Council Letter No. 330 Agenga September 8, 1980 The Honorable Mayor and Members of the City Council City of Richfield Council Members: Subject: Approval of Minutes, Tabulation of Bids and Award of Contract for Central Garage Remodeling Project The city garage remodeling is a multiphasic project. One of the items in this project is the addition to, and remodeling of, the south end of the facility. At the May 27, 1980 city council meeting, the council authorized preparation of final plans and specifications, and the solicitation of bids for this building addition. Funding for the project is available through Capital Improve- ment budget appropriations from the special revenue fund. It has been the intent of the city council and staff to complete as much as possible of the work on the project in 1980, with essentially only finishing work to complete in 1981. To accomplish this goal, it is recommended that $55,000 in the 1980 Capital Improvement bud- get funding for a sidewalk project be transferred to the 1980 fund- ing for the central garage project, and that the $55,000 scheduled in the Capital Improvement Program for the garage in 1981 be reas- signed at that time to the sidewalk project. On September 4,1.980, bids were opened for the addition and remodeling of the central garage facility. A copy of the bid minutes and tabulations is attached for city council review. The specifications call for an addition to the garage facility with all proposals to include an indication of calendar days from start to completion and submittal, on a lump sum basis, to furnish all materials, labor, skill, tools and equipment for the purpose of awarding a single construction contract, including all general, mechanical and electrical work. Finish work on the remodeling is to be provided by city staff personnel. The bidding has a good response, with nine contractors submit- ting proposals. .The estimate for the work was $60,000, as was noted in the council letter and action of P4ay 27, 1980. Henry O. Mikkelson Company, is the apparent low bidder with a proposal in the amount of $58,700 and 90 calendar days to completion.. Henry O. ~ti.kkelson Company has worked for the city on other projects and it is the opinion of the staff and the architect that the bid proposal sub- mitted by this contractor is excellent. With the transfer of funds, sufficient monies will be available in the project for award of this contract. Council Letter No. 330 -2- September 8, 1980 i ~. It is recommended that the city council take the following actions 1. Accept the bid minutes and tabulations for the Richfield Municipal Garage addition and remodeling project. 2. Adopt the attached resolution transferring special revenue monies currently assigned to the sidewalk project to the central garage remodeling project. 3. Approve the low bid of Henry O. Niikkelson Company in the amount of $58,700, and authorize the Dlayor and City Manager to execute the contract documents. RESOLUTION TRANSFERRING SPECIAL REVENUE MONIES FROM CITY PROJECT N0. 727 TO CITY PROJECT NO. 692 WHEREAS, Transitory Ordinance No. 16.64 provided $55,000 to be allocated to City Project No. 727, and WHEREAS, it has been determined to be in the best interest of the city to transfer $55,000 of special revenue monies from City Project No. 727 to City Project No. 692, NOW, THEREFORE, BE IT RESOLVED that the city staff is author- ized and directed to transfer $55,000 in special revenue funding from City Project No. 727 to City Project No. 692. Bergh Acting City Clerk /6 Q t CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No. 329 Agenda September 8, 1980 The Honorable Mayor and Members of the City Council City of Richfield Council Members: Subject: Certification of Delinquent Sewer and Water Utility Accounts There is a resolution on the September 8, 1980 city council agenda designating the annual accumulation of unpaid sewer and water utility accounts. Although the Richfield utility ordinance places unpaid water and sewer charges as a lien against the property, some homeowners have traditionally chosen to have the charges certified and included in their annual property tax billing. A $10.00 Certification Charge (preparation for certification to taxes of delinquent accounts) shall be charged against each delinquent account as authorized by Ordin- ance 8.12 subd. 12. The attached resolution represents those delinquent accounts which have occurred from August 30, 1979 through August 30, 1980. It is recommended that the city council adopt this resolution certi- fying delinquent water and sewer accounts. RESOLUTION CERTIFYING UNPAID SEWER AND WATER SERVICE CHARGES TO THE COUNTY AUDITOR TO BE COLLECTED WITH OTHER TAXES ON SAID PROPERTIES WHEREAS, Ordinance Code 8.23 establishes rules, rates and charges for water service in the City of Richfield, and WHEREAS, Minnesota Statutes 44.075, Subd. 3, provides that all delinquent water service ck~arges not paid may be certified to the County Auditor with the taxes against such property, and shall be collected with other taxes on such property, and WHEREAS, Ordinance Code 8.12 establishes rules, rates and charges for sanitary sewer service in the City of Richfield, and WHEREAS, Subd, 12 thereof provides that all sewer service charges not paid within fifteen (15) days after the quarterly due date may be certified to the County Auditor with taxes against such property, and shall be collected with other taxes on such property, and WHEREAS, an assessment roll has been prepared specifying the amounts which shall be certified against each particular property. A copy of this resolution is attached. Chairperson RESOLUT{ON N0. 