Program. • Congress .has appropriated six .million dollars for the entire .country-for Innovative Projects Program Applications; Title I Housing and Neighborhood Preservation Grants. While the total. amount of money for the entire country '' • is quite small, ~e Y~iave been discussing the possibility of f-ding a grant applie,a- tion with Minneapolis, St. Paul and .the Metropolitan Council. The purpose of the grant application would be to provide research funds for evaluation and up dating various p ojects in Minneapolis, St. Paul and Richfield to'insure that the proposed Metrop litan Countsl Investment Framework will promote .private in- vestment in thee. entral cities and first ring' suburbs. The grant application would :be made in the amount of $4Q0, 0;00, of which the City of Richf eld would receive approximately $30,000. Our arrangement -.with the other pa ticipants in the application is such that the grant application would be prepare and administered by the City of St. Paul so that the applica- tion and adminis ration process for the City of Richfield would require only a minimal amount f time. The Richfield portion of the- grant application would be .used for the L/H/N project toupdate the present development strategy and to evaluate how federal, tote and metrop liLan policies can be strategically and effectively applied to ,enhance. the success of theL/H/N ,project. The specific work elements which :.'could-be carried ut if the grant is made would consist of the following: 1. 'Consideration of this proposal' as an extra; item will make it possible to give second reading consideration to the• amendment on June 14, 1y76 so -that the ordinance can become effective at the .earliest possible date. `• ~. Recently the city council has taken action to improve city. ordinances dealing with massage parlors and prostitution. The proposed ordinance" amendment, of which a copy is attached, would 'be compatible and complimentary to these other. two recent ordinance changes by providing another resource to deal with these ..:community problems • The proposed or finance amendment subjects the operator of a business,-the owner, the employes and the patrons to arrest and prosecution for being present in a disorderly house. A disorderly house is any place where prostitution, illegal safe of intoxicating iquor or non-intoxicating liquor, or gambling :occurs. . i It is the recom endation of the Public Safety Director and the City Attorney, • in .which. AMENDMENT TO CHAPTER X, PART • •I IT, SECTION•10.16 OF THE ORDINANCE CODE OF THE CITY OF RICHFIELD -CITY OF RICHFIELD DOES ORDAIN: Chapter X, Part III, Section 10.16 of the Ordinance Code of the City of Richfield relating to miscellaneous misdemeanor offenses is hereby amended by adding subdivision ' i2 to read as follows: "Subd. 12. Participating in a Disorderly House. _ No person-shall own, lease, operate, maintain, reside in, visit or entice or attempt to entice another to reside in or visit any building or place with knowledge that prostitution as defined in Subdivision 10 of this Section, lewd, lascivious or ni decent acts, gambling or the unlawful sale of intoxicating liquor or non-intoxicating ma t liquor occurs therein. - Evidence of the general reputation of such a building or ~1ace as one where any of the foregoing occurs shall be prima facie evidence of such knowl-edge. Gentlemen: Council Letter No. 133 Agenda April 26, 1976 Subject: Report an the Proposed Metropolitan Transit Commission Fus Garage Environmental Impact Statement The City of Richfield has received a copy of the draft environmental impact statement prepared by the U. S. Department of Transportation for the. MTC bus storage facility construction project. The city has an opportunity to review this draft environmental impact statement and prepare written comments for submission • to the Department cf Transportation for inclusion. in the final environmental impact statement. Environmental Impact Statement Process The purpose of an environmental impact statement is to .provide information t~ the funding agency (in thin case, the Department of Transportation) and other interested parties . The .EIS is an advisory document, prepared by the funding agency and submitted to interested or affected parties for review and comment. • The written camments of the interested parties in response to their review of the draft EIS are included in the final Environmental Impact Statement. Contents of a Draft Environmental Impact Statement Draft Environmental Impact Statements are required to include a statement of purpose, description of the proposed action, and an analysis of the environmental effect. This environmental analysis must inc ude both the long range and the s or range impact of the proposed project on man, and his phy~ica~l,'social and eco` no surroundings. The analysis of impact an the environment must a so inc'^1u ed an analysis of the secondary and cumulative effects of the .proposed action. (The secondary or in erect consequences of an action are often the ..changed patterns of social and economic activities which might arise because of the proposed project. Such secondary factors to consider. include population and growth, land use, public services, and resource space.) . Council Letter No. 133 ~ -2-- Agenda April 2fi, 1976 The environmental assessment. of the impact of the proposed project must also discuss any conflicts which may exist between the proposed action. and local land use plans, policies, and .controls; and describe the extent of reconciliation between the proposed project and the local policies. . The environmental assessment is also concerned with the physical. envir- onment, such as air quality, noise, hazardous substances, energy supply and redevelopment and construction. A final. major part. of a draft. environmental impact statement addresses, alternatives. Thealternatives to the proposed project must be described and a summary of the environmental impact of the reasonable alternatives be included. Some alternatives might be: 1. Taking no action 2. Postponing action for further study 3 .Significantly .different actions which could provide similar benefits Based on review of the nature of the proposed project, and the requirements outlined above for the content of the draft EIS, city staff. recommends that the city develop comments in the following areas• 1. Additional Data: The city should provide additional information • regarding the impact on housing stock, residential dwellings along the north frontage road, and secondary impact on Richfield's southern- mostneighborhoods which could result from the proposed action. The city should also address the issue of congestion on the frontage roads and I-494 and 12th Avenue-Portland Avenue arteries. The city should also request inclusion in the data of the secondary and cumulative effects of noise and air contaminents arising from the project and',the general social impacts of the project on the city as a whole . 