01-14 Regular CITY COUNCIL MEETING MINUTES Richfield, Minnesota Regular Council Meeting January 14, 2020 CALL TO ORDER The meeting was called to order by Mayor Maria Regan Gonzalez at 7:01 p.m. in the Council Chambers. Council Members Maria Regan Gonzalez, Mayor; Edwina Garcia; Simon Trautmann; and Present: Ben Whalen. Item #2 CONSENT CALENDAR City Manager Rodriguez presented the consent calendar. A. Consider a resolution granting an amendment to approved development plans at Cedar Point Commons requesting approval of a standalone trash enclosure for the retail building at 1840 th 66 Street East (Staff Report No. 01). RESOLUTION NO. 11702 RESOLUTION APPROVING AN AMENDED FINAL DEVELOPMENT PLAN AND CONDITIONAL USE PERMIT FOR THE CEDAR POINT COMMONS PLANNED UNIT DEVELOPMENT B. Consider approval of the first reading of an ordinance rezoning property at 6501 Woodlake Drive (Market Plaza & Village Shores) as Planned Mixed Use (PMU) and schedule a second reading for January 28, 2020 (Staff Report No. 02). C. Consider approval of an agreement with the City of Bloomington for the provision of public health services for the City of Richfield for 2020 (Staff Report No. 03). D. Consider approval for Temporary On-Sale Intoxicating Liquor license for the Blessed Trinity Catholic School, located at Church of St. Richard, 7540 Penn Avenue South, for their 2020 Sno*ball Dance taking place February 8, 2020 (Staff Report No. 04). E. Consider approval to designate an Acting City Manager for 2020 (Staff Report No. 05). F. Consider the resolutions designating official depositories for the City of Richfield for 2020, including the approval of collateral (Staff Report No. 06). RESOLUTION NO. 11703 RESOLUTION DESIGNATING CERTAIN FINANCIAL INSTITUTIONS AS DEPOSITORIES FOR THE INVESTMENT OF CITY OF RICHFIELD FUNDS IN 2020 RESOLUTION NO. 11704 RESOLUTION DESIGNATING CERTAIN SAVING AND LOAN ASSOCIATIONS, BANKS AND CREDIT UNIONS AS DEPOSITORIES FOR THE DEPOSIT AND INVESTMENT OF CITY FUNDS IN 2020 RESOLUTION NO. 11705 RESOLUTION DESIGNATING U.S. BANK A DEPOSITORY OF FUNDS OF THE CITY OF RICHFIELD FOR THE YEAR 2020 G. Consider a resolution authorizing the use of credit cards by City employees otherwise authorized to make purchases on behalf of the City (Staff Report No. 07). Consider a resolution designating an official newspaper for 2020 (Staff Report No. 08). CONSIDERATION OF ITEMS, IF ANY, REMOVED FROM CONSENT Item #3 CALENDAR None CONSIDERATION OF THE APPOINTMENT OF YOUTH MEMBERS TO CITY Item #4 ADVISORY BOARD/COMMISSIONS (STAFF REPORT NO. 09) Council Member Whalen read Staff Report 09. M/Whalen, S/Trautmann to appoint youth members to City advisory board/commissions Mayor Regan Gonzalez explained to the present Cub Scouts how they can apply to be a youth commissioner when they turn 15. Motion carried 4-0. CONSIDER A RESOLUTION APPROVING THE CONTRACT WITH POLICE OFFICERS AND DETECTIVES LELS LOCAL 123 FOR THE CONTRACT Item #5 PERIOD JANUARY 1, 2020 THROUGH DECEMBER 31, 2021 AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE AGREEMENT (STAFF REPORT NO. 10) Council Member Trautmann presented Staff Report 10. M/Trautmann, S/Whalen to consider a resolution approving the contract with the Police Officers and Detectives LELS Local 123 for the contract period January 1, 2020 through December 31, 2021 and authorize the City Manager to execute the agreement. Council Meeting Minutes -4- January 14, 2020 RESOLUTION NO. 11708 RESOLUTION APPROVING LABOR AGREEMENT BETWEEN THE CITY OF RICHFIELD AND LAW ENFORCEMENT LABOR SERVICES (LELS), LOCAL 123 BARGAINING UNIT FOR THE YEARS 2020 AND 2021 Motion carried 4-0. CONSIDER A RESOLUTION APPROVING THE CONTRACT WITH THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS LOCAL 1215 FOR THE Item #6 CONTRACT PERIOD JANUARY 1, 2020 THROUGH DECEMBER 31, 2021 AND AUTHORIZE THE CITY MANAGER TO EXECUTE THE AGREEMENT (STAFF REPORT NO. 11) Council Member Garcia read Staff Report 11. M/Garcia, S/Whalen to consider a resolution approving the contract with the International Association of Firefighters Local 1215 for the contract period January 1, 2020 through December 31, 2021 and authorize the City Manager to execute the agreement. RESOLUTION NO. 11709 RESOLUTION APPROVING LABOR AGREEMENT BETWEEN THE CITY OF RICHFIELD AND THE INTERNATIONAL