1-80 WHEREAS, the Metropolita~~ Aircraft Sound Abatement Council, a joint citizen/ user advisory group to the Metropolitan Airports Commission on environmental matters has continuously studied methods of reducing aircraft noise impact; and WHEREAS, the Metropolitan Aircraft Sound Abatement Council is tide longest standing joint advisory group of its kind in the Country and has established a national reputation for its constructive achievements in dealing with aircraft noise related problems; and WHEREAS, the Metropolitan Aircraft Sound Abatement Council strongly supports the concept of a secondary reliever airport system to serve as a reliever to the Minneapolis/St. Paul International Airport guaranteeing the viability of Inter- national as an air carrier facility; and WHEREAS, the Metropolitan Aircraft Sound Abatement Council recognizes the need for a system of reliever airports in the Twin Cities metropolitan area to meet the needs of air carriers, business operators, and private aviation activities; and WHEREAS, the Metropolitan Aircraft Sound Abatement Council has implemented programs to reduce aircraft noise impact for the benefit of the majority of persons residing near Metropolitan Airports Commission system airports; and WHEREAS, the growth of general aviation in the Twin Cities metropolitan area has continuously grown requiring a system of reliever airports to reduce pressures on Minneapolis/St. Paul International; and WHEREAS, the Anoka County Airport is the only facility capable of limited development to meet the increased aviation needs of the northern metropolitan area communities; NOW, THEREFORE, BE IT RESOLVED, that the Metropolitan Aircraft Sound Abatement Council strongly objects to the designation of the Anoka County Airport as a perman- ent minor role facility limiting the airport's regional potential in meeting the needs of general aviation, and BE IT FURTHER RESOLVED, that the Metropolitan Aircraft Sound Abatement Council strongly objects to the downgrading of the Anoka County Airport as a secondary reliever airport to the disadvantage of the metropolitan system of airports for the purpose of serving the parochial interests of one community, r RESOLUTION N0. 1-80 (cont.) -2- t BE IT FURTHER RESOLVED, that the .Metropolitan Aircraft Sound Abatement Council strongly urges the Legislature of the State of Minnesota to permit the appropriate development of the Metropolitan Airports Commission systems of airports as outlined in the Metropolitan Council Development Guide to meet the needs of the metropolitan area as a whole by designating the Anoka County Airport as an intermediate facility. Passed this day of 1980• APPROVED: Chairperson Technical Advisor ATTEST: Secretary . ~s'~~ CITY OF RICHFIELD, MINNESOTA Office of City Manager Council Letter No. 327 Agenda September 8, 1980 The Honorable Mayor and Members of the City Council City of Richfield Council Members: Subject: Amendment to Off-Street Parking Permit Lyndale Hardware At the August 25, 1980 city council meeting, the city council approved an off-street parking layout for the Lyndale Hardware Store. Mr. John Sief, representing 5 & M Corporation, owners of the Lyndale Hardware Store, has subsequently requested that the off-street park- ing permit be amended to allow the construction of an additional 2,331 square feet of office space to the second floor of the bu7_d- ing. This additional space will he occupied by three additional tenants. No changes in the size or design of_ the parking lot are proposed. The parking lot approved by the city council provided 100 off- street parking spaces. City off-street parking guidelines indicate that for the existing 26,433 square foot building, 133 spaces would be required. It would require 12 additional spaces for the addition- al 2,331 square feet of office space. Since no new spaces are prop- osed, the total development will be 45 spaces short of the number of spaces required by city guidelines. It is the opinion of the staff that this shortage could lead t.o parking problems during peak busi- ness periods. This off-street parking shortage could be made worse when on-street parking spaces are eliminated on Lyndale Avenue. When the Lyndale Hardware lot is full, customers will park in off- street parking spaces owned by adjacent businesses, which would possibly have a negative impact on adjacent property owners. It is the staff's opinion that, because of the problems dis- cussed above, a minimum of 12 additional off-street parking spaces should be provided. Alternative methods for providing such addi- tional off-street parking spaces are as follows: 1. Lyndale Hardware could purchase additional land to provide more parking This is an unlikely possibility, as adjacent property is slated for other uses in the L/H/N Redevelopment Plan. i Council Letter No. 327 -2- September 8, 1980 2. Lyndale Hardware could enter into a shared parking agreement with adjacent property owners to make addi- tional parking available to Lyndale Hardware customers. The total number of spaces available would have to be sufficient for all parties covered under the agreement. It is the staff's opinion that a sufficient number of spaces would still not exist under this option. 