines, etc.) that be
identified at the land surface.
3. An assessment of the vulnerability of the aquifer underlying the DWSMA
The results of the Part 1 Wellhead Protection Plan are shown on the attached figure. The dark blue line
represents the la-year Wellhead Protection Area for the City's wells. This is the area of the aquifer
calculated to supply water to the City's wells in a lO-year span of time. The green line represents the
DWSMA boundary. The vulnerability ofthe aquifer in this area is ranges from "very low" to "high." Low
vulnerability means that sufficient geologic deposits exist to impede the vertical infiltration of most
contaminants into the aquifer. High vulnerability is assigned to areas where very little geologic protection
exists between the land surface and the aquifer, allowing contaminants a greater possibility of infiltrating
into the aquifer.
In the near future, the MDH will conduct a scoping meeting with the City of Richfield to initiate the Part
2 Wellhead Protection planning process. The Part 2 Plan will include an inventory of potential
contamination sources located within the DWSMA, along with a management plan to mitigate any risks
of contamination reaching the aquifer. Since the aquifer has variable levels of vulnerability, the
contaminant source inventory will need to focus on a wide variety of potential contaminant sources. The
management plan will then need to address these sources to determine if they pose a threat to the water
quality of the underlying aquifer. Action items will be established to minimize the threat, wherever
possible.

Consideration of the renewal of the contract with ABC for 2006 for auctioning of forfeited
vehicles from Public Safety/Police.
I. RECOMMENDED ACTION:
By Motion:
· Approve the renewal for 2006/2007 of the attached auction service
contract between the City of Richfield and Auction Broadcasting
Company of Minneapolis for auctioning of forfeited vehicles from
Public Safety/Police.
· Approve the two changes in the contract; raising the cost of
transportation of an operable Forfeiture Vehicle to or from the City
of Richfield to ABC's storage site from $35 to $45; raising the cost
of basic cleaning of a forfeiture vehicle from $25 to $35.
I II. BACKGROUND I
The City currently has a contract with the Auction Broadcasting Company
(hereinafter referred to as "ABC"), to transport, store, repair, maintain and sell its
Forfeiture Vehicles. "ABC" was awarded the contract for the past year and would

like to renew the contract for the year 2006/2007 as the contract expires on April 9,
2006.
ABC's performance during the contract period was satisfactory. They auction
forfeiture vehicles for many cities, including the City of Bloomington.
I III. BASIS OF RECOMMENDATION I
I A. POLICY I
. "ABC notified the City that they wish to renew the contract.
. The Public Safety Department wishes to renew the contract with
"ABC."
. The contract has numerous conditions that must be met. "ABC" is a
reputable, established auction company that meets all contract
requirements.
I B. CRITICAL ISSUES I
. A 30-day written notice must be given by either party to terminate the
contract.
. Public Safety must have a company to store and auction forfeited
vehicles on April 9, 2006.
. Adequate space is not available in the City to store forfeited vehicles.
I C. FINANCIAL I
. The current contract with "ABC" reflects rates from 2005/2006. Two
changes in rates are reflected in the new contract: Raising the cost of
transporting operable vehicles from $35 to $45; Raising the cost of
cleaning vehicles from $25 to $35.
. Public Safety receives monies from the sale of forfeited vehicles after
appropriate fees are taken out.
I D. LEGAL I
. The City Attorney has reviewed and approved the past contract with
"ABC."
I IV. ALTERNATIVE RECOMMENDATION(S) I
. Do not sign the contract; however, Public Safety would need to find other
means to auction forfeited vehicles.