ASSOCIATION OF FIREFIGHTERS (IAFF), LOCAL 1215 BARGAINING UNIT FOR THE YEAR 2020 AND 2021 Motion carried 4-0. CONSIDER THE DESIGNATION OF A MAYOR PRO TEMPORE FOR 2020 Item #7 (STAFF REPORT NO. 12) Mayor Regan Gonzalez presented Staff Report 12 and designated Council Member Trautmann as the Mayor Pro Tempore. M/Garcia, S/Whalen to designate Council Member Trautmann as the Mayor Pro Tempore for the year 2020. Motion carried 4-0. CONSIDER REPRESENTATIVES TO SERVE AS THE 2020 LIAISONS TO Item #8 VARIOUS LOCAL, REGIONAL AND STATE ORGANIZATIONS, AND CITY BOARDS AND COMMISSIONS (STAFF REPORT NO. 13) Council Meeting Minutes -5- January 14, 2020 Mayor Regan Gonzalez read Staff Report 13 and reviewed the list of liaisons. M/Regan Gonzalez, S/Trautmann to consider representatives to serve as the 2020 liaisons to various local, regional and state organizations, and City boards and commissions. Motion carried 4-0. CONSIDER THE ACCEPTANCE OF BID MINUTES/TABULATION, DATED JANUARY 7, 2020, AWARD OF CONTRACT TO COMMERCIAL REFRIGERATION SYSTEMS, THE LOWEST BIDDER, IN THE AMOUNT OF Item #9 $2,849,895.00 (MINUS 8% CONTIGENCY DURING CONSTRUCTION), AND THE AUTHORIZATION OF STAFF TO EXECUTE THE CONTRACT FOR THE RICHFIELD ICE ARENA REFRIGERATION PROJECT, MANAGED BY B32 ENGINEERING GROUP (STAFF REPORT NO. 14) Council Member Whalen presented Staff Report 14 and stated how the Richfield Ice Arena is in need of the update. He stated the process included extensive community outreach and this is the final step to the project. Director Markle spoke of how three companies submitted bids and with the amount the project will cost, they will also be able to upgrade the HVAC system, ADA upgrades, purchase of artificial turf and roof improvements. The work is to start in late March and scheduled to be done mid-September. M/Whalen, S/Garcia to consider the acceptance of bid minutes/tabulation, dated January 7, 2020, award of contract to Commercial Refrigeration Systems, the lowest bidder, in the amount of $2,849,895.00 (minus an 8% contingency during construction), and the authorization of staff to execute the contract for the Richfield Ice Arena Refrigeration Project, managed by B32 Engineering Group. Council Member Garcia praised Director Markle and Facilities Manager Weiby on their efforts to bring this project to life. Mayor Regan Gonzalez also commended staff on their work, especially the community engagement process and is excited what they will be able to do the upgrades. Council Member Trautmann applauded staff as well and is very much looking forward to all the upgrades. Motion carried 4-0 Item #10 CITY MANAGER’S REPORT City Manager Rodriguez had nothing to report. OPEN FORUM Bryan Milliard, South Minneapolis resident, stated that he does business in the City of Richfield and was present to show support for the Quinones family. He stated his opinion that the officers involved in the incident should not be on the streets while the investigation remains open. Kimberly Milliard, South Minneapolis resident, spoke of her discontent with the city and does not believe the police department is abiding by their mission. Wilmery Quinones, sister of Brian Quinones, requested information about the officer involved shooting. She wants to see the videos from the incident and wants the officers involved off the streets. She stated how she avoids the City of Richfield. Don Williams, Minnesota resident, spoke of his frustration and dissatisfaction with City Council and referenced the lack of action and transparency. Chara Blanch, Richfield resident, specified her disappointment in City Council. She also demanded to have the three officers involved out of the streets, an update to the use of force policy and for police body cameras to be implemented. Zeta Henry, Minneapolis resident, spoke of the loss of her brother in 2012 due to an officer involved shooting with Brooklyn Center Police Department. She expressed her concern of not being heard or being kept aware. Dean Aden, brother of Isak Aden, stated his discontent with the City approving the budget for the Richfield Ice Arena improvements instead of using the money for police body cameras. Sumaya Aden, sister of Isak Aden, spoke of her frustration with the City Council and how they have handled the officer involved shooting.
