ORDINANCE .CODE OF THE .CITY OF RICHFIELD ADDING .SECTION 4.14 -CITY OF RICHFIELD DOES ORDAIN.: ~ Chapter IV of the Ordinance Code of the City of Richfield is amended by adding Section 4.15 relating to the hitting of golf balls in the public parks and other. public places and providing for penalties for such activity which reads as follows: "4..15 REGUL..ATING GOLF IN PUBLIC. PARKS. - ~. Subdivision 1. Definitions. The- following .terms shall have the.meanings.ascribed to them in this sectx.on: r.. (3) The ball mad not be hit from or into any location closer than 100 feet from any playground, tot lot, picnic area, walking or biking trail, parking lot, buildinq, structure or lake within the park. James 'Hansen, 6315 Logan Avenue, president of the' West Richfield Girls Softball 'Association, appeared before the city council to request that improvement of Monroe Park, scheduled in the. present Capital Improvement Program for 1978', be moved up to 1976. He also requested rearrangement of the two existing ballfields'plus;,addtion of one field with a backstop and other improvement The city council took no action on resched- cling the overall. park improvement project and declined to realign the existing fields: .However,. the council did. direct the. city manager to construct a third field at Monroe'Park with backstop, agrilime .and benches . After construction of the.,temporary third field was. begun, some .neighbors. in the. vicinity of Monroe Park requested that the field not: be installed. -At the council meeting on September 8, 1975, the neighborsappeared before the city .~ council. As -the neighbors also were scheduled to appear before the_ Park and RecreatiomAdvsory Commission on September I1, 1975; no action was taken- by the city council on September 8 . .The Monroe Park neighbors >did appear before: the Park and. Re creation Advisory Commission on September 11, 1975. At that time, it was decided that work on the field should ha t until the commission .could meet with both the neighbors and the special interest group at the. October 8, 1975 commission meeting. The city council confirmed this action on September 22, 1975. At the October 8, 1975 Park and Recreation Advisory Commission. meeting,,: extensive discussion was :held: on the subject. Several options were reviewed. These included continuing. with the present field locations, eliminating one' of the .existing: fields at Monroe and replacing it withahe new temporary field to maintain two fields at the. park, centralizing the West Richfield Girls Softba 11 , play on the existing two fields at Monroe ;and increasing the days of use_ per week, and many others. Law has asked that the attached. request from the Animal Humane Society. of Hennepin Comity be placed on the October L4; 197:5 agenda fore discussion. Recent amendments to state law have made, it possible for'the city to' legally donate to organizations such as the Humane Society. Requests .from the society in previous years have been rejected becabse of legal restrictions.. 'While. main- taining services. of the ma ynon-profit organizations operating within the comm- unity is certainly in the best interests of the city, our financial resources are stretched to, the legal'-limit just to support those; services for which the city is responsible; -Moreover, iin terms of value received, it would be far more ad- vantageou to 'use funds requested for this purpose to reinstate some. of the items cut from the proposed 1976 budget.' Therefore, it is recommended that the council deny the request. from the Animal Humane Society, .arid thereby .establish a precedent for declining, similar requests in the future. Law, Mayor City of Richfield 6700 Portland Ave. Richfield, MN 55423 Dear Mayor Law: The Animal Humane Society of Hennepin County cooperates with city and county authorities in the enforcement of the laws of the State of Minnesota pertaining to cruelty. to animals. In addition, it has the responsibility of promoting education and understanding for animals. • The Society is financed through memberships, donations, adoptions, and bequests from individuals. We are not receiving funds from outside organizations, such as the United Fund.. The increasing unwanted and uncontrolled animal population is creating a problem which affects everyone. The Society's budget has been increasing annually to meet these needs. However, we have now reached the. point where our dependency on voluntary contributions has made it difficult. Chapter 187 of the State Statutes amending Statute 1971, section 343.11 allows the County. Board of any county or the council of any city in which the Humane Society exists to appropriate for the maintenance and support of such socieities, in the transaction for the work which they-are organized, any sums of. money not otherwise appropriated,-not to exceed $4800 in any one year.. The Statute recognizes the problem which Humane Society are facing. In order to increase-the Society's services to combat the rising animal population, we estimate that it will be necessary to generate an additional total of $30,000 from Hennepin County. .This sum, we feel,: cannot be generated from our. voluntary sources due to their limited nature. In 1974, of the animals handled by