AGREEMENT BETWEEN THE CITY OF RICHFIELD
AND AUCTION BROADCASTING COMPANY MINNEAPOLIS
THIS AGREEMENT is made and entered into this 8th day of April, 2006 by and
between the City of Richfield, a Minnesota municipal corporation located at 6700 Portland
Ave. S., Richfield, Minnesota 55423 (hereinafter referred to as the "City"), and Auction
Broadcasting Company Minneapolis, a limited, liability corporation with its principle
business offices located at 18270 Territorial Road, Dayton, Minnesota 55369 (hereinafter
referred to as "ABC").
WITNESSETH
WHEREAS, the City comes into possession of and is authorized to retain various
motor vehicles which are identified as potentially being subject to forfeiture or other civil
processes under the laws of the State of Minnesota as a result of their having been used in
the connection with a criminal act (hereinafter referred to as "Forfeiture Vehicles") and
upon successful completion of the forfeiture or civil process the City is authorized to
dispose of said vehicles in accordance with Section 315 of the Richfield City Code; and
WHEREAS, ABC represents that it has the professional expertise and knowledge to
perform its duties as an automobile dealer, and is licensed by the State of Minnesota in
that capacity; and
WHEREAS, the City desires to hire ABC to transport, store, repair, maintain and
sell its Forfeiture Vehicles;
NOW, THEREFORE, in consideration of the terms and conditions expressed
herein, the parties agree as follows:
I. TERM OF AGREEMENT
The term of this Agreement shall begin April 9, 2006 and shall continue until April 9,
2007, subject to termination as provided in Article IV.
II. DUTIES OF ABC
A. Upon specific authorization from the City, ABC agrees to drive or transport
those vehicles identified by the City as one of its Forfeiture Vehicles to a secure location to
be determined and managed by ABC.
B. Upon receipt of a City Forfeiture Vehicle, ABC accepts full responsibility for it
and agrees to exercise due diligence in its care, maintenance and storage of said vehicle
until the time that it is sold or released; so as to avoid waste and obtain a reasonable sale
price at auction.
C. Upon specific authorization from the City, ABC agrees to perform such minor
repair work on the City's Forfeiture Vehicles so as to prepare them for auction and
maximize the City's return at auction, but in no event shall such repair work exceed the
cost of TWO HUNDRED AND NO/100 DOLLARS ($200.00) without prior, written
authorization by the Richfield City Manager or his/her designee.
D. Upon specific authorization from the City, ABC agrees to release the City's
Forfeiture Vehicles prior to auction on such terms and conditions as the City may direct.
E. ABC agrees to box and store personal property that is not affixed to, but
located within, the City's Forfeiture vehicles and upon specific authorization from the City
to release such property on such terms and conditions as the City may direct.
F. Upon specific authorization from the City, ABC agrees to promptly sell the
City's Forfeiture Vehicles in a commercially reasonable manner by an open and
competitive automobile dealer or salvage auction.
G. ABC agrees to defend, indemnify and hold harmless the City, its officials,
employees and agents from any and all claims, causes of action, lawsuits, damages,
losses, or expenses, including attorney fees, arising out of or resulting from ABC's
(including its officials, agents or employees) performance of the duties required under this
Agreement, provided that any such claim, damage, loss or expense is attributable to bodily
injury, sickness, diseases or death or to injury to or destruction of property including the
loss of use resulting therefrom and is caused in whole or in part by any negligent act or
omission or willful misconduct of ABC.
H. During the term of this Agreement ABC agrees to maintain general
comprehensive liability insurance in the amount of $1,000,000 for any damage to property,
theft, loss or other claims as a result of ABC's negligence or malfeasance in performing
this Agreement. In addition, ABC agrees to maintain such motor vehicle liability insurance
as required by state and federal laws.
I. ABC shall be licensed and bonded in the State of Minnesota to perform its
duties under this Agreement and shall provide a certificate of licensure, bonding and
insurance to the City.
J. ABC agrees to comply with all applicable local, state and federal laws, rules
and regulations in the performance of the duties of this Agreement.
K. It is agreed that nothing herein contained is intended or should be construed
in any manner as creating or establishing the relationship of copartners between the
parties hereto or as constituting ABC's staff as the agents, representatives or employees
of the City for any purpose in any manner whatsoever. ABC and its staff are to be and
shall remain an independent contractor with respect to all services performed under this
Agreement. ABC represents that it has, or will secure at its own expense, all personnel
required in performing services under this Agreement. Any and all personnel of ABC or
other persons, while engaged in the performance of any work or services required by ABC
under this Agreement, shall have no contractual relationship with the City and shall not be
considered employees of the City, and any and all claims that mayor might arise under the
Workers' Compensation Act of the State of Minnesota on behalf of said personnel or other
persons while so engaged, and any and all claims whatsoever on behalf of any such
person or personnel arising out of employment or alleged employment including, without
limitation, claims of discrimination against ABC, its officers, agents, contractors or
employees shall in no way be the responsibility of the City; and ABC shall defend,
indemnify and hold the City, its officers, agents and employees harmless from any and all