2. Criticism of the Data: There are obvious mistakes, fallacious con- clusions and conflicts in the data which is contained in the draft EiS. These'. conflicts and mistakes should be pointed out in the city's comments, An effective means of testing the data would be to duplicate the test data through use of a credible testing firm, provide cumulative and secondary data and draw conclusions from our testing process. Twin ity~ Testing could be used to provide this service. 3. Criticism of the Draft EIS Itself: As summarized the draft EIS deviates . substantially from the requirements of .federal regulation. The city should point out the discr~~anries in the draft environmental impact statement as related to federal requirements and request the Department a. Council. Letter No . 133 -3- April 26 , 1976 of'Transportation to amend and complete the statement in accord with the requirements The .city's comments are to be relayed to the Department of Transportation no later than May 30. It is the recommendation of the planning director, in which, I concur, that. the city develop comments along the lines outlined above to prepare for inclusion in the final environmental impact statement. Because the HRA has no acquisition funds at this time,. it will be necessary to borrow; funds from the city to accomplish the purchase of this .property. The recommended procedure provides that the IRA and the city execute a loan agreement for the borrowing of the money, with the understanding that the HRA will repay the borrowed funds to the city with interest. The city council will have to execute the attached loan agreement and resolution before the HRA may proceed with the purchase of • this property.. . The estimated amount of the city loan will be $42, 000, This amount would cover the purchase price, which has not yet been negotiated, and the cost of relocation. The home is a 1 1/4 story frame dwelling which was built in 1947, It has 876 square feet on the first floor with two bedrooms. The city assessor's office has recorded a current market value for this-property of $31,30'0. The loan from !the city would be paid back with interest by the end of three . years. The interest rate would be five percent per annum ($2,100. per year) on the unpaid balanc ~. The interest on the loan would be paid from two sources: 1. Until the land is needed for the L/H/N project, the home would be rented. Gross rental income would be $250-$280 per month. 2. School. With- the closing of Wood-lake Elementary.School at the end of the current school year, the school crossing signal located at this site on 66th Street will no longer be necessary. Hennepin County has requested permission to remove this-pedestrian traffic signal after the completion of the current .school year. - The county'~,request is based on the possibility that the school property . may be redeveloped into residential use in tiTe future acid that primary access to the site maybe on West' 66th Street. Even though such. an access may be at the existing signal location, and the traffic generated meets traffic signal warrants, the existing equipment would not be suitable and. a completely new signal would bed necessary. Subject; Ordering of Project and Preparation of 'Plans and Specifications far Washington Park Tennis Courts On April 26, 1976 the city council approved preparation of an agrEement with John Turriftin to provide consultant services for preparation of preliminary park plans for the Washington Park redevelopment. .Council members will _ recall that thes',e preliminary plans are to be prepared before construction of the four nevi= tennis courts at Washington Park is started. However, in order • • to insure completion of the tennis ccurts during this summer, it is necessary to order the project and authorize preparation of plans and specifications for the tennis cou snow. It should be noted that the city council in 1975 allocated a total of $fi0, 000 in revenue sharing money for tennis court construction. Two new tennis courts and a practice court have already been constructed at Donaldson Park. The remaining dollars in the tennis court construction project will be used to construct the four-new courts at Washington Park. Construction of these courts was approved by the city council at the March 18, 1976 hearing on the 1976-81,i Capital Improvement Program. Plans and specifications would be prepared by city staff . Therefore , it is recommended that the city council order construction of ~ new tennis cou is at Washington Park and authorize the preparation of plans and specifications hrough the attached resolution. Raaen, R. Richardson., and J. Wilde . •. The committee met with Mrs.: Estelle Rudek, representing petitioners for stop signs at 66th Street and Standish. Avenue. The following recommendation was made by the committee: "No Parking Between Signs" to be installed on the east side of Standish. This would prohibit parking for approximately 100 feet from the corner.. The petitioner was informed of this recommendation and also told that the Public Works Department will stripe the roadway to provide hat vehicles rounding the corner move into the inner traffic lane. The committee considered two additional petitions for two-way stop signs: 75th and Xerxes, stopping 75th Street traffic.. The committee review.of traffic counts, accident reports and site visits indicate that this intersection does not .meet any of the criteria for installation of stop signs. The committee recommender: that no stop signs be installed at this intersection. Thepetitioner will be notified of the committee recommendation. 68th and Logan: The committee review of traffic counts,. accident reports and site visits indicate that this intersection does not meet any of the criteria for insta118tion of stop signs. At that time j the council expressed cgncern that the proposed amendment would not provide for any type of council review before the centers could begin operation. The city council requested that-the city staff consideralternate methods of regulation and submit a new proposal. . The city attorney has prepared a proposed ordinance amendment which would provide that the city council grant a "certificate of occupancy" for group day care homes in an "R" district. This ordinance amendment -also provides. that an applicant for such a certificate must make _ .application which would be accompanied by a petition from the abutting property owners. showing the extent to which they approve. The certificate could be -granted by the council with or without a hearing, as the coucil would deem appropriate.
