06-11 Resolution No. 11630 RESOLUTION NO. 11630 RESOLUTION AUTHORIZING A SUBDIVISION WAIVER FOR 6540 PENN AVENUE WHEREAS , an application has been filed with the City of Richfield which requests approval of a subdivision waiver for the division of property commonly known as 6540 Penn Avenue, legally described as: Lot 1, Block 1, RICHFIELD GARDENS 2ND ADDITION, Hennepin County, Minnesota WHEREAS , the applicant proposes to divide the above-described property into two parcels, legally described as: Tract A: Lot 1, Block 1, RICHFIELD GARDENS 2ND ADDITION, Hennepin County, Minnesota LESS AND EXCEPT: That part of Lot 1, Block 1, Richfield Gardens 2nd Addition, described as lying westerly of the following described line; Commencing at the Southwest Corner of said Lot 1, Block 1, thence South 89 degrees 45 minutes 12 seconds East, assumed bearing along the south line of said Lot 1, Block 1, a distance of 125.10 feet, to the Point of Beginning of the line to be described; thence North 00 degrees 14 minutes 25 seconds West, parallel with the west line of said Lot 1, Block 1, a distance of 70.00 feet more or less, to the angle point on the westerly line of said Lot 1, Block 1 and there terminating. Tract B: That part of Lot 1, Block 1, Richfield Gardens 2nd Addition, described as lying westerly of the following described line; Commencing at the Southwest Corner of said Lot 1, Block 1, thence South 89 degrees 45 minutes 12 seconds East, assumed bearing along the south line of said Lot 1, Block 1, a distance of 125.10 feet, to the Point of Beginning of the line to be described; thence North 00 degrees 14 minutes 25 seconds West, parallel with the west line of said Lot 1, Block 1, a distance of 70.00 feet more or less, to the angle point on the westerly line of said Lot 1, Block 1 and there terminating. WHEREAS , the City has fully considered the request for approval for the subdivision waiver; and WHEREAS , the City Council finds that compliance with City Code Section 500.05, Subdivision 1 would result in unnecessary hardship and that failure to comply therewith will not interfere with the purposes of the platting regulations of Section 500.01. Resolution No. 11630 NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Richfield, Minnesota, as follows: 1. A waiver for the subdivision of the Subject Property legally described above is hereby granted. 2. The separate parcel described as Tract B above must be incorporated into the plat of the NOVO development (future address: 2400 66th Street West). 3. City staff is authorized and directed to take any action necessary to effectuate this Resolution and to authorize the recording of conveyances complying with the terms of this Resolution.