such claims regardless of any determination of any pertinent tribunal, agency, board,
commission or court. Such personnel or other persons shall not require nor be entitled to
any compensation, rights or benefits of any kind whatsoever from the City, including,
without limitation, tenure rights, medical and hospital care, sick and vacation leave,
Workers' Compensation, Unemployment Compensation, disability, severance pay and
PERA.
L. The books, records, documents, and accounting procedures of the
Contractor, relevant to this Agreement, are subject to examination by the City, and either
the legislative or state auditor as appropriate, pursuant to Minnesota Statutes, Section
16C.05, Subdivision 5.
M. ABC agrees to comply with the Americans with Disabilities Act (ADA),
Section 504 of the Rehabilitation Act of 1973 and not discriminate on the basis of disability
in the admission or access to, or treatment of employment in its services, programs, or
activities. ABC agrees to hold harmless and indemnify the City from, costs, including but
not limited to damages, attorney's fees and staff time, in any action or proceeding brought
alleging a violation of ADA and/or Section 504 caused by the ABC. Upon request,
accommodation will be provided to allow individuals with disabilities to participate in all
services, programs and activities. The City has designated coordinators to facilitate
compliance with the Americans With Disabilities Act of 1990, as required by Section
35.107 of the U.S. Department of Justice regulations, and to coordinate compliance with
Section 504 of the Rehabilitation Act of 1973, as mandated by Section 8.53 of the U.S.
Department of Housing and Urban Development regulations.
N. The Contractor will comply with all applicable provisions of the Minnesota
Government Data Practices Act, Chapter 13 of the Minnesota Statutes.
O. Any Forfeiture Vehicles which ABC has been authorized and directed to sell
but was unable to under the terms of this Agreement shall be returned to the City at a site
designated by it as soon as reasonably practicable but in no event more than sixty (60)
days from the occurrence of the event making sale under this Agreement impossible.
III. DUTIES OF THE CITY
A. The City shall consign specifically identified Forfeiture Vehicles to ABC to
sell to the highest bidder at public dealer or salvage auctions.
B. The City shall certify that it has good title and right to sell those of its
Forfeiture Vehicles which it directs and specifically authorizes ABC to sell at public dealer
or salvage auctions and shall provide and deliver merchantable title to the purchaser upon
notification from ABC.
C. The City shall defend, indemnify and hold harmless the ABC, its officials,
employees and agents, from any and all claims, causes of action, lawsuits, damages,
losses or expenses, including attorney fees, arising out of or resulting from the City's
performance of the duties required under this Agreement, provided that any such claim,
damages, loss or expense is attributable to bodily injury, sickness, diseases or death or to
injury to or destruction of property including the loss of use resulting therefrom and is
caused in whole or in part by any negligent act or omission or willful misconduct of City.
D. The City shall pay to ABC the following amounts as and for its services
properly authorized and provided pursuant to this Agreement:
1. Transportation of an operable Forfeiture Vehicle to or from the City of Richfield to
ABC's designated storage site: $45.00.
2. Tow of an inoperable Forfeiture Vehicle (tow or trailer) to or from the City of Richfield to
ABC's designated storage site: $85.00.
3. Basic cleaning of a Forfeiture Vehicle: $35.00.
4. Complete detail of a Forfeiture Vehicle (vacuum and shampoo carpets, detail interior,
etc.): $85.00.
5. Repair of a Forfeiture Vehicle prior to auction: Shop Rates.
6. Sale by auction of a Forfeiture Vehicle: $110.00.
7. Release of a Forfeiture Vehicle prior to auction: $50.00 redemption, fee plus any
charges (i.e., transportation).
8. Storage fee if car is not sold within 90 days: $3.00/day.
9. Inventory fee for release of personal property: $25.00.
IV. TERMINATION
Either party may terminate this Agreement for any reason upon thirty (30) days
advance written notice to the other party. The City reserves the right to cancel this
Agreement at any time in event of default or violation by ABC of any provision of this
Agreement. The City may take whatever action at law or in equity that may appear
necessary or desirable to collect damages arising from a default or violation or to enforce
performance of this Agreement.
V. MISCELLANEOUS
A. Any material alterations, variations, modifications or waivers of provisions of
this Agreement shall be valid only when they have been reduced to writing as an
amendment to this Agreement and signed by poth parties.
B. This Agreement shall not be assignable except at the written consent of the
City.
C. This Agreement represents the entire Agreement between ABC and the City
and supersedes and cancels any and all prior agreements or proposals, written or oral,
between the parties relating to the subject matter hereof; and amendments, addenda,
alterations, or modifications to the terms and conditions of this Agreement shall be in
writing and signed by both parties.
D. The parties agree to comply with the Minnesota State Human Rights Act,
Minnesota Statutes, Section 363.
E. The parties hereto agree to comply with Section 504 of the Rehabilitation Act
of 1973/31 CFR Part 51. This Act states in part that, ".. .all recipients of federal funds,
whether in the form of a grant or a contract, review, and if necessary modify, their
programs and activities so that discrimination based on handicap is eliminated."
F. The terms and conditions of this Agreement shall be binding on ABC's
successors and assigns and to the extent any assignee of ABC.
IN WITNESS WHEREOF, the parties hereto have caused this Amendment to be