3. Lyndale Hardware could petition to vacate Circle Place. Currently, 16 parking spaces exist along Circle Place. Lyndale Hardware would only gain half of the right-of- way (30 feet) if Circle Place were vacated. According to city guidelines, 44 feet would be necessary to provide 20 foot deep parking spaces and a 24-foot wide driving aisle. The city may want to maintain public access on Circle Place for future development in the area. If the street were vacated, an access easement could be maintained to assure such access. A variation of this alternative would be to vacate only the north 26 feet of Circle Place. This would provide space for 16 additional spaces and a sidewalk along the building. The remain- ing 34 feet of right-of-way would provide a sufficient driving aisle, and would maintain access for future development. 4. The city could develop a parking lot as indicated in the redevelopment plan on the three lots west of the building now occupied by Star Auto. Such a lot could provide approximately 50 additional spaces for businesses in the area. The development of such a lot is questionable, and at least a year away. This alternative would not solve the immediate parking shortage for Lyndale Hardware. It is recommended that the city council approve the amendment to the off-street parking permit with the stipulation that Lyndale Hardware provide a minimum of 12 additional off-street parking spaces. It is further recommended that Lyndale Hardware should proceed to petition for vacation of the north 26 feet of Circle Place to accomplish this. Respectfully submitted, ;' Karl Nollenberger City Manager KN/eja CITY OF RICHFIELD, MINNESOTA office of City Manager Council Letter No. 326 Agenda September 8, 1980 The Honorable Mayor and Members of the City Council City of Richfield Council Members: Subject: Request for Approval of Phase II, Hub PUD Final Development Plan: Hub Shopping Center Property, Special Use Permit, Offstreet Parking Permit and Vacation of a portion of Pillsbury Avenue History On February 12, 1979, the city council approved a preliminary plat, PUD plan and rezoning for the Hub/Summit/Penny's PUD. The PUD plan indicated that the development would be completed in four phases, with each property owner responsible for the improvements to be undertaken oh their property. At that time, the council also considered a request for the vacation of Pillsbury Avenue between 65th Street and 66th Street. The council delayed setting a public hearing on the proposed street vacation until one of the following events occurred: 1. Issuance by the city, pursuant to an application and the filing of a final development plan by Penny's Super Diarket, Inc., or United National Corporation with respect to its own property, of a special use permit allowing development pursuant-. to a final development plan covering: a) the proposed North Addition; or b) the proposed Market Addition; or c) the proposed Financial Institution/office building 2. The elapsing of two and one-half years after the effective date of the rezoning to FC-2, or 3. A joint request by Penny's Super Market, Inc. and United National Corporation that the hearing be scheduled at an earlier date. On August 13, 1979, the city council approved a final develop- ment plan, special use permit and offstreet parking permit for the Phase I site and building improvements on the Hub Shopping Center property. United National Corporation is now requesting city council ap- proval of a final development plan, special use permit, and offstreet ~ parking permit to allow them to complete Phase II site and building improvement work on their property. Council Letter No. 326 -2- September 8, 1980 Proposal Improvements which United National Corporation are proposing to construct in this phase include the following: 1. Building improvements will consist of the construction of a new freestanding restaurant in the south parking lot approximately 106 feet east and 173 feet south of the shopping center. The res- taurant will be approximately 75 feet northeast of the Minnesota Federal Building. The restaurant will be a Burger King restaurant with a seating capacity of 96. The restaurant will be integrated into the planned mall addition, when it is constructed in Phase III. The restaurant will be 39 feet by 98 feet and will have a height of one story. Building materials will be brick, wood and glass on the walls with a wood shingle roof. Landscaping will consist of juniper and red barberry in bark chip planting beds along the south and east sides of the building. 2. Concrete curbing and an eight foot wide sidewalk with handi- capped ramps and bomanite crosswalks will be constructed on the west side of the south parking lot. 3. A catch basin will be constructed in the southwest corner of the south parlcing iot. 4. Existing curbs on Pillsbury Avenue will be removed and pavement will be repaired. 5. Four new concrete curbed and landscaped end islands would be constructed in the northwest corner of the United National property. 6. Three light standards would be removed and replaced by two new light standards in the northwest corner of the United National property. 7. The parking area in the northwest corner of the United National property would be restriped as shown on the site plan. 8. A four foot concrete sidewalk would be constructed on the north side of the Korner Plaza store. 