the Society, 302 animals came from the. residents of Richfield. Re: Drainage Report, b2nd St. at 14th_Ave. and 15th Ave., Gentlemen: At your request we have completed the drainage study at the n- tersections at 62nd Street and 14th Avenue, and 62nd Street and 15th Avenue. Prior to the permanent street paving program, the city of Rich- field constructed storm sewers. and catchrlaasins at most inter- • sections throughout the city.., However, some intersections do . not have-catch basins because of the street slope or tre small quantity of storm water flow. It did not appear economically feasible to construct catch basins, but to .allow the water to flow in valley gutters across these intersections.. This is the :case at 62nd Street and 14th :and 15th Avenues. During the design of the permanent streets in this area, the. feasibility of constructing stormsewer`to these intersections was again..checked.. Again, it did not appear economically fea- sible to construct this storm sewer. A concrete valley gutter design-was also. investigated and it was not deemed necessary at-this time. The streets were designed with bituminous valley gutters to provide.. drainage for storm water across these inter- sections. These valley gutters have been used. successfully in other locations throughout the permanent street paving pro- gram, They do have a tendency to fill up with'snow and ice in the wintertime because the snowplow blade floats .across the valley gutter. During the summer small quantities of dirt will settle out during light rain storms when the flow is not sufficient for :flushng....purposes. The residents at 1401 and 1501 E: 62nd Street have complained about the noise the traffic creates going over the valley gutter, the small amount of dirt left after a'rain, and about the water stand- ing in the valley .gutter. The noise .that the traffic creates going over the valley gutter could possibly be controlled somewhat by installing a stop sign on 14th Avenue at 62nd. As we see. it, there are three possible courses of action to take: 1. Install approximately 800 feet of storm sewer to these inter- sections at a construction cost of approximately $16,500.00. 2. Install concrete valley gutters, replacing the bituminous valley gutters at a construction cost of $5,000.00. 3. Take no action at all, and leave the intersections as is. However, I have a few comments which l think you should consider. I reside next door and have watched the traffic for some time, which is very heavy. -With the few used cars they now have, with the prices affixed to the windshield, I have noticed cars going by suddenly stopping to I-ook at the cars which at times almost causes a rear end collision and ties up traffic. Also, they park the cars so close to the street that pedestrians either have to walk in the street or back around the cars. Perhaps you have noticed that at certain times. they parka semi plus other trucks and their own cars close to the street, making visibility poor for customers leaving the lot. As'it is now with these .two trucks, three or four used cars, a 2 wheel trailer, trash container and their, own cars on the lot, the customers have a hard time finding a parking place and end up parking across the street at the doctors' lot. Last winter they pl-owed out their driveway and parking lot about four times. at the most that customers and themselves got stuck. I used my snow blower several times to open a path for pedestrians and never received a thank you.. I realize we had more snow than usual Iasi year, but the winter before they didn't keep their driveway and lot plowed out much either. I feel a used car lot should not be located on a corner next to a freeway ramp or turnoff. Use your best judgment in this matter, but if you do grant a permit do not allow any trucks, campers or anything that will stick up high to spoil the looks of the avenue and interfere with visibility. The .staff was also instructed to survey the residents ~o-determine what type of parking restrictions they preferred. The results of this survey were presented to the city council at the September 22 , T 975 city council meeting . While-the results of the. survey do not indicate a strong desire to change. the established parking restrictions., manyresidents.who attended the September 22, 1975 hearing on the. subject requested further changes be'made. The staff recommendation in view of -the' survey results was that the existing. parking restrictions in the area of the high school be retained except for a few limited changes . After hearing the comments of those individuals attending the council- meeting the city council took the following action: 1. Adopted a resolution ordering the installation of ~"No Parking.8:00 A. Prior to making this request, the Minnesota -Highway Department has con- ducted two public meetings and a mail survey to obtain the reaction of affected residents to this proposed improvement. The proposed locations of the noise barriers shown on the attached plan recommended by the Minn- ~sota Highway Department reflects the desires of a majority of residents as indicated at the public hearings and by the mail survey. In addition to the proposals submitted by the Minnesota Highway Depart- ment, there are