The city .council deferred action until the City of Rich- field ~ould obtain an expert review of this property.. That review has n t been. completed as of this date and a final report will not be av ilable until the August 23, 1976 city council meeting. Theref re, it is recommended that the city council continue to defer ~ ction on this parcel until the August 23, 1976 meeting.. 2. Parcel 46530-6310 (7727 Wentworth Avenue, Mrs. M. There are now 52 •parking spaces fewer than the ..number required; the proposal will make them 93 spaces short. RICHFIELD DOES ORDAIN: .Chapter IV of the Ordinance Code of the City of Richfield regulating use of streets, public ways, grounds I• and places is hereby amended by adding thereto section 4.16 to read as follows: "4.16 REGULATING ACTIVITIES ON BODIES OF WATER PIITHIN TIE CITY. Subdivision 1. Definitions.. 'Bodies of Water' means Richfield Lake, Wood Lake, Legion Lake, Mother's Lake, and all other lakes, streams, ponds, e wetlands, marshes, water courses, and ponding areas situated in whole or in part within the city. Subd. 2. Activities Prohibited. Suk~.ject to the except~.ons contained in Subdivision 3, the following activities are prohibited on bodies_.of water ~•7i thin the city. ~'~ .___._.~ ~~~~ Swimming or bathing except at areas'officially_ designated as swimming beaches and signed as such. (2) 'The use of any boat, raft or~any other device or object designed to support or bony up any individual, in, upon, or attached to such device or object. (3) The placement or occupancy of ice fishing houses or enclosures or other similar structures regardless of their size or construction. (4) Snowinobiling. Subd. 3. Exceptions. The above described activities may be conducted on bodies of water if: (1) The activity is done by or at the express direction of city personnel for rescue, law enforcement~or maintenance parposes. • (.2) The activity is city sponsore or supervised and cannot reasonably be carried out in other areas of the city where such activity is not prohibite . -2- ~- ;, (3) The activity is sponsored by a group, .association or .organization which applied for and received a permit for such activity pursuant to subdivision 4 of this section.. Subd. 4. Permits.. A group, association or organization wishing to sponsor or conduct any activity describe in Subdivision 1 of this section shall apply to the city manager not less than l0 days before such planned activity for a permit to conduct that activity. The application shall be on forms prepared by the city manager. No permit shall be issued unless the dity " manager determines that the proposed activity: l) Could not reasonably be conducted, in areas of the city where such activity is not prohibited. (2) Will not be likely to disturb the residents of property in the area of the planned. activity. (3) Will not be likely to create or cause crowd control or traffic or maintenance problems. (4) Wi11 not interfere with other activities previously scheduled for the area. ~5) Is proposed for an area which is designed to facilitate such activity. The city manager may limit the time of the activity, the area where the activity iai11 occur and may mpose other con itions upon the conduct of the proposed activity. The manager may also require as a condition far issuance of the permit an indemni~ bond holding. the city harmless from liability of any kind or character and .reimbursing the. city for any property damage or clean up costs. Subd. 5. Cancellation of Activity. The: city manager may cancel or terminate any activity permitted under this section for such .a period as he shall deem necessary for public health or safety reasons or to terminate or prevent `~ breaches of the peace or_order. Aft r receiving a complaint-that the- truck had-::not been mocTed, the police division investigated again and a citation was issued in mid-July.: ...Council membe smay recall that this ordinance -previously restricted parking- of truck type v ehicles only in~areas zoned residential. In analyz4ng `the needs. of the fire division, the public safety director has determined that the city no longer -•has a practical use of this apparatus, a 1946 Ford .with- a 500 GPNI pump, The truck is now thirty years old and is only used in a second 'line, reserve status . It is `burrently hou ed at the west side fire station, The new mini-pumper has also been housed at the west side station to compliment ttie first line maxi-, pumper housed there, The combination.of the_rew mini-pumper and the maxi- pumper, .manned on a call-back basis, provides adequate first alarm fire resptlnse equipment for the west side station. The public Safety director has discussed the proposed, removal. of the 19.46.. . Ford fire pumpe~ from service with the Insurance Services Office, and has been assured that th removal of this truck will have no significant impact-on the .:city's fire insur nce rating. In fact, the I.S.;O, only credits. this. truck fora 25.0 GPM pumpi g, ability, rather than the full 500 GPM pumping ability, because of both its age ~nd reserve status. For all practical purposes, this piece of equipment has een fully replaced by the mini-pumper. . - • .Further,' th 1946 Ford pumping engine is not of suitable design nor does it have a sufficie t enginecapacity to give, satisfactory service .for the city's current fire servlice: demands . Its age makes obtaining repair .parts when needed extremely difficult. Purpose. It is the purpose of this section to provide for the establishment,. • at the discretion of the city council, of planned unit development (PUD) zoning districts on tracts ~~ of land which are suitable in location, area and . character for the use and for the structures. ~ ~ proposed. All such PUD zoning districts are to be planned and developed on a unified basis. • Suitability of the tracts of land for the de- velopment proposed shall be determined pr~.marily by reference to the city's comprehensive develop- ment plan and any redevelopment plan for the area which has been adopted by the city. Can- sideration shall be given to existing and surround- ing development when establishing a.planned unit development district. It is intended that-the provisions of this section and any additional re- quirements established by the city council in establishing a PUD district will accomplish the purposes of zoning 'as set forth in Section 3.27 Subdi.visign 1. F'stablishment of Planned Unit Development District. (1.) Ownership_ In order that the purposes of this section may be achieved, the land, buildings, and improvements in a proposed PUD district . shall be in a single ownership or under the . .management and supervision of a central author- .. ity, or otherwise subject to such long-term _ or other ownershi control as the cit leases P Y council may deem necessary to carry out :the provisions of this section. (2) Integrated Design.. The planned unit develop- ment will consist of a harmonious selection ~, of uses in groupings of buildings, services, parking areas, traffic and pedestrian circu- lation and open spaces and shall be planned and designed as an integrated unit. If a '~ proposed PUD district falls, in whole or in part, .within a redevelopment project, the PUD plan and design shall be integrated with the '~ general character of that redevelopment project. Planning Commission Review -'PUD Plan. Upon rec p and review of the concept proposal statement and receipt of the application and PUD plan, the planning director shall refer the-PUD plan to other departments .and agencies for review. Within thirty (30) days after t e receipt of the written concept proposal statement, PUD plan and application, the planning director shall- reco~xunend to tiie planning conunission either (a) approval of the proposal in the form submitted, or b) approval wi-' h modifications, or ~c) isapproval. P • -~~ I• The recommendation of-the planning director shall include findings of fact, and shall set ort the reasons for the recommendations specifying with particularity in what aspects the plan would- or would not be in the public interest, including but not limited to the following:- (a) The extent to which the plan departs from the zoning ordinance, subdivision regula- tions, comprehensive development plan an redevelopment plan, if any, otherwise ..applicable to the subject property, in- cluding but not l~_mited to density,. bulk and use, and the reasons why such departures are or are not deemed to be in the public interest. (b) The extent to which the plan does or does not make adequate provisions for public ser- vices, vehicular traffic control, air and lrght, recreation and visual enjoyment. (c) The nature and extent of open space, the adequacy of provision for maintenance and conservation of the common open space, and the adequacy or inadequacy of the amount and~unct n of open space in terms of the ensities proposed ~.n the plan. (d) The impact, beneficial or adverse, of the planned unit development project upon the neighborhood in which it is proposed to be established. (e) In the case of a plan. that proposes develop- ment over a period of years, the sufficiency of the terms and. conditions proposed to protect and maintain the integrity of the plan. (f) The relationship of the proposed structures to existing structures, to any redevelopment plan, and to anticipated future development of the area. ^ Within forty-five days after receiving the planning director's report, the planning commission shall hold a public hearing on the application. Within forty-five-days after the public hearing, the planning commission shall submit its recommendation to the city council. .The commission may recommend approval with or without riodification or recommend disapproval. " -8- Subd. 5. City Council Approval - PUD Plan. Fol_towing • action by the planning commission the city council shall consider rezoning the area described in the plan in accordance with the procedures set forth in this part. If approved, the are~~ shall be rezoned as one of the five types of~ PUD districts. Prior to the commencement of any constructior- or developrnent of the land and .after. rezoning the applicant shall submit a Final Development Plan, consistent with the-PUD plan, together with an application for a special use permit for the develop- . ment shown in such Final Development Plan. A special use permit, in con ormance with the approved Final De- velopment Plan, must be issued by a two-thirds vote of the council before the PUD district can be devoted to the uses provided for in such plan. Subd. 6. Final Development Plan. A Final Development • Plan shall consist of the following: (1) If required, a final plat of the Iand to be de- veloped. Upon approval by the planning director, the building permit .application along with the appropriate information required for building permits shall be submitted to the chief inspector who shall process the building permit in conformance with applicable building codes. ~ , Subd. 8. Bond for Confor_m_ance. Prior to the issuance '~, of a special use permit, the applicant shall provide the city with a performance bond in the amount of ten percent of the estimated value of the proposed buildings and improvements in the area designated as a planned unit development district conditioned on the satisfactory development of the PUD in accordance with the PUD Plan and Final Development Plan and any additional conditions imposed by the council.
