RESOLUTION AUTHORIZING A SUBDIVISION WAIVER
FOR 6812 EMERSON LANE
WHEREAS, an application has been filed with the City of Richfield which
requests approval of a subdivision waiver for the division of property commonly known
as 6812 Emerson Lane ("Subject Property"), legally described in the attached Exhibit A;
and
WHEREAS, the Richfield Housing and Redevelopment Authority is the current
fee owner and proposes to divide the Subject Property into two parcels, legally
described as "Parcel 1" and "Parcel 2" in the attached Exhibit B; and
WHEREAS, the City Council finds that compliance with City Code Section
500.05 Subdivision 1, requiring the property to be platted, would result in unnecessary
hardship and that failure to comply therewith will not interfere with the purposes of the
platting regulations of Section 500.01; and
WHEREAS, the majority of the property, described in Exhibit B as Parcel 1, is
proposed to be platted as GALATIANS ADDITION, to be considered by the City Council
in a separate Resolution; and
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Richfield, Minnesota, as follows:
1. A waiver for the subdivision of the Subject Property legally described above is
hereby granted.
2. City staff is authorized and directed to take any action necessary to effectuate
this Resolution and to authorize the recording of conveyances complying with
the terms of this Resolution.
Adopted by the City Council of the City of Richfield, Minnesota this 26th day of
November, 2019.