I. RECOMMENDED ACTION:

I II. BACKGROUND I
· The City's current fee schedule for land use permits and approvals is set forth in
Transitory Ordinance No. 18.30, which is a part of Appendix D to the City Code.
Transitory Ordinance No. 18.30 adopts by reference certain fees in Resolution
No. 9556, which was the City's fee schedule resolution for 2005. In December
2005, the City Council approved a new fee schedule resolution for 2006,

Resolution No. 9694. As a result, Transitory Ordinance No. 18.30 now contains
an obsolete cross-reference.
. The proposed ordinance lists the specific fees in the ordinance rather than
referring to the current fee resolution. This is a technical amendment. No
changes were made to any of the fee amounts. Other technical changes
included updating references to certain subsections of the city code.
. The proposed amendment also changes the designation of "C-3 zoning district
site plan review to "site plan review." The change was necessary because of
the recent addition of the Mixed-Use Zoning Districts to the zoning code, which
include a requirement for site plan review.
I III. BASIS OF RECOMMENDATION I
I A. POLICY I
. The recommended ordinance amendment will eliminate an obsolete
cross-reference in Appendix D and make other technical changes.
. The recommended ordinance amendment will establish a fee for the site
plan review process in all districts that require it. The current fee
schedule only dictates a fee for site plan review in the C-3 District.
I B. CRITICAL ISSUES I
. Minnesota State Statute 462.353 requires that certain fees be adopted by
ordinance.
. The amendment clarifies that the fee for site plan review is applicable to
all zoning districts, not only the C-3 District.
I C. FINANCIAL I
. Section 3.12 of the Richfield City Charter allows the City Council to
authorize by unanimous vote summary publication of an ordinance when
the summary clearly informs the public of the intent and effect of the
ordinance.
I D. LEGAL I
. Zoning: This ordinance amendment will establish a fee for site plan
review in all zoning districts, rather than just the C-3 District.

TO THE RICHFIELD CITY CODE; ESTABLISHING A FEE SCHEDULE
FOR CERTAIN PERMITS AND APPLICATIONS
THE CITY OF RICHFIELD DOES ORDAIN:
Section 1. Background
1.01 Appendix D to the Richfield City Code consists of the schedule of fees
adopted by the City Council, including those adopted by resolution and
those adopted by ordinance.
1.02 Minnesota Statutes, Section 462.353 requires that certain fees be adopted
by ordinance. The City Council has previously established certain fees by
Transitory Ordinance No. 18.30. The City Council has established other
fees by Resolution No. 9694, which is also part of Appendix D.
1.03 The City Council has determined the need to update the schedule of fees
under Transitory Ordinance No. 18.30.
Section 2. Fee Schedule Adopted
2.01 The fees set forth in the attached Exhibit A are hereby adopted by
ordinance.
2.02 The fees adopted at Section 2.01 of this Ordinance shall be amended only
by ordinance. Any fees established by Resolution No. 9694, other than
those adopted at Section 2.01 of this Ordinance, may be amended from time
to time by resolution of the City Council.
Section 3. Effective date; codification.
3.01 This ordinance is effective in accordance with Section 3.09 of the Richfield
City Charter.
3.02 A copy of this ordinance shall be included in Appendix D to the Richfield City
Code, immediately prior to Resolution No. 9694.
3.03 This ordinance supersedes Transitory Ordinance No. 18.30 to the extent
that Transitory Ordinance No. 18.30 is inconsistent with this ordinance.

A. Investigation Fees: Work without a Permit:
Investigation. Whenever any work for which a permit is required by this code has been
commenced without first obtaining said permit. a special investigation shall be made before a
permit may be issued for such work.
Fee. An investigation fee. in addition to the permit fee, shall be collected whether or not a permit
is then or subsequently issued. The investigation fee shall be equal to the amount of the permit fee
required by this code. The minimum investigation fee shall be the same as the minimum fee set
forth in Section 2. The payment of such investigation fee shall not exempt any person from
compliance with all other provisions of this code nor from any penalty prescribed by law.

WHEREAS, the City has adopted the above referenced ordinance; and

publication of the complete text is not justified; and
WHEREAS, the following summary clearly informs the public of the intent and effect
of the ordinance.

AN ORDINANCE AMENDING APPENDIX D TO THE
RICHFIELD CITY CODE; ESTABLISHING A FEE SCHEDULE
FOR CERTAIN PERMITS AND APPLICATIONS
On March 14, 2006, the Richfield City Council adopted an ordinance
designated as Bill No. , the title of which is stated above. This
summary of the ordinance is published pursuant to Section 3.12 of the
Richfield City Charter. The ordinance adopts a fee schedule for certain
permits and approvals related to construction, land use, utilities services and
certain fire services. This is a technical amendment to correct an obsolete
cross-reference in the existing fee schedule ordinance. No changes were
made to any of the fee amounts. Other technical changes included updating
references to certain subsections of the City Code and changing the
designation of "C-3 zoning district site plan review" to "site plan review." The
latter change clarifies that the fee for site plan review is the same in all
zoning districts, including the Mixed-Use Zoning Districts recently added to
the zoning code. Copies of the ordinance are available for public inspection
in the office of the City Clerk during normal business hours or upon request
by calling 612-861-9760 of the Community Development Division.