9. A low sign would be constructed in the southwest corner of the United National property and a pylon sign would be constructed on the north side of the United National property. Zoning and Other Ordinance Requirements 1. Section 3.34A, subdivision 5 of the zoning ordinance requires that, prior to commencement of any construction or development of the land, and after rezoning, an applicant shall submit a final develop- ment plan, consistent with the council-approved PUD plan, and an ap- plication for a special use permit for said development. A special use permit in conformance with the final development plan must be obtained before the PUD district can be devoted to the uses provided in such plan. In this case, the property owner must submit a final development plan and obtain a special use permit for development of the property for each phase of the overall Hub/Summit/Penny develop- ment. Council Letter No. 326 -3- September 8, 1980 2. Section 3.41 of the ordinance code requires that it be dem- onstrated that the development would not be detrimental to the public welfare, and Section 3.34A, subdivision 3 requires that development be coordinated with subdivision regulations. 3. Section 4.05 requires that an off-street parking permit must be obtained for parking areas in commercial zoning districts, and sets standards with which parking areas must comply. Council Stipulations on PUD Plan Phase I At the February 12, 1979 city council meeting, the council ap- proved the PUD plan, preliminary plat and rezoning, subject to stipu- lations which were agreed to by the developer. The developer, United National Corporation, was to incorporate these stipulations in the final development plan. The council's stipulations are: 1. That the plan be brought into compliance with the Urban Design Guidelines of the Lyndale/Hub/Nicollet area; 2. That the parking lot be redesigned to effectively park and move traffic in accordance with design standards of the city and county. All driving aisles and access must be dimen- sioned on the plan; 3. That new signs must conform to the Lyndale/Hub/Nicollet Urban Design Guidelines as adopted by the city council; 4. That, if within the United National Corporation parking lot, cars are allowed to overhang public right-of-way, United National Corporation be responsible for replacement of any damaged city property; 5. That all transformers be protected as per city code and screened when visible to the public; 6. That a separate sanitary sewer line be provided for the kitchen waste at the proposed restaurant. This line should have a grease trap and interceptor to prevent grease from plugging the sanitary sewer line. 7. That an eight foot sidewalk be constructed at the rear of Korner Plaza. 8. That the unprotected light standards southwest of Korner Plaza be temporarily protected. 9. That end islands without trees be all concrete as per the Urban Design Guidelines. 10. That all end islands should be landscaped (trees) or concrete. Council Letter No. 326 -4- September 8, 1980 Staff Findings `l~he staff has reviewed the proposal and found the following: 1. That the vacation of Pillsbury Avenue between 65th Street and 66th Street would have to be accomplished before the site im- provements could be constructed, because they would be within the existing public right-of-way, 2. That the proposed final development plan is in substantial compliance with the PUD plan previously approved by the city council. The financial institution which was to be constructed in Phase II was constructed in Phase I and the restaurant which was to be con- structed in Phase I is now proposed to be constructed in Phase II. The size of the restaurant is 3130 square feet, which is 4870 square feet smaller than the restaurant approved as part of the PUD plan. This reduction in size will not be detrimental to the project or the general public welfare, however. The reduction in size results in an increased amount of parking available and increased building separation until construction of the mall addition. The setback from 66th Street will be the same as that for the restaurant approved as part of the PUD plan. 3. That the PUD plan stipulations will be met as follows: a. The plan conforms to the urban design guidelines. b. The final development plan indicates that all new signs will conform to the urban design guidelines. Sign details have not been provided as of yet, however. c. No parking will overhang public right-of-way. d. One transformer pad will be constructed in Phase II, and will be screened from 66th Street. It will be visible from the Hub center. It will be completely screened from the public when the mall addition is constructed. In the interim, the transformer should be protected from damage by automobiles. e. A separate sanitary sewer line, grease trap and in- terceptor will be provided as required by the city. f. The final development plan indicates that only a four foot sidewalk will be provided. An eight foot sidewalk would leave only a 22 foot driving aisle, which is two feet under the minimum required by city guidelines. A six foot sidewalk would provide a sufficient driving aisle and additional pedestrian space. United National Corporation has indicated that they would provide a six foot sidewalk. g. The final development plan indicates that no light standard protection will be provided. United National Corporation