three additional areas which should be considered for noise barrier construction. East Side of 35W Between 6430 and 6400 Emerson Avenue The original survey conducted by the Minnesota Highway Department in- dicated adesire by the majority of the residents in this area to have no wall constructed. However, since that survey was conducted, the city has received a petition, of which a copy is attached, wherein eight of twelve affected residents request construction of a noise barrier wall in this area. It is the recommendation of the public works director, in which ? concur that the city ccu ncil request the highway department to construct a noise barrier wall in this area in addition to the walls proposed by the higrw+~ay department . v Council Letter No. 314 -2- October 14, 1975 V'Test Side of 35W Between 73rd Street and 76th Street i The State Highway Department did not propose a noise barrier wall in this area. However, it was the recommendation of the acting park and recreation director, in which I concur, that there should be a noise barrier v~~all along Donaldson Park. This matter was considered at the park and recreation advisory commission meeting and it is the row mmendation of the commission in which the department director and I concur that a noise barrier be installed in this area along Donaldson Park and the Church of Christ property. It is recommended that the city council request the highway department to install a noise barrier wall in this area in addition to the plans proposed by the State Highway Department. East Side of 35W Between 68th Street and 72nd Street The State Highway Department did not propose noise barrier walls along this area which would provide relief from highway noise to users of the Wood Lake Nature Center. In view of the heavy use made of the trail system at the Nature Center and the proximity of this trail system to 35W, it was the recommendation of the acting park and recreation director, in which I concur, that it would be in the best interest of the city park system, the Wood Lake Nature Center and users of the center for a noise barrier wall to be constructed in this area. Residents in the area were invited to the October 8 park a nd recreation advisory commission meeting to discuss this proposal. After discussion of this issue the commission voted to recommend to the city council that no wall be built along the Wood Lake Nature Center. However, it is still the recommendation of the acting park and recreation director and myself that the city council consider requesting the highway department to construct a noise barrier wall along Wood Lake. It would appear that it would not be nec- essary to construct a wall along the entire length. By referring to the attached map of the center it can be seen that there is a berm which runs along part of the nature center and it would not be necessary to construct a wall along the berm. However, it~is recommended that wall sections be constructed in the area north and south of the berm . Summary In summary, the following recommendations are made; 1 . That the preliminary plans proposed by the highway department be approved by adopting the attached resolution. 2. That the highway department be requested to add to their preliminary plans the noise barrier walls along the east side of 35W between Council Letter No. 314 -3- October 14, 1975 6430 and 6400 Emerson Avenue and on the west side of Emerson Avenue between 73rd and 76th Streets, 3. That the city council give consideration to requesting the construction of noise barrier walls along portions of the Wood Lake Nature Center with the understanding that the commission recommendation is against construction of these walls and the staff recommendation is in favor of such construction, It is the intention of the Minnesota Highway Department to construct such noise barrier walls which are approved during the 1976 construction season. Prior to commencing the final design of this project, it is necessary that the city council approve the location of the walls. As you may be aware, two public meetings-have been held in the Richfield- City Ha1.l regarding this project. The layout being submitted at this _ time reflects the input received from the people at these two meetings. Certain portions of the barrier were deleted from our original proposal because-the residents did nat want it. To ..arrive at the exact termini of .the barrier, we conducted adoor-to- door survey of -the neighborhood. A map showing how each homeowner ~nroted" in the survey was given to Mayor Taw at the last meeting (.Sep tember 25)• We believe the present layout we are submitting will satisfy the most people. Also, the survey asked the question of whether the people. wanted a wooden or a concrete barrier.. The results were 75~ in favor. of. wood. We are therefore recommending wood as the material of which the' wall will be constructed. . This-project is scheduled for a May, 1976 letting, with-construction to follow that sumuner. We feel the people-want the barrier as soon as possible, and we hope to be able to satisfy them. However, this means that .council approval is required- as quickly as possible. Any lengthy delay is approvals will push the project into the 1977 construction - season.
