RESOLUTION AUTHORIZING A STIPULATED AWARD OF COMMISSIONERS
FOR THE ACQUISITION OF THE MOTEL 6 PROPERTY AS REQUIRED
TH
FOR THE CONSTRUCTION OF THE 77 STREET/RICHFIELD PARKWAY
PROJECT
WHEREAS
, pursuant to City of Richfield (the “City”) Resolution No. 11544, City
staff and the City property acquisition consultants were authorized acquire fee simple
absolute title of a certain property (owned in fee) by G6 Hospitality Property LLC, a
Delaware limited liability company (the “Motel 6 Property”), located in the City of
Richfield, Hennepin County, Minnesota, and legally described as follows:
That part of the North 1/2 of the Southeast Quarter of the Southeast
Quarter of Section 35, Township 28, Range 24, lying South of the North
10 acres of said quarter-quarter and East of the extension South of the
East line of 18th Ave. So. as laid out in the plat of “Larson’s South View
Gardens Second Addition.”
Torrens Property; and
WHEREAS,
on January 22, 2019, Judge Laurie J. Miller granted the City’s
Petition in condemnation and filed an order (in Hennepin County District Court File No.
27-CV-18-16502) awarding the City with title and the right of possession to the Motel 6
Property following the City’s deposit of its $4,600,000 appraised value of the Motel 6
Property with the District Court; and
WHEREAS,
G6 Hospitality Property LLC, has offered to stipulate to an award of
commissioners in the total amount of $6,700,000 (i.e. less the $4,600,000 deposit) to
finally settle the claims that pertain to the condemnation of Motel 6 Property/Parcel 1 as
described in the Petition, inclusive of any and all relocation benefits, attorney’s fees,
litigation expenses, appraisal fees, other expert fees and other related costs as may be
claimed under Minn. Stat. §117.012 though Minn. Stat. §117.57.
NOW, THEREFORE, BE ITRESOLVED
, by the City Council of the City of
Richfield, Minnesota, as follows:
1) That the City Council hereby accepts and authorizes the City staff and the City
property acquisition consultants to process the G6 Hospitality Property LLC offer
to stipulate to an award of commissioners in the total amount of $6,700,000 (i.e.

less the $4,600,000 deposit) for the acquisition of the Motel 6 Property or the 77
Street/Richfield Parkway Project inclusive of any and all relocation benefits,
attorney’s fees, litigation expenses, appraisal fees, other expert fees and other
related costs as may be claimed under Minn. Stat. §117.012 though Minn. Stat.
§117.57.

2) That the City Council authorizes the City staff and the City property acquisition
consultants to stipulate to the release of the City's deposit of its $4,600,000
appraised value of the Motel 6 Property with the District Court as may be
necessary to effectuate payment of the stipulated award of commissioners in the
total amount of$6,700,000.
Adopted by the City Council of the City of Richfield, Minnesota this 11th day of
February, 2019.