has indicated that they will protect the light standard. h. All end islands constructed during Phase II will be either landscaped or of concrete. Council Letter No. 326 -5- September 8, 1980 4. The development will not meet the following off-street parking standards: a. Eighteen-foot deep parking stalls, instead of 24-foot deep stalls, are indicated along 65th Street, Pillsbury Avenue, adjacent to the Summit Bank property, adjacent to the financial institution, and adjacent to the driving aisle to the west curb cut on 65th Street. b. Twenty-two feet wide driving aisles, instead of 24-foot aisles are proposed in the western portion of the north parking lot. c. A twenty foot wide driving aisle is shown immediately north of the restaurant, instead of the twenty-four foot wide aisle required by city guidelines. It is the opinion of the staff that these departures from city off-street parking guidelines will not result in conditions which will be detrimental to the general public welfare. The departures are necessary to maximize the number of parking spaces available, and the dimensions provided should be sufficient due to the trend toward smaller cars. Staff Recommendations Based on review of this application, the staff would recommend the following: 1. That the city council approve the final development plan and special use permit subject to the following stipulations: a. That design details of all new signs should be approved by staff. b. That the transformer adjacent to the restaurant should be protected from automobiles. e. That a six-foot wide sidewalk should be provided at the rear of Korner Plaza. d. That an easement for buses to use vacated Pillsbury Avenue right-of-way be provided. e. That United National Corporation provide a performance bond or other acceptable security. 2. That the city council approve the off-street parking layout and authorize the city manager to execute an off-street parking agreement by passing the attached resolution. This approval should be subject to the stipulation that the site work to be constructed within the Pillsbury Avenue right-of-way shall not begin until after Pillsbury Avenue is vacated. 3. That the city council set October 13, 1980 as the public hearing to consider the vacation of Pillsbury Avenue between 65th Stree~. and 66th Street. There are several such items on the council agenda of September 8, 1980. Fencing The Babe Ruth organization has requested that the pony league field in the east youth baseball complex (in the vicinity of the golf course) be extended. It is also necessary to fence the youth athletic complex from the golf course. We have recently experienced some problems with patrons and participants of the youth baseball and softball activities parking at the golf course. Fencing in this area should help solve that problem, and provide additional protec- tion to the substantial investment at the golf course. Quotations were obtained from three companies to provide the 1,960 feet of 48" chain link fencing and the necessary posts, tie-ins and other fittings necessary for the city staff to install this fencing. Crowley Fence Company submitted a written quotation in the amount of $4,950. Amco Steel Fence Company, Inc., submitted a writ- ten quotation in the amount of $5,538. Crown of Minnesota, Inc., submitted a written quotation in the amount of $5,030. It is recommended that the city council approve the purchase of fencing materials, as described, from Crowley Fence Company, in the amount of $4,950. Funding for this purchase is through the capital improvement program's appropriation for minor park improvements. Carpeting for Ice Arena Lounges A portion of the funding in the Ice Arena Improvement Project provides for carpeting of the lounges at the Richfield Ice Arena. Quotations were solicited from ten firms for this work, to include removal of existing carpet, floor preparation and installation of new carpeting, with all work to be completed in September, 1980. It is recommended that the city council authorize the purchase of carpeting for the ice arena from Minneapolis Builders Supply Company, in the amount of $2,271.00. Grass Seed The Rich Acres Golf Course has recently opened all 18 holes of the regulation course for play. Although the course is open for play, it is essential that a seeding program continue. A constant reseeding program will be necessary for a three to five year period. After that time, occasional seeding will be required following un- favorable weather conditions or heavy use of the facility. To establish a favorable turf for playing conditions, five steps must be followed: 1. Eradication of undesirable species; i.e., crabgrass, clover, etc. 2. Insuring seed contact with soil through thatching and cultivation. 3. Fertilization. 4. Seeding. 5. Irrigation. When the golf course was under construction and first seeded, 90 pounds per acre of blue grass was applied to the disturbed areas, and 60 pounds per acre to undisturbed areas. It is recommended that ad- ditional seeding be done this fall, and that 30 pounds per acre now be applied. Over a 60 acre area, this amounts to roughly 1,800 pounds of seed. The best time to seed is just prior to cooler fall temperatures and moisture conditions. This period is between August 15 to September 15. In establishing the turf during construction and the subsequent seeding programs, O.M. Scotts, Inc., products have been used. This product is manufactured only by O.M. Scott in that the chemical mix- ture is a hybrid bluegrass with Baron Victa and.Bristol in certain percentage. In order to provide the best possible playing surface, it is necessary to continue using this product. Council Letter No. 322 -3- September 8, 1980 The quotation frdm O.M. Scotts, Inc., would provide the required 1,800 pounds of grass seed for $4,680. Starter fertilizer will also need to be ordered. By purchasing 40 units of the starter fertilizer from O.M. Crabgrass is an annual plant which, upon heavy traffic, can be spread over a large area quite quickly. To stop the spread of the plants, it is necessary to stop the development of the seeds before they become mature plants. This approach is the most effective, as it is directed at the plant during its weakest stage of development in its life cycle. Control measures should halt development of the seed but not affect established turf areas. These resolutions provide for the following certification: 1. Resolution certifying special assessments for weed destruction. This is a one-year assessment at 8% penalty. 2. This is the assessment roll for diseased tree removal on private property which has been performed by the City at the request of the property owner. The assessment is certified at the city's actual cost of the tree removal, less the amount of the city and state subsidy for which the removal qualifies. These applications were sub- mitted to the Office of Local and Urban Affairs, a section of the State Planning Agency, for Land and Water Conservation Fund Act (LAWCON) monies and state natural resource fund monies through the Legislative Commission on Minnesota Resources (LMCR). We recently were notified that the preliminary application for the Monroe/Fairwood Park complex has ranked high enough to be eligible for submission of a final grant application. The project is tenta- tively eligible for $143,750 in programmed state funding assistance. The city would be required to provide funding for the remainder of the project cost, which is currently estimated to be $256,250, for a total estimated project cost of $400,000. The deadline for submission of the final grant application is October 3, 1980. It is recommended that the city council adopt the attached resolution, authorizing submission of the final grant ap- plication and confirming the city's long-range commitment to devel- opment of the Monroe/Fairwood Park complex. RESOLUTION AUTHORIZING FILING OF FINAL APPLICATION FOR GRANT TO DEVELOP OPEN SPACE UNDER THE PROVISION OF THE STATE NATURAL RESOURCE FUND WHEREAS, the State Natural Resources Fund provides for the making of grants to assist local public bodies in the acquisition and development of outdoor recreation projects, and WHEREAS, the City of Richfield desires to develop certain land known as Monroe/Fairwood Park, which land is to be held and used for permanent open space, and WHEREAS, in order for the proposed project to be eligible for approval, there must be proof that it is part of a comprehensive outdoor recreation plan and five-year action program, or capital improvement program, and WHEREAS, the City of Richfield has an original or revised five- year action program, or capital improvement program which includes Monroe/Fairwood Park, and WHEREAS, it is estimated that the cost of developing said interest(s) shall be $400,000, NOW, THEREFORE, BE IT RESOLVED by the city council of the City of Richfield, Minnesota, as follows: 1. That the application be made to the Office of Local and Urban Affairs of the State Planning Agency for a grant from the Nature Resource Fund (Minnesota Law, 1979, Chapter 333, Section 31, Subdivision 3, paragraphs (j) and (k) for an amount presently estimated to be $143,750, and the City of Richfield will pay the balance of the cost from other funds available to it. 2. The council requested that the committee investigate the possibility of establishing parking restrictions in this area. Presently, parking is not allowed on the south side of 73rd Street. The committee decided, after review, that establishment of further parking restrictions on 73rd Street would force parking onto neighboring residential streets, and create yet additional parking congestion problems. The committee recommends no change. 2. 6640 5th Avenue: Request for Parking Restrictions The council also requested that parking congestion in front of this address be investigated. Fifth Avenue is used for on-street parking by city hall visitors, when the city hall parking lot fills up, particularly on days when court is held at city hall. These monies have enabled Richfield to purchase per- sonal health services from the City of Bloomington and to maintain our local environmental health programs. In the year 1980, we anticipate approximately $82,915 in subsidy through this grant program. On August 27, 1979, the city council approved by resolution a two-year Community Health Services Plan, covering the period 1980-1981. However, since it is not very feasible that long- range projections from 1979 to 1981 would be very accurate, the state therefore requires that the anticipated 1981 budgetary plan approved by the city council one year ago be updated. For council review, the following changes are proposed to the 1980-1981 Community Health Services Plan: 1. Local participation has been reduced to $138,562, from $167,651, to more accurately reflect our share of costs for personal and environmental health services. With the anticipated state subsidy of $85,716, our new total expenditures of $224,278 is down from the previously pro- jected total expenditures of $253,367. 2. The cost of the personal health services provided through our contract with Bloomington are expected to increase, due to inflation, from the previously proposed $86,400 to approximately $93,650, which would be an increase of $7,250 in 1981 over 1980. 3. The environmental health activity, as included in the original 1979 plan, projected a budget of $129,234. The 1980 portion of the 1980-1981 plan proposed a budget of $97,850, which was $31,384 less than in 1979, due to the reorganization and budgetary reductions implemented in the fall of 1979. However, the projected costs of the en- vironmental health activity for 1981 has been amended to reflect an increase of $6,849, due to inflationary pressures. ~. Stephen Hachig, representing House of Prayer Lutheran Church, has submitted an application for a special use permit to allow a day care center use at the House of Prayer Lutheran Church, located at 7625 Chicago Avenue.. The property is zoned "R", single family residential. State statutes indicate that a day care operation for fewer than 10 children is a permitted use in residential zoning districts. When 10 or more children are involved, local. approval is necessary. Day care operations of 10 or more children are considered schools under terms of Richfield's zoning ordinance, and the operation of schools in an "R" zoning district requires the issuance of a special use permit. The proposed day care use is a "Latch Key" operation. Latch Key day care operations are for school age children only, including children in kindergarten. The projected enrollment for the proposed day care use is 30 children between the ages of 5 and 12. The facilities to be used at the existing church are approximately 7,645 square feet, plus limited use of the existing outdoor recreational facilities. Pdo new construction is contemplated. Zoning Ordinance Requirements 1. Section 3.41, subdivision 5 governs the issuance of special use permits. 3. Section 3.30, subdivision 2, paragraph 1 allows schools in "R" zoning districts by special use permit only. Staff Findings The staff has reviewed this request and found the following: Council Letter No. 315 ~ -2- September 8, 1980 1. The 2. The Richfield Fire Division has inspected the facil- ities and indicated that the necessary changes are being made in order to meet the fire code require- ments for this building use. 3. The staff feels that, based on projected enrollment and the hours of usage, the increase in traffic due to the use would not be significant and would not ad- versely affect the surrounding area. The children will attend the day care program only before and of ter school. Therefore, the heaviest increase in traffic would occur in the morning at approximately 7:00 a.m. to 7:30 a.m., and in the afternoon at approximately 4:30 p.m. 4. Sufficient parking is available on the site. Adjacent property owners on the west side of Chicago Avenue have indicated that a parking problems occurs along Chicago Avenue because of the existing nursery .school use, and have in the past filed a petition requesting that "i1o Parking Anytime" restrictions be established on the west side of Chicago Avenue. The day care re- quest should have no affect on this situation because the entrance is on the Elliot Avenue side of the church property. 5. An outdoor play area is available on the site and is sufficiently screened and setback to avoid disruption of adjacent residential land uses. Staff Recommendation Because this application is in substantial compliance with the conditions governing issuance of special use permits, the staff recommends that the city council approve issuance of this special use permit, with the following stipulations: 1. The amount of time each child spends at the center will depend of their regular school hours, their parents working hours, regularly schedled school vacations, etc.. The fee for part time kindergarteners is $35.00 per week. For school age part time children, the fee i~ $30.00 per week. Full time enrollment for both groups is $9.00 per day or $45.00 per week. The space alloted for the centers activities is Fellowship Hall and classrooms 3 and 5, c~:ith limited use of the surrounding outdoor playground. It is our intention to provide a ~-yell qualified day care facility which will meet the needs of the community as c~:ell as provide an effective atmosphere for growth and learning. The day care will provide a safe, secure atmosphere, where children can build lasting relationships with the staff, other children, and the church. House Of Prayer Day Care{Latch Key will be operated by Marian and Ruth Garrison. Marian has completed a ten month course at Suburan Hennepin County Area Vocational Technical Center in Eden Praire in Child Development. The training included working is nursery schools, day care centers, elementry schools, and working with mentally and physically handicapped children. She received a teachers assistant certificate. She also to;~k general education courses at St. Mary's Junior College and Metropolitan Community College and received her Associate of Arts Degree in Child: Development. Ruth trraduated from the University of Minnesota in 1979 with a Bachelor of Arts Degree in Speech and Communications, emphasizing interpersonal, small group dynamics. In 1978, she helped re-establish a day care facility located on 36th and Bioominoton, in south Minneapolis. She designed and carried out many of the administrative duties and assisted in hiring a complete staff. She has the legal qualifications to be a head teacher, and has taught as a substitute at the day care. She has also had training in first aid and emergency treatment through her caork as a nursing assistant at the Veterans Fiospitol. The scheduled hours of the day care required that we hire an assistant to meet the teacher/child ratio. An assistant has not yet been hired. We are looking forward to working c-rith the community. The property to be disposed of was formerly known as the Amoco Service Station and the Betty Crocker Pie Shop. Both are located in the vicinity of 66th Street and Lyndale Avenue. The parcels contain 8,697 and 9,442 development square feet, respect- ively. The planning commission found the proposed sale to be in conformance with the comprehensive plan. The terms for disposition of this land were part of a de- veloper's agreement between the city and the S & M Company which was also considered by the council on August 25. The terms reflect consideration to the S & M Company for the easements which the city is purchasing to undertake improvements to Lyndale Avenue and 66th Street, and consideration for damages to the facility because of the loss of off-street parking adjacent to Lyndale Avenue, and the resulting "costs to cure.:' The city will convey this property, valued at approximately $73,000, to the developer and pay an additional $75,000. This transaction, valued at $148,000, represents a settlement with the developer for the damages to his property. If the damages are not negotiated, it would be necessary that they be determined under condemnation pro- ceedings. A condemnation settlement could be significantly higher. The notice of public hearing for second reading of the attached transitory ordinance was published in the Sun newspaper on August 27, 1980. ^ ~' Council Letter No. 314 -2- September 8, 1980 It is recommended that the city council hold the scheduled public hearing, and after consideration of testimony, give second reading approval to this transitory ordinance to permit this rehabilitation project to get underway. Demolition was appropriate because the building was vacant and the site is needed for improvements to 66th Street and for the proposed S & M Company, Lyndale Hardware, renovation project. Subsequent to teat action, the staff was authorized by the city council on June 23, 1980, to negotiate the sale of salvageable property. Ordinarily, all salvage rights are awarded to the demoli- tion contractor. However, because of the restaurant equipment re- maining in this building, and the interest expressed by potential buyers, it appeared that the city could attain a better financial position by selling the salvageable equipment directly to purchasers. Quotations for salvageable items on this property were solicited after various city departments identified items which they could utilize. The offers for direct sale of equipment total $5,098.55. A list of the buyers, items, and quotations are attached. On August 25, 1980, bids were opened for the demolition of the building. The bid minutes and tabulations are attached for council review. It is recommended that the city council approve the bid minutes and tabulations, and award the contract to Carl Bolan~ier & Sons Company, the low bidder, in the amount of $5,500.00. It is also recommended that the salvage bid list be approved and that the items listed be sold to the specified parties at the specified prices. The net cost of demolition, i.e., demolition less salvage from di- rect sales, will be $401.45. This net cost does not include the value of the property salvaged by city departments. Because the proposed vacation would have caused access problems to the Richfield Medical Group offices at 8 W. 65th Street, the portion of 65th Street adjacent to the Richfield Medical Group offices was not vacated at that time. The portion of 65th Street between Pillsbury Avenue and the Richfield Medical Group offices was vacated, however. Summit Bank and Richfield Medical Group have now filed a joint petition to vacate the remaining portion of 65th Street between their properties. A map showing the portion of street to be vacated is attached for city council review. The staff has reviewed the street vacation petition and found the following: 1. The petition is in proper form and has the required number of signatures to initiate the street vacation process. 2. The proposed vacation is in compliance with the LHN Re- development Plan, and is necessary for implementing that plan. • 3. All Richfield Medical Group access issues have been resolved. Summit Bank will provide access easements to Richfield Medical Group over the portion of 65th Street to be vacated and over the road immediately west of the Richfield D7edical Group building. 4. Necessary utility easements will be maintained. 5. Traffic flow will not be hindered because 65th Street has been relocated as part of the LHN public improvements. 6. Twenty-one additional offstreet parking spaces will be available to bank and medical group customers. 7. There will be a reduction in street maintenance costs.
